COUNCIL MEETING MINUTES
May 25, 1976
Minutes of the regular council meeting held in the city municipal building
May 25, 1976.
Present: Mayor John O. Cotant, Jr. Councilmen Boyd L. Fullmer, Dwain A. Kinghorn,
Earl L. Romriell, Wayne G. Taylor, Attorney Don Burnett and Clerk Vera Armstrong.
Meeting called to order by Mayor Cotant at 8:03 p.m.
Mayor Cotant asked for corrections or additions to May 11 minutes. There being none
Councilman Kinghorn moved and Councilman Romriell seconded the minutes of May 11 be
approved as written.
PARKS AND RECREATION COORDINATION ON DEVELOPMENT OF PARKS - Donna Boe, Pocatello
City councilwoman informed mayor and council they are anxious to correlate park
development with the city of Chubbuck. Louis Archuleta also was present and
informed council two park developments are planned for the northern part of
Pocatello, one at Hawthorne Park and the other along the river at North Main
and North Arthur area.
Mr. Archuleta told council their next meeting is June 1st for a field trip of the
park areas. The regular meetings are held the 3rd Tuesday of each month.
Mayor told Mrs. Boe and Mr. Archuleta the city appreciated their interest and
our city would be glad to correlate park planning.
WIDENING OF EAST AND WEST CHUBBUCK ROAD - Earl Pixton, manager of Herzogs coin-
operated gas station expressed his feeling of the unfairness of the highway
department desiring 22 feet from the south side of East and West Chubbuck Road
and only 8 feet from the north side of East and West Chubbuck Rd.
Several residents of the city were present and voiced concern of street widening
on West Chubbuck Road. Mayor Cotant informed these residents there was no project
planned for street widening beyond Afton Street on West Chubbuck Road at this
time.
Frank McCurdy, 701 West Chubbuck Rd. asked councilmen why a walkway has not been
painted across West Chubbuck Rd. Councilman Kinghorn informed residents the city
have ordered school lights and signs designating a 20 mph speed limit throughout
this area but the city crews have been so busy they have not been able to install
them and Idaho Power has not been able to get power installed as yet.
AFTON STREET CLOSURE - Louis Hoge asked mayor and council what the city decision was
on closing Afton Street. Mr. Hoge also thanked the mayor and council for closing
the street the past two days. Mayor Cotant told Mr. Hoge the street would re-
main closed for the next two weeks as a test before a determination will be
made on permanent closure.
FINANCIAL CONSULTANT PROPOSALS - Edward L. Felsing of Bosworth, Sullivan and Company,
Inc. was present and presented council and mayor with a proposal concerning
financial consultant services for sale of water revenue bond issue. Mr. Felsing's
bid was for $2,600.00. The city has received two written proposals; one from
Idaho First National Bank for $30.00 per hour; a written proposal from Burrows,
Smith Company of Idaho for $7,500.00; a telephone call from Hanifen, Imhaff and
Samford, Inc. of Denver for $2,500.00. These bids vary somewhat because of
printing and publication costs that may be absorbed by one bonding consultant
but not another.
BUILDING CLAIM - Gene Galloway and Roland Hull were present again to check on
a determination of the claim they presented city last council meeting. Mayor
Cotant read two bids the city received from concrete contractors. The average
of the two bids was-$628.00. Mr. Galloway informed council they had not lost
quite as much as they thought in changing building location for their four-plex.
Councilman Kinghorn moved the city approve the claim for $628.00 and that dis-

held awaiting determination of insurance company if city is covered with this
type of liability. Councilman Taylor seconded motion. All councilmen voted
in favor of motion.
City clerk to send check at time of payment to Attorney Burnett so that he
might prepare a release form to be signed.
BUILDING PERMIT AND WATER AND SEWER SERVICE - John Harris, Jr. told council he has
purchased three acres of property on Tree Valley Road and would like permission
from city to apply for a well permit from Southeastern Health District.
After reviewing the history of the property which lies along Tree Valley Road
Attorney Burnett said property evidently is under jurisdiction of subdivision
ordinance and that no building permits can be issued nor can any utility services
be offered by city until the property is properly subdivided. This ruling
apparently affects all property east and west of Tree Valley Road.
BASEBALL RPOGRAM - Mayor and council discussed the Chubbuck baseball program. Mr.
Harris informed council they had had a call from Salt Lake City to join the
Boys Baseball League and he stated he felt this would be a good move for city.
A city recreation program was also discussed.
SEWER LINE ACCEPTANCE - MOBILE MANOR 2nd ADDITION - Max Parrish presented a letter
requesting the city accept the sewer line in Mobile Manor 1st and 2nd Additions.
Engineer Forsgren stated the sewer lines seem to be installed properly, his only
concern is if elevation is proper to hook into the line at boundary of Hendersons
Mobile Home Park.
After some discussion Councilman Romriell moved the city accept the sewer system
in Mobile Manor 1st Addition and Mobile Manor 2nd Addition with the exception
of sewer system on Eagle Street in front of Lots 13-22 Block 5 and Lots 1-10,
Block 8 with further provision that if lines are not at proper grade, Land Inv-
estment, Inc. will cause them to be corrected. Land Investment, Inc. represent-
atives approved the provision that they would be responsible for grade correction.
Acceptance also subject to inspection and approval of construction by Engineer
Forsgren and Public Works Director Jordon Stuart. Councilman Fullmer seconded
motion with all .councilmen voting in favor of motion.
Engineer Forsgren asked Max, Bart and Rodney Parrish to tag clean-outs in sewer
line on East end of easements in Mobile Manor. Bart Parrish stated they would
tag these for the city.
WATER HOOK-UPS TO SERVE LOTS which lie in Mobile Manor 1st Addition - Max Parrish
requested city make water hook-ups to serve the lots which lie directly south
of lots facing the south side of Chickadee Drive. City council agreed water
meter hook-ups would be put in as soon as city work schedule allows.
COUNTER CLAIM - MOBILE MANOR - Max Parrish questioned if city is going to take
action on his counter claim filed on law suit city filed against Mobile Manor.
Mobile Manor, Inc. have filed a counter claim for damages according to fact
city filed claim against Mobile Manor. Claim in the amount of $50,000.00
plus $5,000.00 additional.
Councilman Taylor moved the city deny the counter claim filed by Mobile Manor.
Councilman Kinghorn seconded. All councilman voted in favor of motion.
SEWER LINE IN OPERATION - Rodney Parrish asked when Land Investment, Inc. could hook into the Henderson Mobile Home Park sewer line.
It was reported Hendersons have two trailers in their park.
Councilman Taylor remarked that Hendersons should not have trailers in their
park until the sewer line is accepted and all easements have been transferred
and deeded to city.

Rodney Parrish asked if city owns the water line to Henderson's Mobile Home
Park on Hiline Rd. and if city would turn the water off because the water
line hasn't been accepted. Mayor Cotant said the city assumes Hiline Road
belongs to the city and also the water line on Hiline Road.
A discussion was had on Land Investments, Inc. negotiations with the
Hendersons on sharing cost of sewer line to serve the two developments.

Mayor Cotant said at this point the city is going to contact Hendersons
and stop the placing of trailers until park is developed properly.
Attorney Burnett said basically this is a private matter and said he felt
Parrishes were imputing powers to the city council they do not have.
FIREWORKS PERMIT - Clezie H. Lewis and Lynn W. Hoge has submitted a request for
a fireworks permit. Mayor Cotant asked Attorney Burnett to review the copy of
insurance coverage. No action was taken on permit application, however city
clerk polled city council by telephone following meeting and all voiced
approval of permit. Councilman Fullmer requested the fire chief inspect the
stand periodically to be sure they are only selling safe and sane fireworks.
Councilman Kinghorn said he felt that only adults should be allowed to sell
at stand.
CURB AND ACCESS APPROACHES at Triangle Service, Cinema Theatres, Green Triangle
and Golden West. Mayor told council the Traffic, Safety and Beautification
committee suggested approaches as a traffic control at the Green Triangle area.
City to plan a meeting with these commercial businesses.
MAILBOXES IN SUBDIVISIONS - Mayor and council discussed the placement of mail-
boxes in new subdivisions. Attorney Burnett to contact the postal department.
SICK LEAVE - Mayor and council agreed the new sick leave provision was to take effect at time it was discussed with employees.
PROPERTY SIZE FOR WATER TANK - Engineer Forsgren reported the property size for
water storage tank could be reduced to 240 ft x 165 ft. However, the city
would need an easement for construction and repairs.
BREAKDOWN ON WATER REVENUE BOND STORAGE TANK CONSTRUCTION - Engineer Forsgren
presented mayor and council with a cost breakdown for storage reservoir
and site construction.
Councilman Kinghorn moved for city to accept bid for the 1.5 MG reservoir which
was submitted by F. W. Kahley & Sons. Councilman Romriell seconded motion with
all councilmen voting in favor. Bid was $139,800.00
Councilman Fullmer moved to accept the lower bid of Empire Construction
of $57,593.96 for site preparation and underground piping. Councilman Romriell
seconded motion with all councilmen voting in favor with exception of Councilman
Taylor who abstained from voting.
FINANCIAL CONSULTANT - Councilman Taylor moved the city accept the financial consultant
services of Bosworth, Sullivan and Company, Inc. Councilman Kinghorn seconded
motion with all councilmen voting in favor.
PLANNING AND ZONING COMMISSION - Rodney Parrish has tendered his resignation as a member of the P & Z commission. Mayor Cotant recommended a certificate of

presented to Rodney Parrish as past member of Planning and Zoning Commission.
Mayor Cotant also recommended Jack Menard be appointed as a P & Z member to
replace Mr. Parrish and serve the remaining term. All councilmen were in
favor of this appointment.

CHANGE- 1st paragraph on page 61 -- Attorney Burnett stated that there is a
difference under the ordinances between a subdivision and a trailer park. A
subdivision is platted and recorded, and these acts result in automatic ded-
ication of streets and utilities to the city. However, while there is a
"plan" for a trailer park, the park itself is not platted or recorded, and
must be accomplished by separate legal documents. The trailer park ordinance
also does not specify when certain improvements contained in the "plan" must
be completed by the developer. In the case of a subdivision, these improves/~IFx
~n~s do not have to be completed before dedication, but there is a time
?mit f~r completion and a bonding requirement in the subdivision ordinance.
/he trailer park ordinance does not contain such a time limit or bonding
requirement.
CHANGE - 4th paragraph on page 61 -- Attorney Burnett stated that the trailer
park ordinance requires the issuance of a permit and payment of an annual
license fee in order to operate a trailer park. Aside from the question of
when improvements must be completed in relation to dedication, if any
utilities serving a trailer park are found to be inadequate or unaccept-
able, for health and safety reasons, the city could refuse to issue a permit.
