April 27, 1976
Minutes of the regular council meeting held in the city municipal building April 27,
1976.
Present: Mayor John O. Cotant, Jr., Boyd L. Fullmer, Dwain A. Kinghorn, Earl L.
Romriell, Wayne G. Taylor and Clerk Vera Armstrong. Attorney Burnett excused.
Meeting called to order at 8:05 p.m.
Mayor Cotant asked for corrections or additions to April 13 and April 20 minutes.
Roger Seaton has requested that it be added to April 13 minutes; The reason the
larger and deeper 12" sewer line was planned for his subdivision was to serve pro-
perty to the north, which he has an option to buy and plans to develop.
Mayor and council approved of this addition to the minutes. With no other additions
or corrections, Councilman Fullmer moved and Councilman Kinghorn seconded the minutes
be approved as written.
CITY IMPACT AREA - Four Planning and Zoning commission members were present and a
discussion was carried on in regards to the outlying areas of the city as an impact
area. This impact area needs to be determined by Bannock County, Pocatello City and
Chubbuck City according to Local Planning Act passed by Legislature in 1975.
The mayo~council and planning and zoning commission members decided the south
boundary of impact to be 1-15 and l~est to Rio Vista, North to Siphon, West to
~ WV ~ ~ ~ ....
Laughran Road, North to~.,E~'st to a point which lines up in a southerlyj
direction to the city water tanks and East Chubbuck Rd. -~
Mr. Branson is to answer the letter to Pocatello planning commission settin ~g~a~'
meeting for this planning.
MEETING FOLLOW-UPS - Councilman Fullmer asked if Attorney Burnett was going to
draw up an affidavit or agreement that Mr. Seaton will drill a well. Councilmen
also requested the time element to be specified in the agreement.
Councilman Fullmer asked if backstops for ball parks were being built yet. Mayor
Cotant reported Jordon Stuart plans to build them this week.
EL CIELITO RECEPTION CENTER requesting an amendment of ordinance to allow liquor
catering at their place of business. Mrs. Dan Kunz, Eugene Kunz and Kent Kunz
were present to inquire as to city's feeling on their request for this amendment.
Mayor Cotant reported Attorney Burnett had told him an amendment could be drawn
up to allow the liquor catering.
The Kunzes reiterated their request for the city to enact an ordinance to allow
liquor catering at their place of business on Whitaker Rd. which is in a Res-
idential - 2 zone.
Mayor Cotant told Mrs. Kunz their business could be in jeopardy because of the
drinking factor at their business. Their business is being operated on a con-
ditional use permit in a residential zone and Mayor Cotant sai:d i,f neighbors
complain perhaps their license could be withdrawn.
Mayor Cotant also told the Kunzes he felt the general feeling of the council
is they should not approve the request they are making. Councilman Kinghorn, Taylor,
Romriell and Fullmer supported the above statement made by Mayor Cotant.
It was noted by Mrs. Kunz and her sons that the city not allowing the con-
sumption of alcohol could be unconstitutional. They have discussed the situation
with an attorney.
RESOLUTION #2-76 - Resolution authorizing filing of application for grant on the
Bicentennial Park project was read in full by Mayor Cotant.
Councilman Taylor moved the council approve Resolution #2-76. Councilman
Fullmer seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes;
Romriell, yes and Taylor, yes.
INVESTMENT OF SEWER RESERVE FUNDS - City Clerk proposes to invest $8,000.00 47
into Time Certificates of Deposit. Councilman Kinghorn moved and Councilman
Taylor seconded approval for city clerk to make this investment. All other
councilmen also approved.
BAR X TRACTS - Mayor and Council reviewed the preliminary plat of Bar X Tracts.
Forsgren, Perkins and Associates has prepared this plat and all owners of Bar
X property have met and approved the drawing. It was noted Bannock County
will issue building permits. Mayor Cotant said he felt the county, when issuing
permits should notify the city.
Engineer Forsgren informed council if any of the Blocks as platted in the Bar
X Tracts Subdivision were subdivided again it would require platting of the
Block and presentation to Chubbuck City for approval of subdivision.
Engineer Forsgren stated all property owners in Bar X Tracts will sign the final
plat providing for easements for future public right-of-ways as now outlined
in the preliminary plat.
Councilman Romriell moved the council approve the preliminary plat presented.
Councilman Fullmer seconded motion. All councilmen were in favor.
Councilman Kinghorn suggested a letter be sent to the Planning and Zoning
Commission informing them of the legal aspect of city issuing building permits.
County will issue permits and county will enforce Uniform Building Code.
ALTURAS PARK SUBDIVISION - Mayor Cotant informed council that Roger Seaton had
requested to put in their own water hook-ups. If they were not able to do this
then they requested they be allowed to pay only a partial payment on the water
hook-ups until the meter is put in. Mayor and Council determined water hook-
up fees would need ~ paid in advance of construction of installing meters and
in the full amount as oridnance requires.
Attorney Burnett to provide city with a provision that will allow the city to
require issuance of an occupancy permit.
Engineer Forsgren informed council,Alturas contractors would be required to
water settle water and sewer lines.
TRAILER VARIANCE - Velbert Jackson was granted a variance January 8, 1976 for a
period of six months only to operate a business from a mobile unit provided
he install water and sewer services.
Mayor Cotant said Attorney Burnett to contact Mr. Jackson in regards to this
variance provision he has not complied with.
LIQUOR CATERING -Mayor and Council requested Attorney Burnett thoroughly research
the law to find out where the city might stand in declining to issue catering
permits anddeclrinin~/request to amend ordinance to allow the wedding reception
the liquor catering provision.
WATER LINE UNDER INTERSTATE - Engineer Forsgren reported the boring under the
Interstate for water line would cost approximately $56.00 per ft. according
to contractor that just completed a contract for Mountain Bell.
INDUSTRIAL DEVELOPMENT - Mayor and council discussed the possibility of making
it known the city has industrial property within the city. Mayor and council
want Attorney Burnett to research into legality and manner in which this
could be advertised throughout the country. Jack Menard will also do some
follow-up work on this.
MEETING FOLLOW-UPS -1) Building permit fees for churches-Councilman Fullmer asked
if citY had decided to waive building permit fee for churches. 2) Sewer hook-up
for church at Quinn and Hawthorne-Engineer Forsgren told Councilman Fullmer the
Pocatello City would run their camera through the line again for a locati~n.
3) Drai~qge on Valenty Road- Mayor Cotant asked that a work order be m ~ up
