March 9, 1976
Minutes of the regular meeting of the mayor and council held in the city
municipal building March 9, 1976.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd Fullmer, Dwain Kinghorn,
Earl Romriell and Wayne Taylor~& Clerk Vera Armstrong.~ - Attorney Burnett
and Engineer Forsgren after 9:00 p.m.
Mayor Cotant asked for corrections or additions to February 24 minutes. Councilman
Kinghorn moved and Councilman Romriell seconded the minutes of February 24 be
approved as written. All councilmen in favor or motion.
PUBLIC HEARING ITEM: Rodney J. Parrish has appealed a decision of the Planning
and Zoning Commission denying a variance request on zoning of Lot 11, Block
2 less the west 60 feet and on Lot 22, Block 2, less the west 60 feet, Mobile
Manor Subdivision, to allow the placement of a mobile home on each of these
two lots as presently located. The property is presently zoned Mobile Home
Residential (R-2T). The city council is formally holding a public hearing this
evening on this matter.
Several residents from Mobile Manor Subdivision were present and voiced objection
to the division of Lots ll and 22, Block2as requested. Dick Anderson and Robert
Olsen both voiced objection to granting of variance.
Rodney Parrish presented a petition with 58 signatures approving the placement
of trailers on lots ll and 22, Block 2 as now placed. However, some of the
signatures were residents of M~bile Manor 1st Addition.
Rodney Parrish presented a lot~layout whereby Lots 11 and 22, Block 2, if divided
into three lots, would apparently comply with the zoning frontage and square
footage requirements.
Attorney Burnett was not present and matter tabled briefly until Attorney arrives.
After arrival of Attorney Burnett, Mr. Burnett informed council there is a fund-
amental distinction between developer of subdivision, an entity under developers
control or completely separate new owners. The present owners have redrawn lot
lines and it seems to be a transparent way to avoid compliance. This change
is inconsistent with the spirit of subdivision ordinance and a variance would
be required.
After a thorough discussion Councilman Kinghorn mov6d the council affirm the
action of the Planning and Zoning Commission denying the variance request of
Rodney Parrish on zoning of Lot 11, less west 60 feet, Block 2 and Lot 22,
less west 60 feet, Block 2, Mobile Manor Subdivision. Councilman Taylor
seconded motion with all councilmen voting in favor of motion.
Attorney Burnett informed council the city could grant a modification or
waiver of lot lines of plat submitted and approved.
Rodney Parrish at first requested a modification and waiver of subdivision
platting on Lots ll and 22, Block 2 Mobile Manor Subdivision but then withdrew
the request.
ORDINANCE #164 - Amending Ordinance #112 in regulating livestock was read in full by Mayor Cotant and accepted as the second reading.
DOG CONTROL - Mayor Cotant informed council the city needs a dog catcher as it is
necessary that Mr. Burrows give up the job. The city also needs to make new
arrangements for the boarding and disposal of dogs within the city.
EXTENDED BUNCE SUBDIVISION FINAL PLAT - Jim Baird, Forsgren, Perkins and Associates
presented the final plat of the proposed Extended Bunce Subdivision. The final
plat has not been reviewed by the Planning and Zoning Commission and Mayor
Cotant requested the plans be presented to the Planning and Zoning Commission
for review.

BUNCE SUBDIVISION PROPOSED SEWER LINE Engineer Forsgren reported the Whitaker
Road sewer line would carry the proposed Bunce Subdivision sewage plus other
development in the general area and will serve by gravity flow if sewer goes
south along Buffalo Rd. or west to Whitaker Road and then south to Chubbuck Rd.
Attorney Burnett presented a memorandum on condemnation of property for a
sewer easement. Mayor and council of same general opinion that if easements
cannot be secured for this line a pumping station will need to be approved.
NAMING OF WELL #1 PARK - R. B. Bistline has requested the park at this location
be named the "Martha Bistline Park" Councilman Fullmer has discussed this
with the Chubbuck Lions Club and they see no reason why it should not be so
named.
MULTIPLE DWELLING CONSTRUCTION with 30 foot frontage on public right-of-way and
reasonable efficient access thereto. This type of development was discussed
at length. Attorney Burnett asked Engineer Forsgren if he had any suggestions
that might be added or changed prior to codification of ordinances. Mr.
Forsgren said he would research the requirements of other cities.
FINANCIAL STATEMENT for February presented to Mayor and Council.
CLAIMS PRESENTED to Mayor and Council. Mayor and council stated the city should
call for bids on purchase of water pipe or any and all purchases of $5,000.00
or more·
Councilman Taylor moved and Councilman Fullmer seconded the council approve
the payment of claims. All councilman voted in favor.
GENERAL FOLLOW-UPS:
1. Sidewalks - City discussed participation in sidewalk construction on
Hawthorne Road. It was agreed budget would need to be finalized before
it would be known if any funds would be available.
2. Chubbuck Bicentennial Day Celebration - August 7th was suggested. Clerk was
requested to inquire as to date baseball tournament will be held and
perhaps Bicentennial celebration could be held in conjunction with the
tournament.
As there was no further business Mayor Cotant declared meeting adjourned at
11:45 p.m.
