HomeMy WebLinkAbout02 24 1976 CM19 COUNCIL MEETING MINUTES February 24, 1976 Minutes of the regular council meeting held in the city municipal building February 24, 1976. Present: Mayor John O. Cotant, Jr., Councilmen Boyd Fullmer, Dwain Kinghorn, Earl Romriell and Wayne Taylor. Attorney Don Burnett and Clerk Vera Armstrong. Meeting called to order at 8:00 p.m. Mayor Cotant asked for any corrections or additions to the February 10 minutes. There being none Councilman Romriell moved and Councilman Kinghorn seconded motion the minutes be approved with all councilmen approving. BICENTENNIAL REPORT - Shirley Hendricks presented the following proposals as a result of their meeting recently held. The committee plan two small projects. (1) Flag poles in each of parks, (2) Selling flags and encouraging every resident to fly the flag.. M Hendricks rs. s~a~eo the committee are considering the possibility of developing a park with possible construction of a pavilion. The committee plans also to solicit other service organizations to participate in building of park benches, playground equipment, etc. The committee would like to plan and hold a parade in conjunction with Chubbuck Days with a flag raising ceremony at park and a barbecue and games following. The committee suggests naming the park "Bicentennial Park". Mayor and council felt Dean Lloyd of Mortgage Insurance should be consulted about naming of the park since it lies within Paradise Acres Subdivision and is being given to city by them. The committee is meeting again March 2 at city municipal build- ing. ALTURAS PARK SUBDIVISION - Roger Seaton, developer, Val Williams and Jim Voeller, engineer, were present presenting the proposed development of Alturas Park Subdivision. Mr. Seaton is concerned if the city has sufficient water for him to go ahead with his subdivision plans. Engineer Klane Forsgren presented a Chubbuck water supply report which indicated the city water supply is at capacity until such time as the large storage tank and transmission lines are completed. Engineer Forsgren also commented to council and Mr. Seaton that good development plans should require a well for every square mile of development. Mr. Seaton told Mayor Cotant, Council and Engineer Forsgren he would agree to drill a well on the present subdivision if the city would eliminate the park requirement. Mr. Seaton added that if he developed the fifty acres to the west at a later date, he would then buy a pump for the well. In a further discussion of water supply, Mayor Cotant told Mr. Seaton the city hoped the storage tank area problem would be solved within a week and possibly a definite answer could be given. Mayor and council voiced approval of the proposal of Mr. Seaton furnishing a well in lieu of the four lots set aside for a small park, however, it will require Mr. Seaton to furnish one lot for the well. Mayor Cotant asked for the engineer to run a study for recommendations as to casing size of well. Mayor and council recommended t~-location of lot to place well be close to Chubbuck Road. Councilman Romriell moved the council approve the above proposal made by Roger Seaton. Councilman Taylor seconded motion. All councilmen voted in favor of motion. DOG PROBLEM - Jack J. Menard informed council there is a very serious dog problem on East Chubbuck Road. Mr. Menard also voiced objection to the city building a dog pound. Mayor and council also discussed increasing the impound fee on dogs. 21 GENERAL Mr. Menard also suggested stop signs be put on all streets leading to arterial streets. Mr. Menard also informed the mayor and council that all the police officers were in court last week while he was doing jury duty, leaving the city un- protected by police except by back-up call of county police officers. Mr. Menard also reported box cars are parked on railroad tracks on East Chubbuck Road blocking view of oncoming vehicular traffic on East Chubbuck Road. Council decided Attorney Burnett would write to Railroad Company in- forming them railroad cars are parked within a very unsafe distance from the street. Mayor Cotant requested police department take pictures of the situation for record. ORDINANCE # 148 - Adopting 1973 Edition of the Uniform Building Code and all future editions as published by the Association of Building Officials by resolution, requiring the city clerk to maintain on file in the Chubbuck city offices three copies of the code, etc., was read in full by Mayor Cotant. Councilman Taylor moved to dispense with rule of reading Ordinance #148 on three separate days. Councilman Kinghorn seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, no; Taylor, yes. Councilman Kinghorn moved Ordinance #148 be approved. Councilman Fullmer seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, yes; Taylor, yes. EXTENDED BUNCE SUBDIVISION - Mark Bunce was present and requested an answer as to city approval for him to proceed on his subdivision final plat. Mayor and council discussed the proposed sewer location to serve the proposed Extended Bunce Subdivision which has been west to Buffalo Road and south to East Chubbuck Road. The other alternative discussed would be west to Whitaker Road and then south to East Chubbuck Road. Klane Forsgren reported that Gary Carlsen has said he will sign the sewer easement if it goes south on Buffalo Road with the following provisions. (1) A sewer stub-out be provided at his home location and (2) that he will not be annexed for a period of five years unless he subdivides his own property. Councilman Fullmer proposed the engineer make a study as to the capacity of the Whitaker Road sewer line before making a definite decision as to where the sewer line should be installed to serve the Extended Bunce Subdivision. Council were all in favor of proposal. ORDINANCE # 163 - Rezoning the proposed Extended Bunce Subdivision from Agricultural Transitional to Single-family Residential (R-l) and rezoning a piece of property lying within the Mobile Manor 2nd Addition subdivision from Agricultural Tran- sitional to Mobile Home Residential (R-2T) was read in full by Mayor Cotant. A lengthy discussion followed in regards to Mobile Manor 2nd Addtion plat. Councilman Romriell moved to dispense with rule of reading Ordinance #163 three separate days. Councilman Taylor seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, yes; Taylor, yes. Councilman Taylor moved to adopt Ordinance #163. Councilman Fullmer seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, yes; Taylor, yes. Councilman Kinghorn moved that the R-2T rezoning is being approved with the understanding that certain paired lots lying directly south of Chickadee Drive be sold in pairs only and the council have the city clerk enter into the record ORDINANCE #163 23 that it is the city council's understanding that in approving the R-2T zoning that Mobile Manor 2nd Addition be developed as Mobile Home Residential (R-2T) and not as mobile home court development. And further that the city clerk send copy of minutes to Land Investment, Inc. in order to make them aware of the basis upon which city council passed the Rezoning Ordinance #163. Councilman Fullmer seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, abstained from voting; Taylor, yes. NAMING OF PARK AT WELL #1 -Mayor and council discussed the request of R. B. Bistline for park at Well #1 location to be named "Martha Bistline Park". Councilman Fullmer suggested consulting with the Chubbuck Lions Club as they are developing park and propose to name the park. SEWAGE PUMP HOUSE AT PARADISE ACRES - Dean Lloyd of Mortgage Insurance has re- quested permission to paint "Paradise Acres" on sewage pump house in the Paradise Acres Subdivision. Mayor and council would like to know exactly what they plan to paint on pump house and make sure it is compatable to ordinance. ZONING ORDINANCE AMENDMENT - Mayor Cotant asked council to consider amending zoning ordinance to allow chain link fences to higher than the three foot now allowed by zoning ordinance for front yard fencing. STORAGE TANK - WATER - Mayor Cotant informed council of a conversation he and Councilman Taylor had with Harry Hart in regards to the purchase of additional property for use of construction of new water storage tank. Mr. Hart made it clear if he allowed his property to be sold and used for water tank storage he wants definite assurance the city will not drill a well on property. Attorney Burnett stated he could prepare a document stating city will not place well on this additional property nor on the original piece of property city has storage tanks on. ORDINANCE # 164 - Amending Ordinance #112 regulating livestock was read in full by Mayor Cotant. Council accepted the reading as first reading. GENERAL DISCUSSIONS: 1. Terteling and Sons Water Request - Councilman Romriell asked if the Mayor was going to inform Terteling & Sons the city does not have sufficient water to serve a subdivision south of the City of Chubbuck. City feels that as a result of the water survey and growth within the city the water supply will not be adequate. 2. Purchase of Gargage truck - Attorney Burnett advised city of legal procedures in regards to this purchase. 3. McOmber Sewer Service Line - Attorney Burnett reported he had been corres- ponding on this. 4.Requiring bond on subdivisions at time of final plat approval. 5. Codification of Ordinances - Mayor Cotant suggested notifying the Book Publishing Company of the city's desire to contract for their codification service. Council also agreed that Attorney Burnett will cooperate with codification and also improve upon ordinances as recodified. Attorney Burnett's services to have a ceiling of $2500.00, if additional services over this amount should be required, it shall be necessary for council to approve additional costs. 6. Fire Exits - Mayor Cotant requested Fire Chief Denny Jones and Police Chief Arnold Stone check with Green Triangle on compliance to Uniform Building Code in regards to the fire exits.
