Cotant, Jr., Councilmen Dwain Kinghorn, Earl Romriell and Wayne Taylor and Clerk Vera Armstrong. Meeting called to order at 8:00 p.m. Mayor Cotant asked for corrections or additions to December 9, 16 and 19 council meeting minutes. There being non~ Councilman Taylor moved and Councilman Romriell seconded the minutes be approved. All councilmen voted in favor. There being no other carry-over business of 1975 Councilman Romriell moved to adjourn sine-die. Councilman Kinghorn seconded motion with all councilmen voting in favor. Mayor Cotant re-called meeting to order at 8:10 p.m. Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, Earl L. Romriell and Wayne G. Taylor. Attorney Burnett (excused until 8:50 p.m.) and Clerk Vera Armstrong. ADMINISTRATION OF OATHS City Clerk Vera Armstro~administered the oaths of election to the newly elected councilmen, Boyd L. Fullmer and Dwain A. Kinghorn. Mayor Cotant presented certificates of election to newly elected councilmen. APPOINTMENTS - Mayor Cotant recommended Earl L. Romriell be the new chairman of the council. Mayor Cotant appointed the councilmen to serve over the various departments as follows: Boyd L. Fullmer - Parks and Recreation Department and represent- ative for the Traffic, Safety and Beautification Committee. Dwain A. Kinghorn - Water Department and council member to serve on P & Z Commission. Earl L. Romriell- Sewage and Sanitation Departments, Southeast Idaho Council of Governments representative and Bicentennial repre- sentative. Wayne G. Ta~lor - Police and Street Departments. Mayor John ©. Cotant- Fire Department & Urban Transportation Committee PARK DEVELOPMENT ON EAST CHUBBUCK ROAD - Dean Woods and Cary Campbell ~ ' presented a cost estimate for the development of the park at Well ~1 area they propose to develop as a Lions Club project this ~ summer. ~ Dean Woods requested permission to have the ground breaking ceremonies for the park development on January 31st. Engineer Forsgren reported he had contacted Fort Hall Irrigation Company requesting a release of canal easement to develop a portion of the park upon and the written release should be sent to city in the near future. PUBLIC HEARING ITEM: CONTINUED AND CARRIED OVER FROM SEPTEMBER 4, 1975 PUBLIC HEARING - Land Investments, Inc. have requested rezoning from Agricultural Transitional to Mobile Home Residential (R-2T) on property owned by Land Investment, Inc. which lies south of the Kynaston property and directly west of Mobile Manor Addition ~1 to the east edge of their property zoned Light Industrial. Mayor Cotant read Planning and Zoning minutes of which the re- zoning request was approved January 13, 1976 - Page 3 3 Councilman Romriell moved the city rezone the following described property. Commencing at the southwest corner of Mobile Manor 1st Addition, thence northerly along the west boundary line of Mobile Manor 1st Addition a distance of 231.5 feet, more or less to the South boundary of the'Kynaston property", THENCE South 89o46' West~Ll~ along the South boundary o£ the Kvnas~on prop~er~v a distance of ee5 more or ±es~ ~o mne Nort~ proper~y ±±ne os Martha Bistline/ Henderson property, thence Easterly along said property line a distance of 368 feet more or less, thence North 85.4 feet to the Point of Beginning. Councilman Taylor seconded motion. Voting was unanimous in favor of motion. ACCEPTANCE OF PARADISE ACRES SUBDIVISION - Mayor Cotant read letter from David Klatt, Forsgren, Perkins and Associates dated January 12, 1976 requesting a conditional acceptance of streets and utilities on that portion of Paradise Acres Subdivision bound by the follow- ing streets, Moses, Abraham, Jacob, Isaac and Eden. Mr. Klatt lists 12 items that have been done or will be done prior to final acceptance. The City asked Jim Voeller and Associates to inspect the Paradise Acres construction and a letter from James D. Voeller dated December 23, 1975 lists 13 items which will need to be repaired or corrected before final approval is given. Mayor Cotant asked if the city should receive some kind of bond to guarantee completion. This was discussed and Engineer Forsgren said that Mortgage Insurance has a one year guarantee of streets from the contractor. Engineer Forsgren stated he felt it wise to require contractors and builders to leave the streets in as good of shape in a sub- division as the construction is in when they enter to do construction on the lots. Councilman Romriell asked Engineer Forsgren if he was aware of Mortgage Insurance's agreement to participate in the installation of a larger pump at Well #3. Mr. Forsgren said he would start work on the bids for the pump right away. Councilman Taylor moved the city give conditional acceptance of portion of Paradise Subidivsion bound by streets, Moses, Abraham, Jacob, Isaac and Eden, that the items listed in letter from Jim Voeller and Associates dated December 23, 1975 and from David Klatt, Forsgren, Perkins and Associates dated January 12, 1976 be completed prior to final acceptance and that Mortgage Insurance furnish a copy of the maintenance bond to the city. Councilman Kinghorn seconded motion and all councilmen voted in favor. ACCEPTANCE OF MOBILE MANOR 1st ADDITION - Max Parrish presented a letter requesting acceptance of improvements in Mobile Manor 1st Addition. Mr. Parrish also presented bonds in the amount of $1,000 to cover items needed to be done to bring Mobile Manor 1st Addition improvements into compliance. Mr. Parrish also presented limited power of attorney to city on bonds furnished. Attorney Burnett recommended the City of Chubbuck have the limited Power of Attorney form recorded. Councilman Romriell moved the city accept curb, gutter, road and water line construction in Mobile Manor 1st Addition. Councilman Taylor seconded motion with an unanimous vote in favor. It was noted by Engineer Forsgren the sewer was incomplete in Mobile Manor 1st Addition. 5 INTERIM APPROPRIATION ~161 read in full by Mayor Cotant. Motion to dispense with rule of reading ordinance on three separate days made by Councilman Taylor. Seconded by Councilman Kinghorn. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, yes Taylor, yes. Motion to approve Interim Appropriation Ordinance #161 made by Councilman Kinghorn. Motion seconded by Councilman Romriell. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, yes; Taylor, yes. VARIANCE APPEAL - Rodney Parrish submitted a letter of appeal on variance request denied by Planning and Zoning Commission January 8 on size requirements on Lot 11 and Lot 22, Block 2 Mobile Manor Addition. BOYD STREET - W. T. Harvey, 646 Boyd, asked if city was going to change the name of Boyd Street. Mayor Cotant informed him the city does not plan to change the name of Boyd Street. WEST STREET - Rodney Parrish informed council it would be necessary to change the name of West Street in Mobile Manor 2nd Addition. Henderson Mobile Park also has a West Street and it will be necessary for West Street in their park to be changed. LIONS CLUB PATRIOTISM BANQUET - Dean Wood, President of Lions Club extended an invitation to the mayor and council to attend the patriotism banquet to be held February 17, at the Green Triangle. GENERAL DUSCUSSIONS: 1. Garbage collection, a meeting was suggested by Councilman Kinghorn to discuss ways to improve garbage pick-up procedures. 2. Building Inspection compensation was disucssed and Mayor Cotant was requested to discuss this with building inspector to determine a monthly amount which might be agreeable. 3. Building permit fees being waived for churches and schools. 4. Zoning officer being present at P & Z meetings, it was also suggested legal assistance be present at P & Z meetings. 5. Bannock County fire agreement to be renewed. 6. Kunz Easement - Engineer Forsgren was requested to prepare another easement for a future water line to connect Whitaker Road water line with Hiway Avenue water line. 7. McOmber sewer service hook-up. Councilman Romriell suggested Attorney Burnett write Mr. McOmber of his failure to make his sewer service hook-up. Clerk to provide attorney with copy of letter previously sent and sewer payment record. 8. Water delinquent turn-offs. WATER TANK IMPROVEMENTS - Councilman Romriell requested a time schedule of this planned development. Engineer Forsgren stated he would write up a proposed time schedule for the project. REPORT ON ILLEGALLY PARKED TRAILERS - Lynn Cameron reported on his research of the Earl Ellis violations of trailer, junk cars and numerous items being stored on his property which lies on the West end of Briscoe Lane. DENNY JONES CASE - Attorney told mayor and council the Denny Jones case will need to be reset for trial. 7 FINANCIAL STATEMENT FOR DECEMBER, 1975 presented to the Mayor and Council. CLAIMS FOR JANUARY presented to Mayor and Council. It was requested the city personnel check out competitive prices on all purchases, especially in the Water Department. After a thorough review of claims Councilman Kinghorn moved to pay the claims presented. Councilman Taylor seconded motion. All councilmen voted in favor of motion. Cotant, Jr. City of Chubbuck Chubbuck, Idaho 83201 Dear Mayor' By way of this letter I am requesting a conditional acceptance of the completed part of Paradise Acres which includes the following sheets and utilities encompassed in the area bound by these sheets' Moses Abraham Jacob Isaac Eden Due to the season and inclement weather, all items on the inspection list compiled by Jim Voeller and AsS0c] cannot be corrected until spring. We therefore are asking acceptance of that part of the subdivision mentioned above with the understanding that we will be responsible for seeing that all items are corrected as weather permits. The following items are in response to Jim Voeller's i~spection report' 1. Curb & gutter has been backfilled around Yellowstone entrance. 2. Catch basins on Abraham have been cut out, grouting will be done in the spring. 3. Fire hydrants at intersection Abraham & Moses and Moses and Isasc are working, we will ~an valves as weather permits. 4. Fire hydrant at Jacob & Eden will be raised by Wayne Taylor upon receipt of materials. 5. Manholes have been cleaned and inspected by Mr. Jordan Stewart & to his satisfaction. Fire hydrant on Isaac has been deleted, it is not needed based on acceptable design standards used in the area. 8. Curb & gutter to be replaced by housing contractors as weather permits at these locations: A. adjacent to upper M.H. on Isaac. B. Section on west side of Eden near Siphon Road. 9. The park area has not been disturbed, the clean-up in that area will be done by the housing contractors for the lots bordering on the West and East sides. 10. Steel rods at street intersections will be set next spring as weather permits. 11. As-built plans have been completed. 12. Lift station is scheduled for completion Jan 23, 1976, when power for operations are made available. Idaho Power is waiting for permission to cross Yellowstone Highway. We feel that with the exception of the lift station the re- maining tasks will not impede the maintenance and operation of the subdivision. The lift station will be £inished before any homes are inhabited. With these conditions we are asking for acceptance for Paradise Acres Subdivision. Box 846 Pocatello, Idaho 83201 December 7.3, 1975 Mayor and City Council City of Ghubbuck 5160 Yellowstone Avenue Chubbuck, Idaho 832201 Re: Paradise Acres Subdivision Inspection Dear Sirs: Following is a summary of the inspection of Paradise Acres Subdivision made by Jim Voeller, p.E. , Bob Thompson, p. E. , Jordan Stewart, City Maintenance Supervisor, and a representa- tive of Forsgren, Perkins & Associatei on December 23, 1975, at your request. We found several items which should b~ repaired or corrected before final approval is given for that portion of Paradise Acres which is completed. We suggest that that portion of Phase I of Paradise Acres not yet completed (ie, Eve Streetwhich lacks curbs and pavement) not be accepted until complete. Following is a list of items which need correction:- 1. The curb and gutter sections should be backfilled around the entrance onto the Yellowstone Highway. 22. The catch basins on Abraham Street, which drain to the canal have not been cut through the 66 inch culvert as shown on sheet 222 of the plans. The opening should also be grouted after cutting. 3. The fire hydrant valves at the intersection of Abraham and Moses and Moses and Issac streets are full of dirt and need to be cleaned and checked for operation. 4. The fire hydrant at Jacob and Eden Streets needs to be raised about 18 inches so its bottom flange is 7. inches above the top of the curb. Mayor and City Council December 7.3, 1975 Page 2 5. The following manholes had a considerable amount of gravel and other debris in them and therefore, the entire sewer line should be flushed under the supervision of Jordan Stewart and reinspected before acceptance be granted. - Manhole - intersection of Moses and Issac Streets ,-- Manhole - intersection of Abraham and Jacob Streets - Manhole - intersection of Jacob and Eden Streets - Manhole - on Eden between Issac and Jacob Streets - Manholes - on Issac Street - Manhole - on Abraham Street - Manholes - on Eden Street near Syphon Road 6, The valve box on the fire hydrant at the intersection of Eden and Issac Streets needs to be centered on the valve. 7. The fire hydrant on Issac Street has not been installed. 8. Curb and gutter sections should be replaced at the following locations: A. Adjacent to the upper manhole on Issac Street (Broken) B. A section on the west side of Eden Street near Syphon Road (Broken) 9. The park area should be graded and cleaned up before being accepted. 0. Some curb sections along the northeast intersection of Jacob and Eden Streets show signs of settling and tilting. These should be inspected again this spring and if no further settling has occurred should be sealed. 11. The plat for the subdivision shows 5/8" x 30" steel rod to be placed at the intersections of the streets. These should be placed prior to acceptance with the tops flush with the surface. 1Z. The valve and fire hydrant locations don't conform to the plans and should be shown on As Built plans so that they can be readily located in case of an emergency. 13. The lift station for the project was not complete at the time of this inspection and will be inspected when complete. Mayor and City Council December 23, 1975 Page 3 In checking the plans for this subdivision and others recently submitted to your city against your current standard specifications we have found several inconsistencies being permitted. The most significant are those specifications dealing with fire hydrant spacing, water valve spacing, manhole spacing, and the distances allowed between street intersections. We would strongly suggest that these specifications be revised to reflect current changes in construction standards and then be closely adhered to. Some of these changes were recomm.ended to the City Council on December 16, 1975 by your City Engineer. We appreciate the opportunity to be of service to you and will be present at your next city council meeting to answer questions and discuss the inspection with you in detail.
