HomeMy WebLinkAbout10 10 1972 CMMinutes of the regular meeting of the Mayor and Council held in the city municipal building October 10, 1972. ~ieeting called to order at 8:05 P.M. by Mayor Cotant. Present: Mayor Cotant, Councilmen Kinghorn~ Menard, Romriell, Taylor and Attorney Wise. Deputy Clerk Y£ary Stephenson 77 Minutes of September 26 meeting approved as written. STUART THI?~D ADDITION - }ioward Gibson and ]~ichard O!sen of Cate City }~eal Estate proposed to proceed as it is basically approved except that a street will be constructed to .ext~end Lucky to.~n~r~Street. Discussion ensued. Oidewalks agreed upon as they mnIormed at zoning~ting October 5th. ~uestion about using underground utilities, and talk of making lots smaller. ~-'~lso concern over usin~ road through trailer cou~t, and Council against this. Screening may be necessary between t~ailers and homes. Resolved -- Third addition to Stuart Subdivision will be approved with the change in street running north through lots 6 and 7, with variance on underground utilities to be requested. I~omrieil moved for approval with Taylor seconding. Roll call vote: Kinghorn, yes; Taylor, yes; ~omriell, yes; Menard, no. RETAIL S~.~ Of~ WI~3 ON SUND~YS - Mrs. Kennedy of Kennedy's Food ]~arket petitioned the Council regarding Ordinance ~' 113. She requested change in Ordinance in o~'der to sell wine on Sundays. Mr. Kinghorn throught it might i~fringe on rights of bar owners if they ~.e not allowed to sell on Sundays when stores are. However, since no trouble evidenced so far might be best to sell it to eliminate inconvenience to store owners of trying to screen Dune]ay buying. Also Chubbuck is losing trade to nearby Pocateilo. OI{DINANCE ~ 115 - Providing for retail sale of win~ re~d by title only by Mayor Cotant. Councilman Romrieil made motion to change wordir~ of paragraph eliminating sale of wine on Sundays, thereby permitting sale of ~ine on Sundays. Menard seconded. ~oli call vote: Kinghorn, yes; Zenard, yes; ~omriell, yes; Taylor, no. ORD~N~NCE 114 - Making it unlawful to remain on premises after 1:15 A.M. where liquor by the drink is sold, read by title only by Mayor Cotant. Portion reread stating time involved 1:15 A.M. until 7:00 A.M. Council3r~an Menard moved Ordinance be adopted. Seconded by Kinghorn. Roll call vote; Kinghorn, yes; [~ienard, yes; Romriell, yes; Taylor, yes. OI~INANCE ~i 115 - Providing curfew for ~nors read in full by ~ayor Cotant for third reading. Motion to adopt Ordinance # 115 with deletion of last paragraph concerning emergency measure, made by CounciLman Taylor. Seconded by Kinghorn. Roll call vote: Kinghorn, yes; Menard, yes; ~omrieii, yes; Taylor, yes. POLICE DEPAt[Ti~NT: James Phelps presented by Chief Arnold Stone, with recommendation he be hi~ed as third officer. Ceuncil afT:roved and Phelps hired. Chief Stone explained that ~i drivers are now being picked up primarily by state police who are especially trained for detecting these drivers, thereby leaving the local police to concentrate on othe~ traffic violations, etc. Chief Stone also stated he sees the need of fourth police officer when asked about future projection of police manpower. Council approved accepting bid submitted by C. Ed Flandro for new Ford for ~olice car, with the exception of Councilman Kinghorn who expressed preference for Chevrolet. INTEPIM FINANCING ON SE~'iE}~ - Council approved of interim financing at IBT as required and requested by HUD, interest to be 2 ~ZONI~G P~0PE~TY - After some discussion abo~t other property involved as well as ~oss Kelly's p~operty on East Chubbuck ~oad, it ~'as decided to advertise to have a public hearing before next council meeting, in order to discuss rezoning property to R-2. BUYING OF P~OPERTY - Discussion on buying lot from Fred Chase te add to lot ~iven to city by Chase for park. Councilman Romriell made motion to accept the final plat of Triangle Investment Inc. Taylor seconded. Jack Menard abstained, from voting, all other councilmen voted in favor of motion.
