Minutes of the regular meeting of the Mayor and Council held in the city municipal
building September 12, 1972.
Meeting called to order by Mayor Cotant at 8:00 p.m.
Present: Mayor Cotant, Councilmen Kinghorn, Menard, Romriell and Taylor. Attorney Wise
and clerk Vera Armstrong.
Minutes of meetings August 8 and August 9 approved as written.
REQUEST FOR RIGHT-OF-WAYEASEMENT TO BE ACCEPTED AS CITY STREET - Yern Briscoe and Mr.
& Mrs. Paul Adolphson requests their right of way, from Yellowstone back to homes they
have developed on the west side of Yellowstone Avenue in the 5~00 block, bedeeded to
the city and accepted as a city street. Mayor Cotant informed them the city could
not accept it as a street because it is not the required 50 feet wide and is not
developed to city street standards. The council said they could see no reason why
the lane couldn't be named and they could check with the post office department for
mail delivery.
Mrs. Adolphson also asked if she could place a trailer on her property. She was
informed she would need to pay a $10.00 filing fee for a variance request and meet
with the Planning and Zoning Commission.
CP~EAM TOP DAIRY - Ben Williams plans to develop a commercial business on property he pro-
poses to purchase from Joe Brennan. This would be a dairy retail and~ distributing
are
plant. Council discussed zoning regulations in a. uouncm±manfmoved the council
approve a building permit for this business in the present C-iL Zone. Taylor seconded.
Roll call vote: Kinghorn, yes; Menard, yes; Taylor, yes; Romriell abstained.
Further discussion on zoning regulations followed.
Attorney Wise ad~rised council a variance or change of zoning should be requested.
Ben Williams stated he would prefer a variar~ce be requested amd granted.
Councilman Menard moved to rescind above motion to approve building permit in favor
of variance request. Romriell seconded with all councilmen in favor of motion.
Hearing set for September 29, at 7:00 p.m.
CHUBBUCK FIREMAN AUXILIARY - Mayor read letter from the auxiliary commending council
for having crosswalks painted on highway and suggested garbage cans be set in
different areas of city to help keep the city clean and stated they would like to
see more sidewalks in the city. Council discussed placing of garbage cans at various
areas.
POLICE DEPARTMENT - Mayor read letter from Don Frasure resigning as Chief of Police.
Council accepted the resignation. Mayor stated he would like to send letter to
Don commending him on his excellent service to the City of Chubbuck. Councilman
Kingh~rn asked that he and all councilmen sign the letter sent to Mr. Frasure.
Mayor stated he felt if the city has competent personnel they should be given the
opportunity of the promotion.~Mayor then recommended Arnold Stone be appointed
Chief of Police. Councilmen approved this appointment~v~th a motion from Councilman
Taylor and a second by councilman Menard.
Arnold Stone recommended the council hire Jim Phelps as a third officer. No action
taken.
Mayor asked council their feeling as to calling for bids for police cars. After
some discussion council agreed to put a new short block in plymouth and call for
bids for one new police car.
ORDINANCE#lO6 - Disannexing property of John E. Motheral read in full by Mayor Cotant.
Councilman Taylor made motion to adopt ordinance. Kinghorn seconded. Roll call vote:
Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. Third and final reading on
this ordinance.
ORDINANCE #112 - Farm Livestock Ordinance read by title only by Mayor Cotant for second
reading.
ORDINANCE PROVIDING CURFEW ON MINORS - considered by council. Menard suggested council
receive copy for study.
Mayor suggested closing Stuart iPark during night time.
ORDINANCE#il3 - PROVIDING FOR RETAIL SALE OF WINE read by Mayor Cotant by title only
as first reading.
ORDINANCE #114 - MAKING IT ILLEGAL for any person to remain upon premises licensed to
sell liquor by the drink after 1:15 a.m. read by Mayor Cotant as first reading.
COMPLAINT - Councilman Menard stated he had complaints of junk cars at 771 W. Chubbuck
R~and asked police to check this.
INVITATION - Mayor read invitation to council to ride in Hire The Handicapped Parade
September 30, at 1:00 p.m.
RESOLUTION 9-72 - INDICATING CITY OF CHUBBUCK"S INTENT TO JOIN REGIONAL COUNCIL OF
GOVERNMENTS. Mayor read resolution in full. Councilman Menard mad~otion to
adopt resolution. Kinghorn seconded. Roll call vote: Kinghorn, yes; Menard, yes;
Romriell, yes; Taylor, yes;
ZONING MEMBER - Mayor appointed Milton Klein to serve on this commission and all
councilmen approved.
ANNOUNCEMENTS - Mayor made announcement of no-host breakfast with State Highway
Department Thursday at Holiday Inn at 7:30 a.m. and stated he felt the city should
pay for the breakfast with all councilmen agreeing.
Mayor informed council the Oregon Construction Company had failed to list their
sub-contractors and Hartwell Construction was contesting their bid.
Mayor announced the city has hired Lloyd Brower as a steady city employee to operate
the garbage truck.
COUNTRY ACRES CITY LOT - Mayor stated perhaps the city should reconsider buying the lot
next to the one Chase has agreed to deed to the city for a well.
RESOLUTION # 10-72 - City tax certification to co~mty auditor. Mayor stated by law the
city is required to certify tax needs by second Monday in September. Mayor and Council
approved Resolution # 10-72 which is attached to these minutes.
FINANCIAL STATEMENT for month of August presented to Mayor and Council.
CLAIF~ for month of September presented to Mayor and Council. Councilman Taylor made
motion to pay bills. Romriell seconded with all councilman and mayor in favor.
Meeting recessed until further notice if necessary.
