HomeMy WebLinkAbout07 25 1972 CMMinutes of the regular meeting of the Mayor and Council held in the city municipal building July 25, 1972. Present: Mayor Cotant, Councilmen Kinghorn, Menard, Romriell and Taylor. Attorney Wise and Clerk Vera Armstrong. Minutes of the July llth and July 21st meetings read and approved as read with the change to asbestos concrete pipe instead of asphalt pipe in the minutes of the meet- ing of the 21st. 57 GARBAGE PICK-UP - Mayor Cotant reported the truck the city had used the past week from Williamsens out of Salt Lake might be available to buy. He will know for sure Wednesday. If this truck isn't available a new one just like~ will be available next week. The container pick-up will not be available until August 2n~. Williams~ens have sixteen containers and they have been ordered. RE-ZONING OF BRISCOERD. - A public hearing was held July 20th by the P & Z Co=m~ission on this proposed rezoning. P & Z recommended the council make this change. Council- man Romriell made motion the attorney draw up an o~'dinance making this zoning effective. Kinghorn seconded and the motion carried unanimously. ORDINANCE #110 Amending Dog Leash Ordinance #109 read in full by Mayor Cotant. A discussion was had as to the definition and meaning of veterinary clinic and commercial kennel with the understanding tb~t a veterinary clinic will not allow the boarding of animals which is a kennel. This reading accepted as second reading of ordinance. PLANNING AhD ZONING MEMRF~ needed. Wilbur Beall has moved out of the city and the ordinance provides for only one me~ber outside city limits. Mayor suggested Charlie Frasure and Councilman Menard suggested Milton Klein. Council would like to meet ~ith these gentlemen before making appointment. FARM LIVESTODK ORDINANCE - p & Z Commission have recomnended this ordinance for council study. Mayor Cotant read ordinance in full. Council felt some control should be on chickens, geese, rabbits and sm~ll animals and agreed 25 aoimals be considered the same as one animal unit. Council agreed area roofed for animal shelter should not be required and sheds should be at least fifty (50) feet from an inhabilted building. Attorney Wise was instructed to prepare an ordinance and have ready for P & Z review August 3rd. DOG SURVEY - City has received a request from R. D. Vesser~that water bills be stamped with the question "S~ould the dog leash ordinance be repealed?" Council decided a survey has already been taken and another survey seems unnecessary. ANIMAL CONTROL OFFICER - Mayor announced Darrell Burrows is resigning as of August 1st. JAMES STREET PAVING - Fred Chase has requested the city help pave the street from Stuart Street to the new development he is constructing on James Ave. Councilman Romriell reported Mr. Chase had the understanding the city would help with this paving. Counc~lm~n Menard suggested the city pay one fourth of the cost. Mayor and council were in full agreement with this and if Fred Chase is able to get the two property owners to share in the cost this is his responsibility. EVAN'S IANE WATER - Kinghorn asked .how council felt about meters being installed on Evan's Lane. Councilman Menard suggested remote readers installed in the home. A check will be made on this possibility. TRAILERS ON PRIVATE PROPERTY-Attorney Wise informed council action on these cases are being held up in court. After some discussion Councilman Romriell made motion the city file a civil suit and get an injunction on the three owners of trailers in violation of the city trailer ordinance and require them to be moved. Councilman Kinghorn seconded and the motion carried unanimously. TRIANGLE INVESTMENT INC. - Jack J. Menard, as the developer, presented a preliminary plat to the council and asked for approval. After reviewing the plat Councilman Romriell moved the council approve this preliminary plat. Taylor seconded with all in favor. 59 REQUESTS TO MOVE HOME INTO CHUBBUCK - R. D. Price, 920 Yellowstone requests permission to move home into Chubbuck on East Chubbuck Rd. He has bought property from Betty Jo Fenwick. He was informed by council members a 6" water line and an 8" sewer line would be required. Mayor told Mr. Price the city sub-division ordinance requires this property be sub-divided before a building permit be issued. Mayor also suggested Mr. Price have his attorney Mr. Grec. n obtain a copy of the sub-division ordinance so he will know the city requirements. Councilm~n Romriell suggested Mr. Green contact attorney Wise to get the details worked out. ANNOUNCEMENT - Mayor informed council he had appointed Rodney Parrish as a representative from Chubbuck City on the Southeastern Idaho Community Action Agency.
