Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG was lead by Merlin Miller. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular Meeting Minutes of October 26`h, 2004. Councilman Kearns moved to approve the Regular Meeting Minutes of October 26`h, 2004 as read, subject to correction of typos, Councilman England seconded. All council members voted in favor of motion. BEER AND WINE LICENSE FOR GROCERY OUTLET - Krista S. Winn, Grocery Outlet, 150 Bullock Ave has applied for a beer and wine license to sell beer and wine at the Grocery Outlet, 105 Bullock Ave. Police Department recommended approval of the beer and wine license. Councilman Gunter moved to grant a beer and wine license to Krista S. Winn, Grocery Outlet at 150 Bullock Road, Councilman England seconded. All council members voted in favor of motion. DAY CARE FACILITY LICENSE - Shaundell Morton, S &S Day Care, 4714 Heidi Court has applied for a day care facility license to operate a day care facility at 4717 Heidi Court. All departments recommended approv -1 of the Day Care Facility License. Councilman Kearns moved to grant Shaundell Morton, S &S Day Care a day care facility license to operate a day care facility at her residence at 4717 Heidi Court, Councilman England seconded. All council members voted in favor of motion. 197 COUNCIL MEETING MINUTES - (cont.) November 91', 2004 CALL TO DUTY FUND" PROCLAMATION - Mayor Cotant read the "Call to Duty Fund Proclamation" in full. Councilman Quick moved to authorize Mayor Cotant to proclaim October and November, 2004, "Call to Duty Fund' Months in the City of Chubbuck, Councilman Kearns seconded. All council members voted in favor of motion. RESOLUTION #4 -2004 - Update of the Comprehensive Plan. Mayor Cotant read Resolution #4 -2004 in full. Councilman Quick moved to adopt Resolution #4 -2004 as read, Councilman Kearns seconded. All council members voted in favor of motion. GARBAGE COLLECTION BID RECAP - PWD Smart presented the following bid recap: Councilman Gunter moved to accept the low bid of $41,003.16 per month received from Snake River Dispose -All and authorized Mayor Cotant to enter into agreement with Snake River Dispose -All for City of Chubbuck Sanitation Pick Up, Councilman Quick seconded. All council members voted in favor of motion. PROPOSED CHUBBUCK FIRE DEPARTMENT PERMIT FEE SCHEDULE - Fire Marshal Merlin Miller presented a proposed Fire Department Permit Fee Schedule. PROPOSED CHUBBUCK FIRE DEPARTMENT PERMIT FEE SCHEDULE - Fire Marshal Merlin Miller presented a proposed Fire Department Permit Fee Schedule. 199 COUNCIL MEETING MINUTES - (cont.) November 9`h, 2004 PROPOSED CHUBBUCK FIRE DEPARTMENT PERMIT FEE SCHEDULE - (cont.) FM Merlin Miller stated the Fire Department has not charged on these inspections, testing, reimbursements in the past. Councilman Kearns stated he supports the inspection and testing fees, but not fully in support of the citizens charges. CC Conlin said the proposed fee increases are more than 5 %, the City is required to publish the proposed fee schedule and conduct a public hearing prior to the increase of fees. Attorney Holmes said he will check on legality of charging more to the non - district citizens than district citizens. Council tabled the proposed Fire Department Fee increases until the concerns can be reviewed and discussed. ORDINANCE #593 - Annexing certain lands to be included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho; specifying the zoning classification which shall be applied to said lands newly annexed to the City of Chubbuck. Attorney Holmes read Ordinance #593 in full for the first and final reading. Councilman Kearns moved to dispense with the rule requiring an ordinance to be read on three separate days, Councilman Gunter seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. Councilman Quick moved to adopt Ordinance #593 as read, Councilman England seconded. MOBILE HOME SNOW LOAD DISCUSSION - Attorney Holmes stated prior to March 26`h, 2002 the Chubbuck Building Department requires a 36 psf roof on all roofs. That was changed for manufactured homes only to 30 psf on March 26`h, 2002 by the Council. The Uniform Building Code leaves it to the local Building Official to determine what is an appropriate snow load for buildings in the area. Prior to March 26`h, 2002, the Building Department used and had used for probably 25 years a University of Idaho study as its basis for the snow load rating. This rating applied to both stick built as well as manufactured homes. 201 COUNCIL MEETING MINUTES - (cont.) November 91', 2004 MOBILE HOME SNOW LOAD DISCUSSION - (cont.) At the March 26"', 2002 Council Meeting, the following concern was presented in a prior Memo: "This will make it easier to move older double wides into the City. Under State Law as mandated by the legislature and adopted by the City, any double wide meeting the 1976 HUD standard can be placed on any residential lot in the City. Mobile home roofs are rated in 10 psf increments and most of the older homes are built to a 30 psf standard. Fewer older homes will meet a 36 psf standard. The State now has a procedure to bring a pre -76 home into line with the 1976 HUD Standard. If the City now goes to a 30psf rating, it will then be more likely that older homes may be brought up to the HUD standard and be allowed to be placed on any residential lot in the City. This will be a major shift in policy to now make it easier to bring these older homes into the City rather than limit them. The only hold the City then will have is the provision at 18.04.050 (P) (12) which requires the "design and appearance which is congruent with the predominant design and appearance of other site buildings in the existing neighborhood ". That subjective standard is easier to attack successfully than the objective standard of snow loads. The Idaho Manufactured Home rules require a minimum of 30 psf roofs but indicate a higher load may be required in certain areas. Attorney Holmes stated the Building Department requests the Council reauthorize the 36 psf load for all buildings, including manufactured homes. This will avoid having a different standard for stick built homes and manufactured homes and will make it less likely older homes will be moved in which meet the post 1976 HUD Code or have been rehabilitated under State Law to meet it. Existing manufactured homes in the City are Grandfathered. Councilman England moved to rescind the March 26"', 2002 Council decision allowing the Chubbuck Building Department to use the 30 psf snow load requirement and directs the Chubbuck Building Department to require a 36 psf snow roof for manufactured homes, Councilman Quick seconded. All council members voted in favor of motion. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve the computer print -out claims as presented, Councilman Gunter seconded. All council members voted in favor of motion. 203 COUNCIL MEETING MINUTES - (cont.) November 9th, 2004 GENERAL DISCUSSION - 1) Councilman Kearns asked where the City Staff is at on getting the sign on City right - of -way at E. Chubbuck and Hiline Roads removed. Chief of Police Randy Severe stated he had contacted the owner of the sign and they are going to remove it. 2) Attorney Holmes stated he wrote a letter to Wendy McCurdy advising her of the Council discussion last Council Meeting. Larry Kohntopp is going to check with Pocatello Transit System to see where the Bus Stops are. Council was in agreement. 3) Mayor Cotant suggested that if the November 23`d, 2004 Council Meeting is light, the Council Meeting will be cancelled because of the Thanksgiving Holiday.
