COUNCIL, MEETING MINUTES
October 12"', 2004
Minutes of a regular meeting held at the Chubbuck City Council Chambers, October 12"', 2004.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M.
Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:32 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Bob McAteer.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular
Meeting Minutes of September 28"', 2004.
Councilman Kearns moved to approve the Regular Meeting Minutes of September 28`h
2004 as read, Councilman Quick seconded. All council members voted in favor of
motion.
ORDINANCE - Adding Section 17.16. 100 to the Chubbuck Municipal Code to require the water
rights to any canal water serving ground to be developed to be assigned to the City unless
the owner will otherwise be using those rights; to require the owner to show plans for
such use.
Mayor Cotant read ordinance in full for the third reading.
PWD Smart stated the City is not prepared to enforce the proposed ordinance.
Discussion about using irrigation water for public parks.
Councilman England moved to table the proposed ordinance until PWD Smart can get
more information.,Councilman Quick seconded. All council members voted in favor of
motion.
ORDINANCE #591 - Amending Section 16.16.030 of the Chubbuck Municipal Code to provide
an administrative charge of one hundred dollars for the first time the City must re- mediate
dust or spillage of dirt, mud building materials and waste articles onto City streets from
adjacent properties, a two hundred fifty dollar charge for the second time within a twelve
month period and a five hundred dollar charge for the third and any subsequent times
within a twelve month period.
Attorney Holmes read the proposed ordinance by title only for the third and final reading,
one of which was in full.

Councilman Kearns expressed concern about enforcement of the proposed ordinance.
Councilman Kearns asked are we prepared to enforce the ordinance.
CC Conlin stated he sent a copy of the proposed ordinance to the Home Builders
Association Secretary and told her the final reading of the ordinance could be at tonight's
Council Meeting. The Home Builder's Assn. Secretary said she would include the
proposed ordinance in the Home Builders bulletin.
Councilman Kearns suggested dump trucks be required to be covered when carrying dirt,
etc.
Jeff Butikofer, 962 Homerun expressed concern about enforcement, but would like the
proposed ordinance adopted.
Councilman Quick moved to adopt Ordinance #591 as read, Councilman Gunter
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.
APPROVAL OF APPOINTMENT TO LAND USE & DEVELOPMENT COMMISSION -
Mayor Cotant recommended the following appointments to the Land Use & Development
Commission
Shawn Elsinore Term to expire June l'`, 2006
Rodney Burch Term to expire June 1", 2006
Councilman England moved to direct Mayor Cotant to appoint Shawn Elzner and
Rodney Burch to the Land Use & Development Commission, with terms expiring June
V, 2006, Councilman Quick seconded. All council members voted in favor of motion.
BID - CHUBBUCK FIRE DEPARTMENT RESCUE TRUCK BID RESULTS - Fire Chief Eric
King presented the following bids received:

FC Eric King recommended the Council accept the low bid from General Fire Apparatus.

Councilman England moved to accept the low bid from General Fire Apparatus for a Fire
Department Rescue Truck in the amount of $69,923.00, Councilman Kearns seconded.
All council members voted in favor of motion.
CHUBBUCK POLICE DEPARTMENT ANNUAL REPORT TO MAYOR AND COUNCIL
FROM 10 -01 -03 TO 09 -30 -04 - Police Chief discussed the following with Mayor Cotant and
Council. PC Severe stated he will present a quarterly report rather than the annual report.
Financial Status of Department
Major Acquisitions
Forfeitures
Law Enforcement Activities
Staff Issues
Councilman Kearns suggested the Police Department present some sort of annual or
semi - annual report on how the City of Chubbuck's crime statistics compares nationx,11y.
CLAIMS - Computer print -out claim presented to Mayor Cotant and Council.
Councilman Quick moved to approve the computer print -out claims as read, Councilman
Gunter seconded. All council members voted in favor of motion.
At 8:16 p.m, Councilman England moved, Councilman Kearns seconded, with full council
approval to adjourn meeting.
