Cotant, Council Members Leroy S. Quick, Steven M. England, Marvin C. Gunter and Deputy Clerk Myrna Crapo. Public Works Director Steven M. Smart. Meeting was called to order at 5:35 by Mayor Cotant. PURPOSE OF SPECIAL MEETING is to discuss park development and water line extension on Ponderosa Street. The council discussed making modification to the fencing ordinance and allow 4' fences. Gerald McNabb presented a map of Park Meadows development showing the shape of the area. And discussed the layout of the parks. Their restrictive covenants require no fences higher than 4'. 1 Steve Smart told the council that they are dedicating more common area than is required. He recommends that we don't change the ordinance at this point but do some trading. Steve asked the developer for the amount of land for open area and common areas. Mayor Cotant: They figured about $5,000 for the pipeline. We could furnish the pipe and fittings and have them install it. Mayor Cotant is concerned about black toping the road. They need to gravel the area until the hot mix comes on line so it can be done all at once. Marvin Gunter moved that in as much as this subdivision has provided double the park area that is required we will participate with offsetting the cost of the water connection by providing the pipe and fittings. It will be the contractor's responsibility to put it in and blacktop. Roy quick 2 ". ,Steve England, yes; Marvin Gunter; yes; LeRoy Quick, yes. Steven England moved that given this development is planned unit development we will make an adjustment to the requirement of a 6 foot fence and make it in compliance with their restrictive covenants for the P.U.D. Marvin Gunter 2 ". Steve England, yes; Marvin Gunter, yes; LeRoy Quick, yes. The green way would be deeded to the City of Chubbuck. Smart Subject: Country Acres Subdivision Darris Ellis Request to Provide Waterline in Sawtooth Street Date: March 11, 2004 Gentlemen, I suspect that Darris' request tonight will be for us to construct or pay to construct the waterline in the existing part of Sawtooth Street from the waterline in Ponderosa out to the edge of Country Acres so that his development, Park Meadows can pick it up and loop it through their subdivision. Our policy requires developers to pick up waterlines from an existing subdivision to loop through their own development. This policy practice is longstanding, and the following list gives you a feel for how often it has been done: • Vista Park Subdivision had to go in to Leonidas to pick up water. • Heritage West Subdivision had to go to Boyd and Castle Streets in Alturas Park for water. • Caarden Park Subdivision had to go down Rose Street to Stuart to serve their water., • Briarwood Subdivision had to go up Whitaker Road and Eagle to pick up water. • Hiline Heights Subdivision had to bring a line from East Chubbuck Road alongside Well 1 and into Mountain Park Road for water. • Rachael's Rainbow was required to go out to Mountain Park Road through a lot in Hiline Heights purchased by the city. The cost of the lot was also recouped by the city from Rachael's Rainbow Development. • Garden Oaks Subdivision, off Siphon Road, had to excavate a waterline from the east in front of Bullock's house, west across Bullock and Hatch, and into the subdivision. • Johannsen Place Subdivision had to construct water and sewer and street from Chubbuck Road back 190 feet into his property in order to develop. • Ranae Subdivision had to construct water and sewer along Clover Dell from Chubbuck Road north about 250 feet in order to get water and develop his property. This was later extended by Frasure in order serve Frasure Industrial Park. • Kasiska Subdivision had to construct a waterline down Alpine Street and across Chase Park in order to serve their development. These are most of the instances we can think of that apply to Ellis' request. My recommendation is that we continue to be consistent with our policy and require Ellis to construct the waterline from Ponderosa Street into his development.
