Present: Mayor Cotant, Councilmen Kinghorn, Menard, Romriell and Taylor. Attorney Burnett and Clerk Vera Armstrong, Meeting called to order by Mayor Cotant at 8:00 p.mo Minutes of meetings of November 13, 15 and 27 approved as written with the addition of statement from Jerry Morrison, Idaho Meal Finishing, that all employees were~r~not held up from work because of water being off October 17 and 18. RAIL SERVICE IN IDAHO ~ Don Brennan and Mrs. Connie Hansen, co-chairing the Idaho Rail Passenger Users' Association were present to discuss furthering the possibility of establishing a rail Amtrak service in Idaho. Mr. Brennan requests the city ad,pt a resolution in favor of this service in Idaho. They are in hopes of getting an exper- imental three day Amtrak service by April. Attorney Burnett read !Resolution#17-73, supporting the rail service cause in full. Councilman Romriell made motion to adopt Resolution #17-73. Kinghorn seconded with an unanimous vote in favor of motion. ACCEPTANCE OF PORTION OF HENRY STREET - Amos Chase, Blue Ribbon Homes, has requested that that portion of Henry Street bounded by Lots 16, 17, 18 of Block 7 and Lots 18, 19, 20, 21, and 23 of Block 3 be accepted for maintenance. Council agreed Mr. Chase would be ~. ~ i~2required to repair drain across Henry at the intersection with James and ato align two curbs on Henry. Councilman Kinghorn made motion city accept the above described portion of Henry for maintenance.. Taylor seconded with an unanimous vote in favor of motion. ATTORNEY HARGRAVES BILL - Attorney Hargraves has submitted a bill to the city for $7,64~.00. 1He has been paid $6,000.00. The total is 3/~ of 1% of bid price. Mayor said he felt this should be discussed with Attorney Burnett and Attorney Hargraves and he will do this. RELEASE OF ESCROW - BLUE RIBBON HOMES have requested the city release the $1,000.00 escrow be~g held for maintenance of a temporary sewer in the Country Acres Addition. Councilman Taylor suggested Mr. Chase should pay the proper connection fee before releasing this bond. Mayor said the council would need to talk with Fred Chase on this. TRANSFER OF FUNDS - Additional funds are required in the Law Enforecemmnt budget to finish pay the expenditures for the year. Councilman Romriell moved to tramsfer $3,000.00 from #~90 General Contingent to #~22 - Law Enforcement fund. Kinghorn seconded with all counc~D_men in favor of motion. LETTER ON CLAIM - B~tva Adolphson presented a letter to Mayor Cotant she has received from Mr. Williams, insurance agent for Oregon Construction. Mayor Cotant informed council he had talked to Mr. Williams and informed him the city was in no way re- sponsible for water leaks at Mrs. Adolphsons. FIRE DEPARTmeNT - Mayor informed council he and Fire Chief Denny Jones had met with county commissioners and they reacted favorable to reimbursing or making payment to city for fire coverage in northern part of county. Commissioners have agreed to discuss this at their meeting and report back to Mayor Cotant. EXTRA HOURS - POLICE DEPARTMENT - Mayor informed council the policemen had worke~d extra hours while patrolman Kelly ~[[Was going to school. The state would have reimbursed the city 75% of these costs if the officer had graduated from the Law Enforcement school. However, Officer Kelly was terminated from the school and therefore city is not eligible for any grant or reimbursement on any costs. Councilman Taylor made motion policemen be paid for extra hours worked while patrolman Kelly was at school. Kinghorn seconded with an unanimous vote in favor of motion. REQUEST FOR CITY WATER - Telmar Siebert, 23~ West Quinn Rd. told the mayor and council the residents in the area would like to work with the city of Chubbuck to secure water service for their area. Mayor informed Mr. Siebert he felt council should take this under advisement and get a cost estimate. Councilman Kinghorn told Mr. Siebert the council would like to meet with ~ residents to make sure they are in agreement with charges and etc. 193 SEWER SERVICE -~ H. Hal Clarke told council he was interested in getting sewer to the property on the south side of West Burnside so they could start a Mobile Home Sales business. Mayor and council showed Mr. Clarke where the sewer line was proposed to go. Mayor Cotant told Mr. Clarke he would check with the engineer and find out when this line wd_ll be complete. FORT HALL IRRIGATION - BRAINAGE - Mayor informed council Councilman Romriell had suggested writing to Fort H~ll Irrigation company requesting information on drainage rights of way in ChubbUck. REQUEST OF STREE. T ACCEPTANCE - Max Parrish asked if streets in Mobile Manor had been accepted. Councilman Romriell told Mr. Parrish Jordon Stuart had been requested to make the inpsection but they had not heard from him as he had been on vacation. Mr. Parrish asked when the sewer would be available at Chubbuck Road and Yell~owstone intersection and also on Parrish Drive. He was told that the last report received was dhubbuck Rd could hook up December 15 but it was not known when Parrish would be ready. '~$~ii~.~ CLAIM FROM IDAHO METAL FINISHING - Attorney Burnett informed council they could take ~ ,1\'~--IJ~%~'60 days to take action on or honor claim, if not acted on in this time the claimant may take the claim to court. Attorney Burnett suggested the city discuss this with Oregon Construction. Mayor said he would set up meeting with Oregon Construction.. IDAHO CODE SECTION 50-606 - Police Powers of' Mayor. Attorney Burnett informed council he felt city could accomplish a serious benefit from adopting such an ordinance. Council Menard moved Attorney Burnett prepare ordinance to this effect. Taylor seconded with an unanimaus vote in favor of motion. ORDINANCES #128 and #129 - Attorney Burnett read a letter from Housing And Urban Development stating they had reviewed Ordinances #128 and #129 relating to sewer and sewer rates and have no corrections or alterations to make. ORDINANCE #128 - Mayor read Ordinance #128 in full. Motion to dispense with rule of reading on three separate days made by Councilman Taylor and seconded by Council- man Kinghorn. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; TaYlon~ yes. Motion to adopt Ordinance #128 made by Counc~dm~mn Romriell and seconded by Councilman Kinghorn. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. ORDINANCE #129 read in f~l~ by Attorney Burnett as second reading. SEWER PUMP STATIONS - Mayor told council he was unsatisfied with the looks of the pump stations and was going to talk to Larry Perkins about same. PUBLIC HEARING ITEM - Jerry Tydemans variance request was acted upon by P & Z by rescinding recommendation for conditional use permit for a d wheel drive specialty business and recommended his origLual variance for same be denied. Councilman Menard ~gved t~e cg~umcil demy ~r~' T~deman' s variance request. Taylor seconded with an unanimous vote in favor of motion. ZONING OFFICER - Councilman Menard told council P & Z suggested appointing the bud_lding inspector as zoning officer. Councilman Menard moved the building inspector be the zoning officer also. Romriell seconded with all councilmen in favor of motion. DISCUSSIONS: Councilman Menard suggested the council put a limit on the amount the building inspector can make in a month. Mayor also mentioned the fact that Chief Denny Jones would be making fire inspections and would need to be reimbursed for this service. Mayor and council agreed to turn Christmas lights on December 20th and leave on for the rest of the holidays. CLAIMS FOR DECEMBER - Councilman Menard moved the council approve the claims.
