Present: Mayor Cotant, Councilmen Kinghorn, Menard, Romriell, Taylor, Attorney Burnett and Clerk Vera Armstrong CLAIM FROM IDAHO METAL FINISHING vs OP~EGON CONSTRUCTION AND CITY OF CHUBBUCK - Max F. Parrish, attorney for Idaho Metal Finishing informed council before a claim can go to court the claim must be considered and presented to the city. On October 17, 1973 the water line on Hiway Avenue was broken which put Idaho Metal Finishing out of business approximately 7 hours. On October 18, the water line was again broken and water was off for a number of hours. Mr. Parrish told mayor and council Idaho Metal Finishing could not carry on their regular business of chrome plaiing without the use of water, therefore he has presented the claim for the loss of business. Attorney Burnett stated Parrish had followed proper procedures in presenting the claim and advised council to take matter under advisement and that the claim should not be honored tonight. Mayor informed Mr. Parrish and Mr. Morrison they would discuss the claim with Oregon Construction and notify Mr. Parrish of action taken on claim. ~,~,~,'-PleaSe note addition to minutes on above subject on page 189. IDAHO CODE 50-606 - This section in Idaho Code provides that the Mayor has such : jurisdiction as may be vested in him by ordinance within one mile of corporate limits of city. ATTorney Burnett suggested the council allow him to check if a court determination had been made on this statute in other states. Mayor Cotant asked Burnett to do some research on same. ACCEPTANCE OF PORTION OF H~NRY STREET for maintenance - Amos Chase, president of Blue Ribbon Homes has requested the city accept a portion of Henry Street for maintenance. Mayor requested Jordon Stuart and the engineer inspect the street construction before the acceptance letter be signed. GASOLINE - Mayor and council discussed the gasoline shortage and ways the city might conserve gasoline. Mayor asked Councilman Taylor to talk to Chief Stone about ways 'the police department might use less gasoline. AGREEMENT WITH ATTORNEY read by Mayor Cotant. Councilman Menard moved the mayor sign the agreement with attorney. Taylor seconded motion with an unanimous vote in favor of motion. Councilman Menard suggested the city write the county and ask if Don Hammond had received permission to place a trailer on his property on Hiline Road in county. CENSUS - Councilman Romriell suggested the city take steps to have a city census taker and updated. The mayor and council discussed the growth of city and the difference it would make with city revenue. Councilman Romriell made motion the attorney draw up a resolution calling for a census. Menard seconded motion with an unanimous vote in favor of motion. JUNK CARS - Councilman Romriell asked what was being done about junk cars at Denny's Oil. Councilman Menard suggested a letter be sent to Denny requesting he clean up these cars as soon as possible. ~0~ COMPLAINT - Councilman Romriell asked clerk to call animal control officer and have him check out dogs at Siler residence on Stuart Avenue. POLICE PROTECTION - Councilman Romriell requested police department drive through and check Mobile Manor periodically. STREET NUMBERING- Councilman Kinghorn suggested streets be renumbered on Whitaker Raod. Mayor suggested other areas of city also be renumbered. Clerk to check with postmaster to determine steps required to renumber these streets. BUDGET - Councilman Romriell asked what had been done on budget and informed Mayor and council it was the duty of the council to prepare the budget. Council requested Mayor send out letter to department heads requesting proposed budget for 197~. AUDIT REPORT - Ray Carter, from Ken V. Carter Co. gave the 1972 audit report, coUncilmaan Kiughorn moved the council accept the audit report. Romriell seconded with an unan- imous vote in favor of motion. LICENSES - Councilman Romriell questioned if city license fees should be updated. PARKING AT KENNEDYS FOODTOWN - Mayor reported problem of parking at Kennedy's. Problem discussed with no action taken. COUNCILMAN Menard reported on a meeting he had attended sponsored by Farmers Home Administration. ORDINANCE # 128 - Sewer Ordinance regulating sewage, etc., read by title only by Attorney Burnett as the first reading. ORDINANCE # 129 - Establishing rates for water, sewage disposal and garbage disposal read by title only by Attorney Barnett as the first reading. DEDICATED STREETS - Mayor and council discussed city dedicated streets and right of way streets, what the difference is and how city can find out which streets are which. Jerry Morrison stated his full force of employees were not out of work because of the water being off on October 17 and 18th.
