HomeMy WebLinkAbout09 11 1973 CMMinutes of the regular meeting of the Mayor and Council held in the city municipal building September ll, 1973. Present: Mayor Cotant, Councilmen Kinghorn, Menard, Romriell and Attorney Hargraves and clerk Vera Armstrong. Meeting called to order at 8:06 p.m. bY Mayor Cotant. 161 DETACHMENT REQUEST - Mr. Lynn Weller Sr. and Mr. Dwight Zundel were present to again request being detached from city boundaries. Mayor Cotant informed them two reasons for annexing is control of development and subdivisions and to improve the symmetry of city. After a lengthy discussion Councilman Romriell suggested informing LYrm Weller Jr. of the difference in taxes plus the benefits derived from being in the city. A letter is to be sent to LYnn Weller Sr. to forward to his son. JUNK CAR SITUATION - Edna Bayliss, 150 W. Linden complained of the used car junk yard at Denny's Oil. Chief Stone reported he had talked to Denny andMr. Jones has agreed to get rid of them within 30 days if possible. Mrs. Bayliss also requested better control o£ dogs in area. IRRIGATION WATER COMPLAINT - Mr. and Mrs Brown, 508 Albatross, complained of irrigation water flooding their trailer lot in Mobile Manor. Mrs. Brown states the irrigation pipe is too small to carry the amount of water needed and it floods over on them. She asked mayor and council what could be done. Mayor informed them he had written Parrishes requesting they correct this problem and any further action w~l] have to be done through their own legal channels. AZTLAN DEVELOPMENT - Sharlene Belanger, acting director, stated they were putting together their cost estimates and would like to know what the charge for sewer hook- ups outside city limits will be. The mayor and council informed her the hook-up fee for outside city limits would be $200.00 the same as city hook-up fee. As homeowner's w~]] be billed in one billing, Ms Belanger asked if the rate could be lowered on the monthly sewer charge to approximately the same as trailer parks in the city with one bd]ling. Councilman Menard suggested the rate be one and one-half times the city residents rate less 10% where one b~]]ing would be sent to the homeowner's association. Ms Belanger asked if Chubbuck would be interested in bidding on garbage collection for their development. Mayor informed her this wabld require some study. HEIGHTS SUBDIVISION - Rodney Clark requested the city adopt their final plat. Drainage problem discussed. Engineer had suggested requiring no curb and gutter but the councilmen were firm in requiring curb and gutter. Mayor stated the city would like some park area. Mr. Clark informed council he hesitated agreeing to giving ground for park area because his lots were so large that plenty of room for play should be available. Mayor Cotant told Mr. Clark he could not sign the plat as is. For one thing, cul- de-sacs should be provided on each end of Canal Street. Mayor also said engineer would need to determine if and where dry wells are required. Lot 9 Block 5 needs more frontage. The mayor again requested they entertain providing a playground area Df approximately 300 square feet. A letter will be sent to Mr. Clark deter]lng each change the council requires on the final plat. Further discussion followed with a proposal that a park area be provided on Lots l~and 2, Block 8 in the northwest corner of the subdivision. PUBLIC HEARING ITEMS:~ 1. Heights Sbudivision request for a Residential 2 Livestock zone discussed by mayor and council. Councilman Menard proposed the sm~]] er~lots be zoned Res-2 instead of Res-2 Livestock. Menard also suggested sending a letter to Roy Middleton and Murray Layne asking if they would like to request a Res-2 Livestock zone on their property, which abuts the Heights Subdivision. Zoning of Heights Subdivision tabled for further study. 2. Mountlake Subdivision tabled because of lack of quoromwith Councilman Menard abstaining from vote. 163 PUBLIC HEARING ITEMS CONT T D 3. Turner Subdivision - P & Z recommend the Turner subdivision be rezoned from Res-2 Livestock and Agricult~val Transitional to a Residential 2-Zone. Councilman Menard moved council approve rezoning Turner subdivision to Residential 2 zone. Romriell seconded with an unanimous vote in favor of motion. ~. Newly annexed area - Councilman Menard moved all newly annexed area East of Hawthorne Rd from West Chubbuck Rd to Quinn Rd. be zoned Agricultural Transitional. Kinghorn seconded with an unanimous vote in favor of motion. PROPOSAL ON PLANNED USE OF REVENUE SHARING ALLOCATION from July 1, 1973 to July 1, 197~. Mayor and council proposed the following for Revenue Sharing allocation. Fire Dept =5,000.00; Water Dept construction=12,705.00; Street Dept Const.=12,705.00 Mayor and council voted unanimously in favor of the above planned use of Revenue Sharing allocation. The total planned allocation being $50,~10.00. RESOLUTION # 1~6-75 - Proclaiming general city election and designating polling place- read in full by Mayor Cotant. Councilman Kinghorn made motion Resolution #1~-73 proclaiming general city election and designating polling place be adopted. Menard seconded. Roll call vote: Menard, yes; Kinghorn, yes; Romriell, yes. Engineer Doug Jensen received approval to acquire a price and estimate to case for a future water pipe under interstate. MOVING BUILDING ORDINANCE # 125 read in f~]] ] by Attorney Hargraves. Motion to declare an emergency and dispense with rules of reading on three separate days made by Councilman Kinghorn. Menard seconded. Roll. call vote: Kinghorn, yes; Menard, yes; Romriell, yes. Councilman Romriell made'motion to adopt Ordinance #125, Kinghorn seconded. Roll csll vote: Kinghorn, yes, Menard, yes; Romriell, yes. BIDS FOR POLICE CAR - Bids were opened and are as follows: Glen's Chevrolet: Standard Model= 3,99~.80, Intermediate= 3,907.20 less trade in (optional) 200.00; C. Ed Flandro: Standard= 3,7~5.00, Intermediate= 3,576.00 less trade in (optional) ~00.00. Mayor and Police Chief' to review 'bids' and make decision.which car-~ to order. SEWER REPORT - Doug Jensen, engineer, reported the project is approximately 68% complete with the time being 70% complete. Mr. Jensen proposed a different street repair which consists of a cold mat finish to repair patch area and follow within two weeks with a complete hot mix coverage from curb to curb. Mayor and council approved this repair change. CLAIMS for September presented to Mayor and Council. Councilman Kinghorn made motion to pay bills.
