Present: Mayor Cotan%, Co~ncilmen Kinghorn, Menard Romriell and Taylor. Attorney Hargraves and clerk Vera Armstrong. Meeting cs]] ed to order by Mayor Cotant at 8:00 o~clock p.m. Minutes of July 2g meeting approved as written. FIRE DEPARTMENT REPORT~- Chief Denny Jones gave report of fire school attended by five members of fire department. They received a 2nd place trophy at school and Chief Jones presented to the city for display. Several volunteer firemen were present aud Mayor Cotant thanked the fireman for their dedicated work and hours spent in the fire department and also for their efforts in z.?aking the Chubbuck Day c~tebration a success. DETACHMENT REQUEST - Lynn Weller Sr. appealed to mayor and council for his property to be detached from city boundaries, He and his sons property on Hawthorne Rd. and south of the Interstate 15Wwas recently annexed to city. Mayor and council asked if they could take some time for consideration. Mr. Wel~er agreed to this. SEWER EASEMENT - John Mill er, Parkway Motel owner and his attorney Dale Kis]~ng presented a plan of construction he would accept for consideration of grantiug city an easement for city sewer construction line.~ Mayor stated the plan would be presented to the engineer for study., BAR X TRACTS - Dale Kisling stated the city engineer's requirement for development on Bar X Tracts were very stringent and suggested perhaps the city could work with him and Mr. Eaton and get the plat corrected to au acceptable state. Mr. Kisling said if the ~street was not acceptable he was sure they could bring that up to standard. Mayor Cotant informed Mr. Kisling the roads and utility easements were not shown on plat properly for acceptance. PLANNING AND ZONING VARIANCE ITEMS - Mr. Boslough, 330 Adams, was present protesting granting variance before proper procedure of public hearing had been held. Mayor told him the city was aware of the error and planned to avoid this in future. Menard recommended that the variance be granted provided Mr. Brooks install a 6 foot solid screen fence within 50 days of occupance of home. Taylor seconded with all in favor of motion. REZONINGREQUEST - George Lish, West Chubbuck Rd. has requested the north 184 feet of Lot 9, Chubbuck Acres be rezoned to R-2T. However, Planning and Zoning have recommended a variance be granted rather than spot zoning. Councilman Menard made motion the mayor and council approve the variance recommended~by P & Z which allows Mr. Lish to place two trailers on the north 184 foot of IX~t 9, Chubbuck Acres and also grant approval to place the water and sewer lines to serve these lots on his own property. Kinghorn seconded with a unanimous vote in favor of motion. Sam Taylor, 520 Adams Dr. informed council the stakes on his property are in error. Mr. Taylor said he felt his driveway extended onto the next property. He wast~ld by council it would be a legal matter to be solved by him and his developer. WATER LINE DEVELOPMENT - Mr. Ross Reese, representing Boise Cascade, informed mayor and council Boise Cascade were in need of water on West Chubbuck Road on lots which face Chubbuck Rd. from the north. These lots are between Hawthorne Rd~.~and Joy Street. Mr. Reese stated he knew it would be the cost of Boise Cascade to install the water line but if the city would like larger line insta]]ed than necessary to serve their lots he would ask cooperation of city to pay the difference in size of pipe installed. Councilman Taylor stated the city has worked with developers before in this way and he was sure they coo_ld. Mayor and council agreed to this. FENCING PARK AT COUNTRY ACRES - Mel Church, Tahoe Street, requests the city have the pa_~k property fenced in Country Acres Addition for safety from canal are~½~Iayor ~ . ~ 155 BURLEY STREET IMPROVED - Mayor and council discussed development of Burley Drive where there is already the 50 foot street fronting property Arthur McOmber has sold. Councilman Menard suggested the city send a letter to Mr. Mc0mber stating theY expect him to improve the street in an acceptable manner as soon as sewe~ construction is complete. SPEED CHECKS - Mayor Co%ant suggested dips be constructed on several streets that residents have complained of speeding and requested the dips. Majority of council disapproved the construction of dips in city streets stating they felt dips were almost as hazardous as speed bumps. Mayor and council ~also discussed drainage problems. It was noted there is a real need of a dry well on the corner of Tahoe and Bonanza and the city should request Fred Chase to install this. WATER BILL ADJUSTMENTS - Clerk Vera Armstrong requested the mayor and council approve a total adjustment of $218.85 on bad water accounts which have accumulated the past two years. Councilman Kinghornmade motion the council approve adjustments. Taylor sec°ndedwith a unanimous vote in favor of motion. FOLLOW UP ON ?REVIOUS BUSINESS - Mayor Cotant announced he had contacted the Postmaster aboUt safety of mailboxes along Yellowstone. Mayor also reported he has contacted the Pocatello Library about Bookmob~e stops and they responded they are willing to make any changes that will promote safety. The sign at Coin-O-Mat that blocked vision at the corner of Yellowstone and Chubbuck Rd. has been moved. BIDS ON POLICE CAR - Mayor and council discussed need of a new police car. Councilman Taylor made motion the city call for bids on a new police car. Kiughorn seconded with all councilmen in favor of motion. AZTLAN DEVELOPMENT - Sharlene Belanger and Rogelio Longoria represented this non-profit organization. Ms Belanger informed the council a self help grant has been awarded to this group and they have a proposed development of 120 single family homes . She requested permission to hook into the Chubbuck sewer system. Ms Belanger Said if Aztlanwere granted approval to hook into sewer system she would suggest the city approve b~]]ing through the Homeowner's Association. Councilman Menard reminded MS Belanger the development would be required to comply~ with the city sewer ordinance. Mayor Co%ant also informed them if the city ever reached capacity their development would be cut off first. Councilman Menard suggested an agreement be drawn up with the developers. Motion to give the Az%lan Development a letter accepting their development into sewer system subject to sewer ordinance, a negotiated agreement with developers and the b~]]ing is to be handled through the Homeowner's Association was made by Counc~tman Kinghorn. Menard seconded with a unanimous vote in favor of motion. ORDINANCE # 123 - An ordinance providing for lands to be rezoned read by Mayor Co%ant for 3r~.reading.~ This is the area owned by Intermountain Industries on the south side o~-Chubbuck Rd in%he g00-block. Menard ~ade motion council adopt Ordinance #123. Taylor seconded. Roll c~l vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. ...... Menard WATERLINE IMPROVEMENTS - Councilnnanmade motion ceuncil cai] for bids to instal] pipe under Interstate 15 on East Chubbuck Road for future waterline development. The size to be determined by the engineer. Romriell seconded with all council in favor of motion° ORDINANCE MOVING HOUSE' OR BUILDINGS INTO CHUBBUCK'~ Attorney Hargraves explained procedure and req~uirements of proposed ordinance. Menard suggested the Planning and Zoning commission be required to approve s]l 'applications. Romriell stated he felt the b~lding inspector should be qualified to approve the application. Taylor auggested building inspector inspect house and make recommendations to P & Z~for approval. Council agreed new construction should also be inspected. Mayor and council agreed if an application is received for moving of b~] ding int~o city of Chubbuck it will need to be approved by the counc~ as Ordinance #61 requires. Claims for month of August presented for payment. Councilman Menard moved the claims be approved. Taylor seconded with all in favor of motion.
