Present: -~Mayor Cotan-t, coUnc~lraen Kinghorn, ~Menar~ Romriell-snd Taylor, Attorney Hargraves snd clerk Vera Armstrong, Meeting called to order 8:05 p.m. by Mayor Cotant. MinUtes of meeting June 26 was approved as written. PUBLIC HEARING COUNCIL ACTION- George A. Lish requests rezoning the north 204 feet of Lot 9 of Chubbuck Acres. Planning and Zoning recommended a variance be granted to ~]low Mr. Lish to sell the north 18~ feet and allow the placement of one trailer on each of two lots, size 92' by 84.22 feet depth. A lengthy discussion followed if water and sewer should be in street or on private property. CounciLman Romriell made motion the variance be granted with the city engineer and inspector approving location of water and sewer line. For lack of a second, motion was tabled. CounciLman Kinghorn stated it should be checked out with Murray and Frasure if these line could be installed in street. DELINQUENT WATER B~J, - Lena Giannini, ~8d2 Yellowstone, requested the mayor and council make some changes in water ordinance so she doesn't have to pay water bills tenants leave unpaid. She suggested a larger deposit or turning off water when bill is one month old. Mayor informed her city would need to collect a water deposit but perhaps she coul_~ollect a rental deposit to cover unpaid bill s. After further discussion Mayor Cotant informed her proper adjustment would be made. TURNER SUBDMSION - Newell Turner presented his preliminary plat for approval. After reviewing Councilman Me-mard moved the council accept the preliminary plat . Kiughorn seconded with all ,OounciLmen in favor of motion. After further reviewing by the Enginee$ Councilm~e~d the council approve Turner's final plat but mayor does not sign until preliminary plans a~ returned to city with corrections as to dropped man- hole ~nd easement on priv~e property removed. Taylor seconded motion with Menard, ~'Taylor and 'Kinghorn voting favor of motion and Romriell voting against motion. SCHd~)L DISTRICT PROPERTY INQUIRY - Dennis Leslie, Darlene and Bill Brown were present to question if city of Chubbuck offered to develop park on school grOund property, because school district had put in sprinkler system, fenced and allowed school district em- ployees, Murray Layne and Gordon Waford to reap benefits of a hay field. Mayor in- fOrmed them he had communications with school district offering cooperation on getting the area developed into grass for playground area and help clean up area so that weeds, black widows and grasshoppers could be eliminated. Mayor said the last he heard the school district said they couldn't afford to water the area. Mayor was asked if city would sti]] participate with school for some park development and maintenance. Mayor and council informed the Brown's the~ city would. REPORT ON MEETING WITH HIGHWAY OFFICIALS -Mayor reported that he and Engineer Perkins had met with Roy Stroschein, Roy Hardin and Andrew Nielsen of Highway ~epartment, Senator Bilyeu and Representative Albert Johnson to discuss Highway 191 development Chubbuck has requested. The city has lost points as for preference for need, but mayor report- ed he felt the meeting was advantageous and possibly some good wd~l come from meeting. Mayor also stated he had requested functional stop and go light be activated at intersection of Yellowstone and Chubbuck Rd for the busy hours of each day at least. WATER SURVEY REPORT - Engineer Perkins informed council they would like to present a preliminary water report and woulk like council and mayor to make comments on what they would like so a projected plan could be completed. Jim Keller informed mayor and council he had projected a population of ll,O00 by 1995 and showed where the growth was anticipated. Mayor and council gave their ideas of growth and requested the engineers prepare a projected plan for present city limits with additional plan of extended growth outside city limits. REAR YARD SETBACK REQUirEMENT - Paul Brooks and his two sons were present to get mayor's and council's feeling on allowing him to build in Stuart 3rd Addition on Lot 1 Blk 3 facing Lucky St with a 16.5 rear yard setback when 20 foot is required~in zoning (cont' d) ordinance. Mayor and council stated they had no objections and a public hearing on this variance request will be scheduled. SEWER AND WATER REQUIREMENT - Larry Ankrum questioned council about water supply and requirements as to dumping acids, etc into sewer system. He was informed that water should be available and he would need to check Pocatello's sewer ordinance for what can be dumped into system. SEWER REPORT _ Doug Jensen gave a report on sewer progres~. He reported the project was ~0% complete and hoped when construction on lines not so deep started the schedule could be brought up to date. CONDEMNATION ON SEWER EASEMENTS - Attorney Hargraves reported the appraiser had looked over property left to secure easements for and reported valuation was minimal. Councilman Menard moved Attorney Hargraves proceed with condemnations on Mabel J. Parrish, Parrish Realty & Ins. Co., Roger Allen White, Diversified Investment Group, Mabel Kasiska and any other easements that need to be acquired. Taylor seconded. Discussion followed on whether names should be quoted. Menard said he wanted motion to state names. Roll call vote; Menard, yes; Taylor, yes; Kinghorn, NO~ Romriell, no. KJ_nghorn and Romriell disapproved of quoting names. Because of a tie vote the Mayor was required to vote and voted in favor of motion. ORDINANCE # 122 - Ordinance annexing certsJ_u lands to the city of Chubbuck consisting of two parcels which include property east of Hawthorne Rd. from Chubbuck Rd. to Quinn Rd. which is not already included in the corporate limits of the city was read in fu]~ by Mayor Cotant. Councilman Taylor made motion to dispense with rule of reading on three separate days. Kiughorn seconded. Roll c~ll vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. Motion to adopt Ordinance #122 made by Councilman Menard seconded by Taylor. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes; ORDINANCE # 125 - Rezoning certain lands on East Chubbuck Rd. read in full by Mayor Cotant. Motion to accept Ordinance #125 as first reading was made by Councilman Menard and seconded by Taylor. Roll c~ll vote: Kinghorn, ~yes;'Menard, yes; Romriell, yes; Taylor, yes. ORDINANCE # 12~ - Rezoning certaiu lands on east side of Burley Drive read iu full by Mayor Cotant. Councilman Menard made motion to dispense with rule of reading on three separate days. Taylor seconded. Roll c~l~ vote: Kinghorn, yes; Menard, yes, Romriell, yes, Taylor, yes. Councilman Kiughorn made motion to adopt Ordinance #12~ and Romriell seconded. Roll call vote: Kiughorn, yes; Menard, yes; Romriell, yes; Taylor, yes. FI~E STATION - Mayor suggested the Fire Station be painted and the sewer line be in- stalled so ~the property around station can be blacktopped. Council in favor. CLAIM ON SEWER FUND - Request for $6,000.00 payment made by George Hargraves for his service on sewer project. Mayor and council approved claim. JOE WISE CLAIM - Bank of Idaho, Boise, has presented a claim to city for payment due · Attorney Wise for work on sewer project. Mr. Wise assigned the amount due him to the First Bank and Trust of Idaho in Mslad. Attorney Hargraves suggested contacting Attorney Wise and asking for an itemized statement of amount due him. Attorney Hargraves also offered to answer letter from Richard Greener, Bank of Idaho, Boise. FIRE HYDRANT - Councilman Kiughorn suggested a fire hydrant be placed on Burnside. Councilman Romriell made motion Mr. Kiughorn take action to get this installed. Taylor seconded with all council in favor. Councilman Kiughorn also requested a fire hydrant be inst~11 ed on corner of Siphon Rd. and Hawthorne Rd. Council agreed to this installation also. CLAIMS FOR JULY presented to mayor and council. Councilman Kinghorn moved bills be paid. F__Romriell seconded with a unanimous vote in favOr of motion. ~ANCIAL STATEMENT presented to mayor and council.
