A special meeting of the Mayor and Council held in the city municipal building
February 21, 1973 at 5~50 p.m.
Present: Mayor Cotant, Councilmen Kinghorn, Menard, Ronmiell and Taylor, Attorney
Hargraves and Clerk Vera Armstrong
Meeting called to order by Mayor Cotant at 5:50 p.m.
Purpose of special meeting to discuss sewer problems.
CONNECTIONS TO SEWER LINE OUTSIDE CITY LIMITS - Mayor Cotant suggested the city approve
construction of a few sewer service lines on West Chubbuck Rd. where there is develop-
ment now and they may desire to hook-up later.
Councilman Menard stated he still favored a sewer district.
Problem of collecting sewer charges outside city limits discussed. Attorney Hargraves
stated an agreement would have to be entered into which would put a lein on property
if service charges not paid.

Councilman Kinghorn propesed that the city approve some service lines on Chubbuck
Road. No action .
Attorney Hargraves was requested to contact HUD legal council and inquire what effect
a sewer agreement with outside city limits would have on grants and loan.
Councilmen Menard and Taylor both stated they did not approve of spending project
money for any service lines not in project, especially outside city limits. Taylor
suggested waiting until Tuesday council meeting before taking any action. Attorney
Hargraves will c~]] HUD and Mayor Cotant will discuss this with Engineer Perkins.
Mayor also stated the need of adopting a sewer ordinance.
It was agreed by Mayor and Council that anyone desiring a service line outside city
limits, if approved by city and engineer, could pay charges determined by engineer
and it 'would be installed during project. '~
EASEMENTS - Mayor Cotant informed council and attorney that easements were difficult
to acquire because some property owners are feeling there is not enough, protection
worded in easement and other property owners did not like the wording sell and sold
in easement agreement.
Attorney Hargraves informed council the words sell and sold could be deleted to
satisfy property owners that request same.
After some discussion it was agreed for Attorney Hargraves to prepare a letter
to guarantee the property owner signing easements of. protection for their property
and animals while construction is taking place.
