HomeMy WebLinkAbout10 24 2000 CM149 COUNCIL MEETING MINUTES October 24th, 2000 Minutes of a regular meeting held at the Chubbuck City Council Chambers, October 24th, 2000. Present: Mayor John O. Cotant, Council members Steven M. England, Marvin C. Gunter, B. Kent Keams, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Councilman Leroy S. Quick was excused. Meeting was called to order at 7:30 p.m. by Mayor Cotant. INVOCATION was given by Bishop William Pincock, Whitaker Ward, The Church of Jesus Christ of Latter-Day Saints. PLEDGE ALLEGIANCE TO THE FLAG was lead by Kris Kinghorn. APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the regular meeting minutes of October 10% 2000. Councilman Kearns moved to approve the regular meeting minutes of October 10th, 2000 as read, Councilman Gunter seconded. All council members present voted in favor of motion. R&G SUBDWISION FINAL PLAT - City Staff report stated the preliminary plat approval required that an easement for access of up to 50' be located on the south property line of the development. Since such approval testing has been performed to determine if the existing mall access, (Breneman Rd.) has been constructed to high enough standards to be accepted as a city street, it will eliminate the need for the access easement. PWD Smart stated the applicant has dedicated an additional 15 feet of right-of-way along the Hawthorne Road frontage, and is consistent with the comprehensive plan. PWD Smart stated Staff recommends approval of the R & G Final Plat as presented. PWD Smart said the City received the pavement analysis which is estimated at about $150,000. for 5 1/2" of paving. PWD Smart said we need to find a way to share the cost between R & G, Price Development, etc. R & G Development Representative said she will pass the request along. Councilman England moved to approve the R & G Subdivision Final Plat as presented, Councilman Keams seconded. All council members present voted in favor of motion. 151 COUNCIL MEETING MINUTES - (cont.) October 24th, 2000 U.S. ARMY CORPS OF ENGINEERS PLANNING ASSISTANCE AGREEMENT - After discussion Council decided more information is needed on the potential total costs of project study. Council tabled the agreement until the November 14th, 2000 Council Meeting. BUSINESS LICENSE APPLICATION - Efrain Pelago, E1 Herradero, 115 Roosevelt, Pocatello, Idaho has applied for a business license to sell Mexican food from a food van at the Green Triangle Parking Lot. Councilman Gunter moved to grant a business license to Efrain Pelago, E1 Herradero to sell food from a van at the Green Triangle Parking Lot, Councilman England seconded. All council members present voted in favor of motion. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Keams moved to approve computer print-out claims as presented, Councilman Gunter seconded. All council members present voted in favor of motion. DORM FENNER PROPERTY AT 4708 YELLOWSTONE AVE - Charlie Johnson, Dorm Fenner's Attorney stated Dorm Fenner recently entered into a lease with Kit Manufactured Homes. Mr. Johnson said over the last 25 years Mr. Fenner has had two street accesses to the property. Kit Manufacture Homes applied for a license and the license had been declined because the City is requiring one only access to the property. Gene Hancock, a realtor was present stating the property is worth a lot more with two accesses, rather than one access. Charlie Johnson proposed the City of Chubbuck grant a temporary access permit to Mr. Fenner so he can continue the use and operation of his business with Kit Manufacturing being the tenant in the same manner he has in the past, with two accesses until there is another sale, or change in the use to the parcel. Attorney Holmes suggested the additional access be tied to the expiration of the Kit Mfg. lease. Councilman England moved to grant Dorm Fenner a temporary access for a maximum of four years, or anytime there is a resale, release or transfer of the property, Councilman Kearns seconded. All council members present voted in favor of motion. Attorney Holmes will draft an agreement for review. 153 COUNCIL MEETING MINUTES - (cont.) October 24th, 2000 GENERAL DISCUSSION - Councilman Gunter expressed concern about the re-striping of the W. Chubbuck and Hawthorne Road intersection. Councilman Gunter said drivers have to watch closer now entering the intersection then they used to. PWD Smart said he received a lot more complaints the way it was striped before. Councilman Kearns suggested East Chubbuck and Hiline Road intersection be a priority when the snow flies. PWD Smart said the intersection is a number one priority when it snows.
