Minutes of a regular meeting held at the Chubbuck City Council Chambers, October 10th, 2000.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes and City Clerk Ron C. Conlin.
Public Works Director Steven M. Smart was excused.
Meeting was called to order at 7:32 p.m. by Mayor Cotant.
INVOCATION was given by Pastor Ely of the Heritage Baptist Church.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Nick Povey, 5463 Jerry Street.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to regular meeting
minutes of September 26th, 2000.
Councilman Kearns moved to approve the regular meeting minutes of September 26th,
2000 as read, subject to noting correction of date in Para~aph 1 on the September 12th,
2000 Council Minutes, Councilman Quick seconded. All council members voted in favor
of motion.
WORLD POPULATION AWARENESS WEEK PROCLAMATION - Mayor Cotant read the
proclamation in full.
Councilman Kearns moved to direct Mayor Cotant to proclaim October 22-28, 2000 as
World Population Awareness Week, Councilman England seconded. All council
members voted in favor of motion.
PUBLIC HEARING - NOTICE OF SALE AT PUBLIC AUCTION - The Mayor and Council of
the City of Chubbuck have attthorized by Ordinance the sale of the following described
real properties owned by the City, located at 5200 Yellowstone Ave.
That certain 22.5' easement for railroad spur on the north side of Bullock Street in the
Rickert Subdivision.
Mayor Cotant declared the public hearing open asking for comments from the public.

Gary Cooper, 495 Fairway, property owner adjacent to the easement to be auctioned.
Mr. Cooper said his property line and where the easement begins goes right down the
center of the railroad track. Mr. Cooper said UPRR cut off the spur into the Pocatello
Industrial Park which severed all activity making all the track useless. Mr. Cooper said he
removed the track and salvaged it. This left a big depression where the easement is, which
is approx, ten feet below the surface of Bullock Road. Mr. Cooper said his concern is the
depression has become a trash collector. Mr. Cooper said he would like to have filled in
but realized the City owns a portion of the problem.
There being no further comment from the public, Mayor Cotant declared the public
hearing closed.
Mayor Cotant asked if there was any bids. There were no bids.
Councilman Quick asked if Bullock Road might need to be widened in the future. Mayor
Cotant said he did not think Bullock Road would ever need to be wider than is.
Attorney Holmes suggested Mr. Cooper purchase the land for an amount of money, then
enter into an agreement that he would give the City the right t° purchase the land back for
Mr. Cooper's cost, plus what it cost him to clean it up, plus a profit if he is willing to do
something like that.
Councilman England moved to direct Mayor Cotant to negociate the details using
Attorney Holmes suggestion as a guideline, Councilman Kearns seconded. All council
members voted in favor of motion.
U.S. ARMY CORPS OF ENGINEERS REQUEST - Mayor Cotant suggested Public Works
Director Steve Smart be present when the U.S. Army Corps of Engineers request is on the
Agenda. Council agreed.
UTILITY BILL COLLECTION - Attorney Holmes reviewed the liens against landlords for
tenant utility bills policy. Attorney Holmes said the Idaho Supreme Court does not allow
a delinquent tenant utility bill to be collected from the property owner.
Attorney Holmes stated the Council might consider having an ordinance passed that
would be effective at some point in the future, say January 1, 2001, which provides that
no utility account will be open for a tenant unless the landlord guarantees payment and
agrees that the property could be subjected to a lien.

Discussion about raising the deposit required at the time the tenant moves in.
Attorney Holmes said he will prepare a proposed ordinance, City Staff will mail to
property owners inviting them to a Council Meeting to discuss the concerns.
CLAIMS - Computer print-out claims presented to Mayor Cotant and Council.
Councilman Quick moved to approve computer print-out claims as presented,
Councilman Gunter seconded. All council members voted in favor of motion.
At 8:12 p.m., Councilman Gunter moved, Councilman Kearns seconded, with full council
approval to adjourn meeting.
