COUNCIL MEETING MINUTES
July 1 lth, 2000
Minutes of a regular meeting held at the Chubbuck City council Chambers, July 11th, 2000.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, B. Kent
Kearns, Attorney Thomas J. Holmes and City Clerk Ron C. Conlin. Councilman Marvin
C. Gunter and Public Works Director Steven M. Smart were excused.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular
Meeting Minutes of June 13th, 2000 and Special Meeting Minutes of June 21st, 2000.
Councilman Kearns moved to approve the Regular Meeting Minutes of June 13th, 2000
and Special Meeting Minutes of June 21st, 2000 as read, Councilman Quick seconded. All
council members present voted in favor of motion.
PUBLIC HEARING - Revising Day Care, Taxi, Massage, Security and Private Investigator
application fees:

Mayor Cotant declared the public hearing open, there being no comment from public,

RESOLUTION #6-2000 - Fees charged for a license issued to Pawnbroker under Chapter 5.05, a
taxicab operator under 5.07, a Security Officer under 5.24 and a Massage Therapist under
5.28 shall be fifty dollars for a new license and Sixteen dollars for a renewal of an
existing license.
Mayor Cotant read Resolution #6-2000 in full.
Councilman Kearns moved to adopt Resolution #6-2000 as read, Councilman Quick
seconded. All council members present voted in favor of motion.

CERTI3'ICATE OF APPRECIATION - Mayor Cotant presented Officer Jean Higgins a
certificate of appreciation for being picked "Outstanding Police Officer of the Year" in
the State of Idaho.
CATERING PERMIT APPLICATION - Hillman Corp./Green Triangle, 4010 Yellowstone Ave.
has applied for a catering permit to cater a class reunion at the Days Inn, 133 W. Burnside
Ave. from 6:00 p.m. to 2:00 a.m. on July 15th, 2000.
Councilman England moved to grant the Green Triangle a catering permit to cater a class
reunion at the Days Inn, 133 W. Burnside Ave. on the 15th of July, 2000, from 6:00 p.m.
to 2:00 a.m. subject to Police Department approval, Councilman Quick seconded. All
council members present voted in favor of motion.
AGREEMENT - PRICE BENCH'S OF DAHO - Placement of benches within certain areas of
the City for the comfort and convenience of its residents and citizens.
Councilman England moved to authorized Mayor Cotant to enter into an agreement with
Scott Price, 589 Canal, Chubbuck, Idaho, Price Bench's of Idaho for a period of five
years, Councilman Keams seconded. All council members present voted in favor of
motion.
DAY CARE FACILITY APPLICATION - Caralee Beers, 5971 Ruth St., Chubbuck has applied
for a day care facility license at 5971 Ruth St.
All departments recommended the Council approve the Day Care Facility Application.
Councilman Kearns moved to grant Caralee Beers, 5971 Ruth St. a business license to
operate a day care facility at 5971 Ruth Street, Councilman England seconded. All
council members voted in favor of motion.
P & B SUBDIVISION FINAL PLAT - Tim Shurtliff, Shurtliff Engineering, 426 W. Lewis
Pocatello presented the P&B Subdivision Final Plat, answering questions the Council had
on the final plat.
Discussion about street signs, City Engineer Sean Harris stated the no parking signs are to
be installed at the developer's cost.
Engineer Sean Harris said he will notify the Police Department when Yellowstone Ave.
addresses are changed to Belva's Lane.
Councilman England moved to accept the P & B Subdivision Final Plat as presented,
Councilman Keams seconded. All council members present voted in favor of motion.

ACCEPTANCE OF OFFER OF DEDICATION - MOUNTAIN PARK SUBDIVISION -
Councilman Quick moved to accept the dedication and offer of dedication as contained in
the final plat of Mountain Park Subdivision, Councilman England seconded. All council
members present voted in favor of motion.
ORDINANCE #529 - Amending Chapter 5.05, pawnbrokers and pawnshops, Chapter 5.07,
Taxicabs, Chapter 5.24, security officers and private investigators, and Chapter 5.28,
massage therapy to provide that all fees for license under each chapter shall be as from
time to time set by City Council by resolution, providing that any license under the
Chapter shall expire December 31 of the year issued, providing that a license may be
renewed, clarifying that only operators of taxicabs are licensed, deleting any separate fee
for a licensee under Chapter 5.24 to carry a firearm, repealing any temporary license
under Chapter 5.24; providing that a massage therapist must obtain a massage therapy
license.
Council read Ordinance #529 in full for the first and final reading.
Councilman England moved to dispense with the rule of reading Ordinance #529 on three
separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes;
Gunter, absent; Kearns, yes. Motion passes.
Councilman Quick moved to adopt Ordinance #529 as read, Councilman England
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, absent; Kearns, yes. Motion
passes.
ORDINANCE - Amending Section 5.07.140 to require a driver's license instead of a chauffeur's
license; amending Section 6.04.060 to provide for annual licenses for daycare facilities;
adding Section 6.04.095 to require all children in a daycare facility to have current
immunizations; amending 6.04.120 to specify certain conditions applicable to daycare
facilities.
Attorney Holmes read ordinance by title only for the first reading.
Council tabled the ordinance until the July 25th, 2000 Council Meeting.
ORDINANCE #530 - Amending Chapter 9.20.021 to provide dog and kennel licenses are on a
calendar year term; eliminating the provision doubling fees if not purchased by a certain
date; amending Section 9.20.023 to place the responsibility for licensing under Chapter
9.20 with the Chief of Police.

Attorney Holmes read Ordinance #530 in full.

ORDINANCE #531 - Amending Section 15.24.020(B) of the Chubbuck Municipal Code to
allow reader board signs.
Attorney Holmes read Ordinance #531 by title only for the third reading, one of which
was in full.
Councilman England moved to adopt Ordinance #531 as read, Councilman Kearns
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, absent; Kearns, yes. Motion
passes.
CLAIMS - Computer print-out claims presented to Mayor Cotant and Council.
Councilman Kearns moved to approve computer print-out claims as presented,
Councilman Quick seconded. All council members present voted in favor of motion.
At 8:11 p.m., Councilman England moved, Councilman Quick seconded, with full council
approval to adjourn meeting.
