Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Councilman B. Kent Kearns was excused. Mayor Cotant called the Special Meeting to order at 10:50 a.m. PURPOSE OF SPECIAL MEETING is to discuss proposed park dedication fees with builders and developers. PROPOSED INCREASE ON PARK DEDICATION FEES - Mayor Cotant stated the park development fee the City of Chubbuck is collecting, is not covering the cost of constructing parks in the City. PWD Smart presented land and development costs for parks, proposing the park development fee be increased to $791.87 for park development per residence and $260.42 for raw park land per residence, for a total of $1,052.29 per residence. Syd Wood, Chairman of the Building Contractors Association of South East Idaho stated the Association is deeply concerned with the prospect of increasing the park dedication fee in the City of Chubbuck. Such an increase would be extremely detrimental tot he ~. building industry in Chubbuck. Mr. Wood stated the following are some questions and concerns which they feel must be addressed before action is taken: 1. What basis in fact was used to implement the existing fee? 2. Does the City have a facility study, including a plan for future needs and the related costs on which to base the fee. 3. How many acres of park does the City of Chubbuck have today compared to the number of acres three years ago? 4. What kind of parks does the City have and how many acres of each type? 5. Benefit and assessment - how is the existing park fee used? Are the fees collected into a fund, or are they kept separate for use in parks directly affected by the fees. (Are fees from one area supporting a park in another area of the City? 6. The City cannot make newcomers alone pay for city parks. The City must first bring everyone up to the existing level through bonds and then charge newcomers to participate. How is this achieved? Syd Wood explained the BCASEI does not want to see something to happen that will be detrimental to both the City and the BCASEI. Mr. Wood stated the BCASEI would like to be part of the solution and not part of the problem. The BCASEL realizes the importance of having city parks. Mr. Wood said cities throughout the United States are losing court cases because of not following the above six concerns. Mr. Wood suggested the City work with the BCASEI while determining a park dedication fee. Discussion about how many city parks there should be, along with size of city parks. Darris Ellis suggested larger city parks instead of the smaller neighborhood city parks. Syd Wood suggested there be a more broad base tax to pay for city parks. Syd Wood stated, should the city choose to move forward with the fee increase the city will be required to adhere to the accountability process required by Idaho's Impact Fee Legislation. Mayor Cotant stated the City of Chubbuck will work with the BCASEI while determining the amount of the park dedication fee.
