HomeMy WebLinkAbout09 11 2001 CM163 COUNCIL MEETING MINUTES September I Ph, 2001 Minutes of a regular meeting held at the Chubbuck City Council Chambers, September 11`h, 2001. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron Conlin. Meeting called to order at 7:30 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG was led by Daniel Carling. INVOCATION was given by Councilman Leroy S. Quick. APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to regular meeting minutes of August 28', 2001. Council member Kearns moved to approve the regular meeting minutes with correction of typo on page 153, last paragraph, Councilman Quick seconded. All council members voted in favor of motion. RESOLUTION #3 -2001 - Proclaiming a General City Election to be held on November 6 1', 2001, designating the polling place, designating the deputy registrars, and ordering the City Clerk to give notice of such election. Sheila Griffiths, 168 Jacobs expressed concern that in prior elections, residents had to wait in line to vote. Sheila Griffiths suggested the Council designate two polling places for this election. CC Conlin said there have been two voting tables in prior elections, one being, A -M and the other N -Z. After discussion, Council was in agreement to have three tables rather than two to help with concern of residents having to wait in line. After discussion, Councilman England moved to adopt Resolution #3 -2001 as read, Councilman Quick seconded. All council members voted in favor of motion. 165 COUNCIL MEETING MINUTES - (cont.) September 11th, 2001 APPEAL - TONY GOLSSARY APPEAL ON NOTICE OF VIOLATION FOR LANDSCAPING FOOTAGE REQUIREMENTS ON RAINBOW ROAD - Larry Kohntopp stated he did not invite Mr. Golssary to this meeting. Council tabled the appeal until the September 25`h, 2001 Council Meeting. ACCEPTANCE OF OFFER OF DEDICATION - P & B SUBDIVISION - On July 11th, 2000 the final plat of P & B Subdivision was approved by the Chubbuck City Council, and said plat is recorded on page 787 of the Book of Plats of Bannock County, Idaho and is further recorded as Instrument No. 20112299 in the official records of Bannock County. Councilman Kearns moved to approve the Acceptance of Offer of Dedication of P & B Subdivision as read, Councilman Gunter seconded. All council members voted in favor of motion. ACCEPTANCE OF OFFER OF DEDICATION - MYSTIQUE SUBDIVISION - On August 8th, 2000, the final plat of Mystique Subdivision was approved by the Chubbuck City Council and said plat is recorded on page 770 of the Book of Plats of Bannock County, Idaho and is further recorded as Instrument No. 20019204 in the official records of Bannock County, Idaho. Councilman Gunter moved to approve the Acceptance of Offer of Dedication of Mystique Subdivision as read, Councilman Quick seconded. All council members voted in favor of motion. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman England moved to approve computer print -out claims as presented, Councilman Kearns seconded. All council members voted in favor of motion. ORDINANCE - Establishing Chapter 9.38 "Public Parks" to provide for the prohibition of certain activities in parks; providing for definitions; providing hours parks are closed; prohibiting dogs and animals in parks; prohibiting alcoholic beverages; prohibiting the damage or destruction of park property, real or personal; providing for enforcement and penalties. Attorney Holmes read ordinance by title only for the first reading. Council tabled the ordinance until the September 25th, 2001 Council Meeting. COUNCIL MEETING MINUTES - (cont.) September 11"', 2001 GENERAL BUSINESS - 167 Bryan Phinney, Keller Associates was present to address Council's request to see if the City is duplicating the Build -Out Analysis by entering into the Water and Sewer Grant Agreements and Amendments. Mr. Phinney stated he talked to Robert Chambers with the City of Pocatello and he told him the Build -Out Analysis is mostly zoning issues. CC Conlin said he removed the Water and Sewer Grant Agreements and Amendments Resolutions from the Agenda. CC Conlin was directed to put the resolutions on the September 25`h, 2001 Council Meeting Agenda.
