COUNCIL MEETING MINUTES
September 28`h, 2004
Minutes of a regular meeting held at the Chubbuck City Council Chambers, September 28`h,
2004.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M.
Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:32 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular
Meeting Minutes of September 14th, 2004.
Councilman Kearns moved to approve the Regular Meeting Minutes of September 14th,
2004 with the following correction on Page 171, General Discussion Number 2 should
read, "the sign advertising the realtor for Kays Kove Subdivision homes being on public
property", Councilman England seconded. All council members present voted in favor of
motion.
ORDINANCE - Adding Section 17.16.100 to the Chubbuck Municipal Code to require the water
rights to any canal water serving ground to be developed to be assigned to the City unless
the owner will otherwise be using those rights; to require the owner to show plans for
such use.
Attorney Holmes read ordinance by title only for the second reading.
Council tabled the ordinance until the October 12th, 2004 Council Meeting.
ORDINANCE - Amending Section 16.16.030 of the Chubbuck Municipal Code to provide an
administrative charge of one hundred dollars for the first time the City must re- mediate
dust or spillage of dirt, mud, building materials and waste articles on the City Streets
from adjacent properties, a two hundred fifty dollar charge for the second time within a
twelve month period and a five hundred dollar charge for the third and any subsequent
times within a twelve month period.
Attorney Holmes read the proposed ordinance in full for the second reading.
Councilman England suggested the Builder's Association be given a copy of the proposed
ordinance and advise them the final reading on the proposed ordinance will be at the
October 12`h, 2004 Council Meeting.

CHUBBUCK FIRE DEPARTMENT OPERATIONS MANUAL - Fire Chief Eric King was
present to answer questions on the proposed manual.
Councilman England moved to approve the City of Chubbuck Fire Department
Operations Manual as presented, Councilman Kearns seconded. All council members
voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Gunter moved to approve the computer print -out claims as presented,
Councilman Kearns seconded. All council members voted in favor of motion.
ANNOUNCEMENT - Rocky Mountain Engineering will conduct a public information meeting
at Chubbuck School to present the results of the School Zone Study and to solicit
comments. This meeting will be held at 6:30 to 8:30 p.m, Tuesday, October 12 ', 2004
and school zones for the following schools will be specifically addressed: Chubbuck,
Ellis, Wilcox and Hawthorne.
Councilman England stated he asked the announcement be placed on the agenda because
it came from Bannock Planning Organization.
Councilman England gave a report on the School Zone Study Meeting.
GENERAL DISCUSSIONS -
1. PWD Smart presented a slide report on Roundabouts.
2. Mary Bunce, 755 E. Chubbuck Road expressed concern about Deloy Stuart not moving
the home on his property on E. Chubbuck Road. City Staff will followup.
Councilman Kearns suggested that a copy of the dust control ordinance be given to
Deloy Stuart for his property on E. Chubbuck Road.
At 8:20 p.m, Councilman England moved, Councilman Quick seconded, with full council
approval to adjourn meeting.
