COUNCIL MEETING MINUTES
August 10', 2004
Minutes of a regular meeting held at the Chubbuck City Council Chambers, August 10`h, 2004.
Present: Mayor John O. Cotant, Council members Steven M. England, Marvin C. Gunter, Kent
Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City
Clerk Ron C. Conlin. Council member Leroy S. Quick was excused.
Meeting called to order at 7:30 p.m. by Mayor Cotant.
Mayor Cotant introduced Josh Madsen as a student council member
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to Special
Meeting Minutes of July 27th, 2004 and Regular Meeting Minutes of July 27th, 2004.
Councilman Kearns moved to approve the Special Meeting Minutes of July 27th, 2004
and Regular Meeting Minutes of July 27', 2004 as read, Councilman Gunter seconded.
All council members present voted in favor of motion.
SUNSET WEST SUBDIVISION PRELIMINARY PLAT - Larry Herrod, 5612 Hawthorne Road
presented the Sunset West Subdivision Preliminary Plat.
PWD Smart stated the Sunset West Subdivision is outside of City Limits, the developers
have asked the City for sewer and water service.
PWD Smart said the water line should be a 16" line instead of 12 ".
Mr. Herrod asked the Council if the City would consider participating in the difference in
the size of the water line. Mayor Cotant stated the City does participate when a water line
is required larger than what is there..
Mayor Cotant suggested there be a park rather than small berms and grass areas
throughout the subdivision. Mayor Cotant stated there should be public parking around
the park area.
Mr. Herrod said the homeowners association will maintain the public areas, park, berms,
etc.
Attorney Holmes suggested the City review the Sunset West Subdivision Home Owners
Association Agreement.
Discussion about a secondary irrigation system.

SUNSET WEST SUBDIVISION PRELIMINARY PLAT - (cont.)
Councilman Kearns moved to recommend to Bannock County approval of the Sunset
West Preliminary Plat with the following conditions:
1. Name change of Sabrina Street.
2. Staff recommends the 16" waterline extend west 2700' on Chubbuck Road and
connect with the waterline in Jasmine Drive. City participation though
negotiations with City Staff and Attorney Holmes.
3. Standard 6" curb and gutter be used instead of ribbon curb.
4. Required to use standard pavement section for collector streets on Jasmine
Drive.
5. City Standard 55' radius cul -de -sac is required.
6. Phasing as proposed by development - The second access will be in the
second phase..
7. Council to review the Sunset Homeowners Association Agreement and be
allowed to provide input.
8. Consider public parking spaces for park area.
9. The Sunset West Subdivision will be annexed into City of Chubbuck at
such time it is contiguous with the City of Chubbuck.
10. Explore possibilities of second water irrigation system or assignment of water
rights to the City of Chubbuck.
Councilman England seconded. All council members present voted in favor of motion.
FINAL SHORT PLAT - PWD Smart presented the Family Dollar Store Addition Final Short
Plat.
Councilman England moved to approve the Family Dollar Store Additional Final Short
Plat as presented, Councilman Kearns seconded. All council members voted in favor of
motion.
REQUEST FROM BANNOCK BARK PARKS - Alissa Salmore, Chair Bannock Bark Parks
presented the idea of dog parks to the City Council with the intent to open discussion
about creating a dog park in the City of Chubbuck.
Alissa Salmore said they would like a dog park in Chubbuck, their mission is to provide
the organizational and fiscal resources to make it happen.
Alissa Salmore said the fund raising strategies are going to include grant writing, local
fund raising, private donations and membership fees.

REQUEST FROM BANNOCK BARK PARKS - (cont.)
Alissa Salmore stated dog parks usually have a 4' to 5' fences around them, with an
airlock gate. There will be signs posted stating the rules. The infrastructure is funded by
the Bannock Bark Parks Organization. Alissa said dog parks are usually one acre or more.
Attorney Holmes said he will prepare a resolution addressing the use of an acre of land in
Capell Park for a Bannock Bark Park on the next Council Meeting Agenda.
PARKS, THE GULLY AND FUTURE PARKS ON EAST CHUBBUCK ROAD - Dennis
Stoddard, 780 E. Chubbuck Road stated he is disappointed on what has happened with
parks in his area over the years. Mr. Stoddard felt it is time the East Chubbuck Road area
received a park. Mr. Stoddard stated the first recommendation he would make is to put
park benches and a pavilion in the parks that are near the area.
Mr. Stoddard said there are several people in the area that will donate time installing
benches, playground equipment and a pavilion.
Mr. Stoddard said the residents in the area will talk to the Harts' about a park dedication.
Mayor Cotant said the only location for a park in that area now is the Hart Property.
Steve Nielson, 765 Leondias spoke in favor of a park in the subdivision. Mr. Nielson said
he would like a pavilion in Jordan Park.
Deloy Stuart, 767 Monika Court suggested Mayor Cotant and Council be pro- active with
new developers to make sure we get the necessary parks. Mr. Stuart suggested a green
way be put along the canal. Mr. Stuart felt the residents will help with donations and
labor.
Mayor Cotant will meet with residents about where a pavilion will be placed in
Community Park.
ORDINANCE #589 - Adding daycare to Section 18.12.030 (2) (k) of the Chubbuck Municipal
Code to clarify that a day care may be a major home occupation for which the procedures
for a major home occupation may apply.
Attorney Holmes read Ordinance #589 in full for the third and final reading.
Councilman England moved to adopt Ordinance #589 as read, Councilman Gunter
seconded. Roll Call Vote: Quick, absent; England, yes; Gunter, yes; Kearns, yes.

BID - PARK LAWN DRIVE CONSTRUCTION - YELLOWSTONE AVE AND PARK LAWN
PWD Smart presented a recap of the bids received:

PWD Smart stated all seems to be in order with the low bidder Jack B. Parsons.
Councilman England moved to authorize Mayor Cotant to enter into a contract with Jack
B. Parsons Company for the low bid of $69,106.60, Councilman Kearns seconded. All
council members present voted in favor of the motion.
2004 -2005 FISCAL YEAR TENTATIVE BUDGET - City Clerk Ron Conlin presented the
following proposed 2004 -2005 Fiscal Year Budget.
General Fund

City Clerk Conlin stated the General Fund has a negative balance of $51,771 that will
have to be addressed prior to the public hearing on August 20, 2004.
CC Conlin stated at the request of Baseball Commissioner and Animal Control Officer he
is advertizing a raise in registration and animal control fees of more than 5% for the
August 24th, 2004 Council Meeting. Public Hearing notice is attached.

2004 -2005 FISCAL YEAR TENTATIVE BUDGET - (cont.)
Councilman England moved to adopt the 2004 -2005 FY Tentative Budget as presented
with the addition of Police Department Grants of $15,000, Councilman Kearns seconded.
All council members present voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Gunter moved to approve the computer print -out claims as presented,
Councilman Kearns seconded. All council members present voted in favor of motion.
ANNOUNCEMENT - Chubbuck Days Parade and Celebration - August 14"', 2004, Parade starts
at 10:00 a.m.
At 9:45 p.m, Councilman England moved, Councilman Gunter seconded, with full council
approval to adjourn meeting.

Treet frontage and extending west to the Avalon Park development. Bids received are

I would like to request time on a city council meeting agenda in order to present
information regarding the benefits of DOG PARKS on behalf of Bannock Bark
Parks.
Bannock Bark Parks is a local non -profit group that advocates for and conducts
fundraising efforts to establish public, fenced parks where citizens can bring their
dogs to exercise and play off - leash. These parks can offer a recreation
environment safer for people and dogs. Our presentation will introduce the idea
of dog parks to the city council with the intent to open discussion about creating a
dog park in the city of Chubbuck.
