COUNCIL MEETING MINUTES
May 25`h, 2004
Minutes of a regular meeting held at the Chubbuck City Council Chambers, May 25`", 2004.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City
Clerk Ron C. Conlin. Councilman Kent Kearns was excused.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Andrew Hubbard.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to Regular
Meeting Minutes of May l lth, 2004.
Councilman Quick moved to approve Regular Meeting Minutes of May 11 "', 2004 as
read, Councilman Gunter seconded. All council members present voted in favor of
motion.
PUBLIC HEARING - An application by Keith Rasmussen - Rasmussen Properties, 1396
Satterfield Drive, Pocatello, Idaho 83201 for a Planned Unit Development, (PUD)
together with its Preliminary Development Plan. Property is located at Briscoe Road,
adjacent to 159 Belva Lane and 219 Briscoe Road. Property is presently zoned Limited
Residential, (R -2). The Land Use and Development Commission recommended approval.
Mayor Cotant declared the public hearing open.
Keith Rasmussen presented the Rasmussen Planned Unit Development Plan located at
Briscoe Road, adjacent to 159 Belva Lane and 219 Briscoe Road. Mr. Rasmussen stated
he is willing to install speed bumps to help with traffic concerns on Belva Lane. Mr.
Rasmussen felt he has met all requirements of a planned unit development and
recommended the Rasmussen Planned Unit Development be approved.
Ardith Whited, 207 Briscoe said she runs a business from her property and she is
concerned about people, children, etc coming over her fence, getting on their equipment
and someone keeping hurt making her and her husband responsible. Mrs. Whited spoke
against the Rasmussen PUD. Mrs. Whited asked if the proposal is approved that Mr.
Rasmussen be required to install a screening fence along the west and south sides of her
property.

Larry Smith, 133 Briscoe expressed concern about the street right -a -way that goes by
Mrs. Whited's property on the west, it does not meet City Code. Mr. Smith said this
planned unit development is going to create more traffic and the road should be wider.
Mr. Smith spoke against the Rasmussen Planned Unit Development.
Jackie Wallace, 159 Belva Lane stated the hitch on her mobile home is right at Belva
Lane now and expressed concern if Belva Lane is widened it will encroach under her
mobile home. Mrs. Wallace requested Belva Lane not be widened to more than 20'. Mrs.
Wallace spoke against the Rasmussen Planned Unit Development. Mrs. Wallace was in
favor of Belva Lane being a dead end street, instead of going through to Briscoe Road.
Paul Sorensen, 147 Belva Lane suggested that if speed bumps are installed, they be
installed in front of his house, with the speed bumps being installed in the existing part of
Belva Lane. Mr. Sorensen showed where the residents would prefer the speed bumps
installed. Mr. Sorensen stated the residents are in favor of Belva Lane being a dead end
street.
Mayor Cotant declared the public hearing closed.
Mr. Rasmussen showed where the proposed Planned Unit Development parking will be.
Attorney Holmes stated Belva Lane is a street that has developed over the years, there is
some thinking that requiring Belva Lane to go through might make the street safer.
Mayor Cotant suggested the Council adjourn the meeting and go over to look at what is
happening in the area.
Attorney Holmes said the City's Comprehensive Plan shows Briscoe Road as a minor
arterial road.
Discussion about dead ending Belva Lane.
Council tabled the Rasmussen Planned Unit Development and the Preliminary plat until
later in the meeting.
ORDINANCE - Clarifying the interests of a Limited Commercial, (C -1) zoning classification;
amending the Schedule of General Controls for Land Use Districts in Limited
Commercial, (C -1) Districts; amending Section 18.12.020 (C) of the Chubbuck
Municipal Code lessen the required buffer to a residential lot where the nonresidential use
is permitted use in a Limited Commercial, (C -1) zone.

ORDINANCE - (cont.)
Attorney Holmes read ordinance by title only for the second reading.
Council tabled the ordinance until the June 8`'', 2004 Council Meeting.
FINAL SHORT PLAT - LOTS OF CINNAMON SUBDIVISION, LOT 15 AND 16, CLOVER
DELL FARMS - PWD Smart presented the Cinnamon Short Final Plat.
Councilman England moved to approve Lots 15 and 16 of Clover Dell Farms Final Plat
as presented subject to; 1) Restricting access to Lot 5 and Lot 6, 2) Requiring a 15' utility
easement shown on the plat, Councilman Gunter seconded. All council members present
voted in favor of motion.
FINAL SHORT PLAT - HAWTHORNE GROVE CONDOMINIUMS SUBDIVISION - PWD
Smart presented the Hawthorne Grove Condominiums Subdivision Final Plat.
Staff recommended the City exact a little more right -a -way on Hawthorne Road.
Dave Orthel, 799 Leondias stated when he set the building back, he took into
consideration there might be more right -of -way dedication needed on Hawthorne Road.
Councilman Quick moved to approve the Hawthorne Grove Condominiums Subdivision
as presented, subject to 1) The City is going to treat for building code purposes the walls
between 1 and 2 and 2 and 3 as property boundaries, this will required a two hour rated
fire wall. 2. Dedication of T road easement along Hawthorne Road. 3. Require the
showing of an easement access or ingress or egress to the properties to the north so they
can use a common driveway, 4) A 15' utility easement requirement, Councilman England
seconded. All council members present voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Quick moved to approve computer print -out claims as presented,
Councilman Gunter seconded. All council members present voted in favor of motion.
At 8:45 p.m, the Council adjourned the meeting so they could drive to Belva Lane and Briscoe
Road for a review of the area.
At 9:55 p.m, the Council continued the Council Meeting.

RASMUSSEN PROPERTIES PLANNED UNIT DEVELOPMENT TOGETHER WITH ITS
PRELIMINARY DEVELOPMENT PLAN - (cont.) Council wanted to look at the 159 Belva and
219 Briscoe area before making a decision. There were no deliberations or action taken
while the Council reviewed the area.
Attorney Holmes asked Mr. Rasmussen if he would be willing to install a couple of speed
bumps in the existing section of Belva Lane, if he is required. Mr. Rasmussen stated he is
willing to install the speed bumps .
Councilman Gunter moved to accept the Land Use & Development Commission's
recommendation to approve the Rasmussen Properties Planned Unit Development,
(PUD), together with it's Preliminary Development Plan subject to 1) Keith Rasmussen
installing two speed bumps in the existing Belva Lane residential area as indicated by
residents in the area. 2) Keith Rasmussen will install a screening fence on the west side of
Leman and Ardith Whited's property from Briscoe to where Whited's grass ends to the
south, Councilman England seconded. Roll Call Vote: Quick, no; England, yes Gunter,
yes, Kearns, absent. Motion passes.

Councilman England moved to accept the Land Use & Development Commission's
recommendation to approve the Rasmussen Planned Unit Development Subdivision
preliminary plat subject to; 1) Keith Rasmussen installing two speed bumps in the
existing Belva Lane residential area as indicted by residents in the area. 2) Keith
Rasmussen will install a screening fence on the west side of Leman and Ardith Whited's
property from Briscoe to where Whited's grass ends to the south, Councilman Gunter
seconded. Roll Call Vote: Quick, no, England, yes; Gunter, yes; Kearns, absent. Motion
passes.
At 9:30 p.m, Councilman England moved, Councilman Quick seconded, with full council
,appr al adjourn meeting.
