Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to Regular Meeting Minutes of April 13`", 2004. Councilman Kearns moved to approve Regular Meeting Minutes of April 13`x', 2004 as read, Councilman Quick seconded. All council members voted in favor of motion. PUBLIC HEARING - An application by Darris Ellis/Park Meadows, 13560 N. Hawthorne Road, Pocatello, Idaho 83202 for an annexation and zone change from Agricultural, (A) to Planned Unit Development, (PUD). For residential use with subordinate commercial uses; contingent upon requested annexation. Property is located south of Galena and west of Sawtooth. Mayor Cotant declared the public hearing open. Mayor Cotant declared the public hearing closed. Councilman Kearns moved to accept the Land Use and Development Commission's recommendation to approve the application by Darns Ellis for annexation and zone change from Agricultural, (A) to Planned Unit Development for residential use with subordinate commercial uses, contingent upon requested annexation on property located south of Galena and west of Sawtooth, Councilman England seconded. All council members voted in favor of motion. PUBLIC HEARING - An application by Avalon Park Limited Partnership, 4110 Eaton Ave., Suite A, Caldwell, Idaho 83607 for a Planned Unit Development, (PUD), together with its Preliminary Development Plan. The council will also consider the preliminary plat. Property is located at 5200 block, Yellowstone West side. Property is presently zoned Limited Residential, (R -2). Mayor Cotant declared the public hearing open. E'11 COUNCIL MEETING MINUTES - (cont.) April 27`h, 2004 PUBLIC HEARING - APPLICATION BY AVALON PARK LIMITED PARTNERSHIP - (cont.) - Gary Hall, 4110 Eaton Ave, Caldwell, Idaho was present to answer questions about the proposed project. Mr. Hall stated this is an affordable housing project of 54 units. There are nine buildings in the project. PWD Smart showed where the access from the Adam Street Connector will be. PWD Smart stated the Romriell Trust shows to be all one number, the same owners. PWD Smart said that under the State Permit the City is obligated to complete the connection to Adams Street by October, 2006. The City and the Urban Renewal Area are responsible for building the connector to Adams Street, unless a development comes along and the City can exact a portion of the cost. Earl Romriell, 600 Marie feels that his land to the north of the development will be landlocked. Mr. Romriell expressed concern about giving a right -of -way without being able to use it. Mr. Romriell wants another access from Avalon to the west of his property. PWD Smart showed where the Romriell Trust has full access to the Adams Connector. Becky Ponkow, 254 James expressed concern about how affordable the housing is. Mayor Cotant declared the public hearing closed. Councilman Kearns suggested a screening fence be required on the western boundary, (Lucky Street) of the Avalon Park Project. Mr. Hall stated he is aware of the requirement Avalon Partnership is required to screen their western boundary, abutting the residential on Lucky. Discussion about size of trees required in the project. The buildings will have vinyl siding. Mr. Hall stated the Avalon Park Partnership will maintain ownership of the buildings for a long time. Mr. Hall stated this is not a project they will flip. Councilman Gunter moved to approve the application by Avalon Park Partnership for a Planned Unit Development, (PUD) located at 5200 Yellowstone, together with its preliminary development plan along with its preliminary plat, Councilman Kearns seconded. All council members voted in favor of motion. M. COUNCIL MEETING MINUTES - (cont.) April 27', 2004 ORDINANCE #587 - Annexing certain lands to be included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho, specifying the zoning classification which shall be applied to said lands newly annexed to the City of Chubbuck; directing the Chubbuck City Clerk to comply with the filing requirements contained in Idaho Code Section 63 -2215 - Park Meadows 5th Addition. Attorney Holmes read Ordinance #587 in full for the first and final reading. Councilman Kearns moved to dispense with the rule of reading Ordinance #587 on three separate days, Councilman England seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. Councilman Kearns moved to adopt Ordinance #587 as read, Councilman Gunter seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. PROCLAMATION - POPPY DAYS AND POPPY MONTH - Mayor Cotant read the Poppy Days Proclamation in full. Councilman Quick moved to direct Mayor Cotant to proclaim May as Poppy Month, May 7th, and May 8`h, 2004 as Poppy Days, Councilman England seconded. All council members voted in favor of motion. PROCLAMATION - CITY OF CHUBBUCK FOURTH ANNUAL SPRING CLEANUP WEEK Mayor Cotant read the City of Chubbuck Fourth Annual Spring Cleanup Week Proclamation in full. Councilman Kearns moved to direct Mayor Cotant to proclaim May 9`h through May 15`'', 2004 as City of Chubbuck Fourth Annual Spring Cleanup Week, Councilman Quick seconded. All council members voted in favor of motion. PROCLAMATION - MOTORCYCLE AWARENESS MONTH - Mayor Cotant read the Motorcycle Awareness Month Proclamation in full. Councilman Gunter moved to direct Mayor Cotant to proclaim the month of May, 2004 as Motorcycle Awareness Month, Councilman England seconded. All council members voted in favor of motion. COUNCIL MEETING MINUTES - (cont.) April 27h, 2004 PARK MEADOWS SUBDIVISION CONCERNS - Jeff Butikofer, 962 Homerun was present to express some concerns about the Park Meadows Subdivision. 1. Mr. Butikofer asked if residents in the Park Meadows Subdivision are going to see the park plans prior to the park being constructed. 2. Mr. Butikofer asked if City is going to install playground equipment in the proposed park. City ordered playground equipment for the first section today. There will be tables for the shelters. 3. Mr. Butikofer asked if there will be speed bumps by the parks. 4. Mr. Butikofer asked about speed limit signs on Galena. There are a lot of speeders. 5. Mr. Butikofer expressed concern about construction debris being brought onto the City Streets by construction trucks in the subdivision. PWD Smart stated the City is in the process of amending ordinance to enforce builder, developers, etc to take care of the Blowing dust and dirt problems. 6. Concern about dirt and mud running onto the swales. Mayor Cotant stated the City will take care of the concerns. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve computer print -out claims as presented, Councilman Gunter seconded. All council members voted in favor of motion.
