BE IT ORDAINED BY THE CHAIR- I MAN AND THE BOARD OF TRUS- TEES OF THE VILLAGE OF k CHUBBUCK, BANNOCK COUN- TY, IDAHO: Section 1. The term "garbage" as used in this Ordinance is hereby de- fined to be kitchen refuse from resi- dences and all other places where food is prepared for human consump- tion; all animal and vegetable refuse from such kitchen or other place; all offal from fish, meat and vegetable markets and all organic substances of every kind and nature unfit for food and subject to decay. Section 2. The term rubbish" as used in this Ordinance is meant to I include ashes, floor sweepings, empty cans, broken dishes and broken glass ware, Section 3. All garbage as herein defined shall be kept in suitable me- tallic cans or vessels, free from leak- age, and have a tight cover on each of such vessels. All rubbish as herein defined shall be kept in containers to avoid same being scattered about. Containers holding such garbage or. rubbish shall be placed at the rear'', of the building or lot on which the same bas been accumulated. The owner, agent or occupant of each building or residence is hereby required to remove such garbage and refuse from the premises and from; the Village of Chubbuck as often as may be necessary to prevent the same from creating offensive odors or wt-. healthful conditions, or unsightly to the sight. Section 4. Eacli owner, agent or' occupant of any building or residence # desiring to dump such garbage or rubbish at the dumping ground i owned by Scardino, easterl•Y of the Village, shall first secure a permit from the Village to dump such gar- bage or rubbish on said Scardino propetty; that such permit shall be issued to any applicant, upon the applicant paying an annual fee of $2.00, payable for the fiscal year or any part or portion thereof:. Section S. It shall be unlawful for any owner, occupant or agent of any property to keep such garbage or rubbish on the premises owned or .' occupied by him, in violation of the terms of this Ordinance. It shall be unlawful i'or any own- er, agent or occupant of ally proper- ty to dump such garbage or rubbish on said property owned by Scardino easterly of the Village, without first obtaining a license or permit there» j tor, and paying the ferequired by te his Ordinahce to the Village of Chub - buck, Section 6- Any person, firm or cor- poration vinlating any of the. provi- sions of this Ordinance shall be deemed guilty of a misdemeanor and on conviction thereof shall be fined { Pot exceeding S100.00 and casts. Section 7. All ordinances and parts Of ordinances in so far as they are I in conflict with this Ordinance shall, and the same are hereby, repealed. Section S. This Ordinance shall take effect and be in full force and . effect from and after its passage, ap- proval and due publication as pro- vided by law.
