ORDINANCE NO. 6
AN ORDINANCE PROVIDING FOR
THE LICENSING OF THE SALE AND
DISTRIBUTION OF BEER, PROVID-
ING AN APPLICATION FORM; PRO-
VIDING THAT A LICENSE BE RE-
QUIRED OF ANY RETAILER; PRO-
VIDING AN ANNUAL LICENSE
FEE; PROVIDING CONDITIONS FOR
THE ISSUANCE OF A LICENSE;
PROVIDING FOR THE REVOCA-
TION OF A LICENSE; AND PRO-
VIDING AN EMERGENCY CLAUSE;
AND REPEALING ALL OTHER OR-
DIANCES OR PARTS OF ORDI-
NANCES INSOFAR AS THEY ARE
IN CONFLICT WITH THIS ORDI-
NANCE.
BE IT ORDAINED BY THE CHAIR-
MAN AND BOARD OF TRUSTEES
OF THE VILLAGE OF CHUBBUCK,
BANNOCK COUNTY, STATE OF
IDAHO:
SECTION 1,: No retailer shall sell,
lend, deal in or dispose of, by gilt,
sale or otherwise, or keep or offer
for sale, beer as defined in this Or-
dinance, withih the Village of Chub -
buck, without first having a license
therefor as hereinafter provided.
SECTION 2. All applications for li-
cense to sell beer as a retailer shall
be made on forms to be supplied by
the village setting forth the name of
the person asking for such license, his
age, representations as to his charac-
ter as may be required, his Citizen-
ship, the location which such busi-
ness is to be carried on, the business
I n connection with which the proposed
licensee will operate, whether the ap-
plicant is owner and operator of said
business, time such applicant has
been in that business at that place,
and such other information as the
governing body may require from time
to time.
SECTION 3. All applications for re-
tailers beer license shall be accom-
panied by a receipt from the Village
Clerk for the required annual fee
for the license, and such fee shall
be paid into the general fund of the
Village; upon rejection of any appli-
cation for retailers ,beer license, the
Treasurer shall refund the amount.
The annual fee for a retailers beer
license to sell beer within the vill-
age of Chubbuck,Idaho, shall be
$25.00, 9
SECTION 4. All Iicenses granted
hereunder shall be granted subject to
the following conditions, and all oth-
er conditions of this ordinance, and
subject to all other ordinances of the
Village applicable thereto.
No license shall be granted to any
person under twenty -ane years of
age.
No license shall be granted to any
person who has been convicted of a
felony or of violating the' National
Prohibition Act or any law of this
State or local ordinance relating to
manufacturing or transportation of in-
toxicating liquors.
No license shall be granted for the
sale oh any premises where the li-
censee has been convicted of the vio-
lation of this ordinauee or where ally

license hereunder has been revoke
forcause fez- at least one year after

the said conviction or revocation.
No sale of beer as defined in this
ordinance shall he made to any per-
son under guardianshin. 1101, to any
Person under twenty ,years of age.
All premises where any license
hereunder is granted shall be open
tO inspection by any -police or health
officer, or other properly designated
officer or employee of the Village, at
any time during which the place so
granted is open to the public for
business.
All licenses granted under this or-
dinance shall be issued to the appli-
cant only and shall be issued for the
premises described in the application.
Such license shall not be transferred
to another place without the approval
of the Board of Trustees.
Retailer's beer Iicenses shall expire
On the lest day of May of each year.

America, more than 21 years of age, and the Principal Clerk of THE
IDAHO STATE JOURNAL, a daily newspaper, printed and published at
Pocatello, Bannock County, Idaho, and having a general circulation
therein.
That the document or notice, a true copy of which is attached, was
published in the said IDAHO STATE JOURNAL, on the following dates,

That said paper has been continuously and uninterruptedly pub-
lished in said County for a period of seventy-eight weeks prior to the
publication of said notice or advertisement and is a newspaper within
the meaning of the laws of Idaho.
