ORDINANCE NO, 6
AN ORDINANCE PROVIDING FOR
THE LICENSING OF THE SALE
AND DISTRIBUTION OF BEER;
P R O V I D I N G AN APPLICATION
FORM; PROVIDING THAT A LI-
CENSE BE REQUIRED OF ANY RE-
TAILER: PROVIDING AN ANNUAL
LICENSE FEE; PROVIDING CON-
DITIONS FOR. THE ISSUANCE OF
A LICENSE; PROVIDING FOR THE
REVOCATION OF A LICENSE; AND
PROVIDING AN EMERGENCY
CLAUSE; AND REPEALING ALL
OTHER ORDINANCES OR PARTS
OF ORDINANCES INSOFAR AS
THEY ARE IN CONFLICT WITH
THIS ORDINANCE.
BE IT ORDAINED BY THE CHAIR-
MAN AND 130ARD OF TRUSTEES OF
THE VILLAGE OF CHUBBUCK, BAN -
NOCK COUNTY, -STATE OF IDAHO:
SECTION 1, No retailer shalt sell,
lend, deal in or dispose of, by gift,
sale or otherwise, or keep or offer
for sale, beer as defined in this Ordi-
nance, within the Village of Chub -
buck, without first having a license
therefor as hereinafter provided.
SECTION 2. All applications for li-
cense to sell beer as a retailer shall
be made on forms to be supplied by
the tillage setting forth the name of
the person asking for such license, his
age, representations as to his charac-
ter as may be required, his citizenship,
the location which such business is to
be carried on, the business in con-
nection with which the proposed li-
censee will operate, whether the ap-
plicant is owner and operator of said
business, time such applicant has been
that business at that place, and such
other information as the governing
body may require from time to time.
SECTION 3. All applications for re-
tailers beer heense _ shall be accom-
panied by a receipt from the Village
Clerk for the required annual fee for
the license, and such fee shall be
paid into the general fund, of the Vil-
lage; upon rejection of any applica-
tion for retailers beer license, the
Treasurer shall refund the amomnt.
The annual fee for a retailers beer
license to sell beer within the Village
of Chubbuok, Idaho shall be $25.00.
SECTION 4. All licenses granted
hereunder shall be granted subject to
the following conditions, and all other
conditions of this ordinance, and sub-
ject to all other ordinances of the Vil-
lage applicable thereto.
No license shall be granted to any
person under twenty-one years of age.
No license shall be granted to any
person who has been convicted of a
felony or of violating the National
Prohibition Act or any Jaw of this
State or local ordinance relating to
manufacturing or transportation of in-
toxicating liquors.
No license shall be granted for the
sale on any premises where the li-
censee has been convicted of the viola-
tion of this ordinance or where any
license hereunder has been revoked
for cause for at least one year after
the said conviction or revocation.
No sale of beer as defined in this
ordinance shall be made to any person
under guardianship, nor to any person
under eighteen years of age.
Ali premises where any license here -
tinder is granted shall be open to in-
spection by any police or health offi-
cer, or other properly designated offi-
cer or employee of the Village, at any
time during which the place so grant-
ed is open to the public for business.
All licenses granted under this ordi-
nance shall be issued to the applicant
only and shall be issued for the
premises described in the application.
Such license shall not be transferred
to another place without the approval
of the Board of Trustees,
Retailer's beer licenses shall expire
on the last day of May of each year.
SECTION 5, Any license granted
hereunder may be revoked by the
Board of Trustees without notice to
the grantee or a hearing may first be
held by the Board and the revocation
then made for cause. Any vioiat.ic i cf

being first duly sworn on oath deposes and says: That -------- she --------------
was at all times herein mentioned a citizen of the United States of
America, more than 21 years of age, and the Principal Cleric of THE
IDAHO STATE JOURNAL, a daily newspaper, printed and published at
Pocatello, Bannock County, Idaho, and having a general circulation
therein.
That the document or notice, a true copy of which is attached, was
published in the said IDAHO STATE JOURNAL, on the following dates,

That said paper has been continuously and uninterruptedly pub-
lished in said County for a period of seventy-eight weeks prior to the
publication of said notice or advertisement and is a newspaper within
the mea' f the laws of Idaho.
