ORDINANCE NO. 156
AN ORDINANCE OF THE
CITY OF CHUBBUCK, IDAHO,
PROVIDING FC+R' CERTAIN
LANDS KNOW, AS THE
BOHRER TRUSI, PROPERTY
WITHIN THE BOUNDARIES OF
THE CITY OF CHUBBUCK BE
REZONED AND CHANGED
FROM MULTIPLE-I=AMILY
RESIDENTIAL -LIVESTOCK (R.
3L) TO COMMERCIAL
GENERAL (C-3); AND
PROVIDING WHEN THIS OR-
DINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE
MAYOR AND COUNCIL OF THE
CITY OF CHUBBUCK, IDAHO:
SECTION 1: Re- Zoning. The
following described lands known
as the Bohrer trust property
within the boundaries of the City
of Chubbuck, Idaho, are hereby
re -zoned to change from Multiple.
Family Residentiai-_Livestock (R
3L)to Commercial General (C-3):
A tract of land in the SWI,4 of
Section 10, Township 6 South,
Range 34E., B.M„ Bannock
County, Idaho, more particularly
described as follows:
Commencing at the south
quarter corner of Section 10,
Township 6 South, Range 34 E.,
B.M., thence south 89 degrees 36'
west 0.7 feet, more or less, to
the westerly right of way of Pole
Line Road; thence north 1 degree
17' east, along said right of way of
Pole Line Road, 625 feet to the
true point of beginning; thence
south 89 degrees 36' west, 633.92
feet; thence south 44 degrees 38'
west, 472.5 feet, more or less, to
the center l(ne of U.S. Govern
ment Lateral (Fort Hall Project—
O'Leary Lateral "X"); thence
north 53 degrees 55' west along
said lateral center line 1269 feet,
more or less, to the west boundary
of the east halt of the SW1f4 SW',t
of the said Section 10; thence
north 0 degrees 43' west 283.8 feet,
more or less, to the northwest
corner of the said east half of the
SWb4 SWI/4; thence north 89
degrees 15' east along the north '
line of the said SW114 SW1a, 658
feet, more or less, to the south-
west one sixteenth corner of the
said Section 10; thence north 0
degrees 01' east, along the west
one sixteenth line of the said
Section 10, 1-159 feet, more or less,
to the southerly right of way of
Interstate Highway I.15W; thence
south 80 degrees 32'11" east,
261.91 feet; thence south 38
degrees 22' east 828.47 feet:
thence south 44 degrees 54' east,
335.1 feet thence south 88 degrees
47' east, 280.3 feet, more or less, to
the westerly right of way line of
the Yellowstone Park Highway;
thence southwesterly along the
said Yellowstone Park Highway
right of way 922.1 feet, more or
Less, to the point ofbeginning,
SECTION 2: Effective Date.
The rule requiring ordinances to
be read on three separate dates is
hereby dispensed with, and this
ordinance shall become effective
upon its approval and publication
as provided by law.
PASSED BY THE COUNCIL
AND APPROVED BY THE
being first duly sworn on oath deposes and says: That ------- She
was at all times herein mentioned a citizen of the United States of
America, more than 21 years of age, and the Principal Cleric of THE
IDAHO STATE JOURNAL, a daily newspaper, printed and published at
Pocatello, Bannock County, Idaho, and having a general circulation
therein.
That the document or notice, a true copy of which is attached, was
published in the said IDAHO STATE JOURNAL, on the following dates,
