ORDINANCE NO. 142
AN ORDINANCE OF THE CITY
OF CHUBBUCK, IDAHO,
AMENDING SECTION 3 (C)OF
ORDINANCE NO. 129 OF THE
CITY OF CHUBBUCK, IDAHO,
TO SPECIFY THAT DEPOSITS
HELD IN THE "SEWER SER-
VICE DEPOSIT FUND" SHALL
BE REFUNDED WHEN A
SATISFACTORY PAYMENT
RECORD HAS BEEN
ESTABLISHED OR WHEN
OWNERSHIP OR OCCUPANCY
OF THE LOT, PROPERTY,
BUILDING OR RESIDENCE IN
QUESTION HAS BEEN
DISCONTINUED, WHATEVER
OCCURS FIRST; AND
PROVIDING WHEN THIS OR-
DINANCE SHALL. BECOME
EFFECTIVE.
BE IT ORDAINED BY THE
MAYOR AND COUNCIL OF THE
CITY OF CHUBBUCK, IDAHO:
SECTION 1: That Section 3(C)
of Ordinance No. 129 of the City of
Chubbuck, Idaho, passed and
approved on the 11th day of
December, 1973, is hereby
amended as follows:
C. Deposits. At the time of
application for sewer service or of
application for restoration of
terminated sewer service, the
owner or occupant of any lot,
property, building or residence
who will receive and pay for
sewer service from the city, but
who does not subscribe and pay
for water furnished by the
Municipal Water System, shall
deposit with the City Clerk three
tunes the applicable monthly
service charge, or $30.00,
whichever is greater, for each lot,
property, building or residence
connected to the sewer system, in
order to guarantee the payment of
monthly sewer system charges.
All deposits shall be held in a fund
known as the "Sewer Service
Deposit Fund," and shali be
retained in said fund until the
owner or occupant shall have
established a satisfactory
payment record by making six (6)
full and timely successive
monthly payments of sewer
charges, or until the owner or
occupant shall have discontinued
the ownership cr occupancy of
such lot, property, building or
residence, whichever occurs first.
Thedeposit shall not bear interest
payable to the depositor while
being held in the "Sewer Service
Deposit Fund."
SECTION 2: That the rule
requiring ordinances to be read on
three separate days is hereby
dispensed with, and this or-
dinance shall become effective
upon its approval and publication
as provided by law.

That said paper has been continuously and uninterruptedly pub-
lished in said County for a period of seventy-eight weeks prior to the
publication of said notice or advertisement and is a newspaper within
the meaning of the laws of Idaho.
