SUMMARY OF LAND
IMPROVEMENT STANDARDS
ORDINANCE
NOTICE IS HEREBY GIVEN
that the Chubbuck City Council
has passed, and the Mayor has
approved, Chubbuck City Ordi-
nance No. 207, which shall be
known and cited as the "Chub -
buck Land Improvement. Stan-
dards
tamdards Ordinance." The ordinance
becomes effective upon publica-
tion of this summary in the Ida-
ho State Journal, the official
newspaper of the City,
The ordinance establishes engi-
neering standards for the design,
installation, alteration, or repair
Of improvement to land. I1 pre-
scribes criteria for design of
streets and layout of lots and
blocks, It regulates landscaping
and the design and location of
utilities, sanitary sewer, water
and storm drainage systems.
The ordinance sets forth stan.
dards with respect to work prac-
tices, materials used and test
and performance data for streets,
curbs, gutters, sidewalks, drive-
ways, sanitary sewers, storm
sewers, water mains and service
lines.
The ordinance further provides
environmental protection and
safety standards for construction
sites, It regulates hours of opera-
tion, dust and materials control,
and practices relating to slopes,
cuts, fills, drainage and compac-
tion. It provides for erosion con-
trol and landscaping. it authoriz-
es the City Engineer to require
special precautions to prevent
property damage from excavation
or grading and to alleviate
weather-related hazards. It also
empowers the City Engineer to
commence legal process to stop
work on projects where public fa-
cilities are exposed to potential
damage or where topographical
characteristics require special de-
sign and construction methods.
The ordinance provides for aug-
mentation of standards in any of
the foregoing areas by the City
Engineer, consistent with applica-
ble national codes, when made
necessary by multistory struc-
tures,
truttures, heavy density of develop-
ment or other special conditions.
It authorizes the City Engineer to
monitor compliance, to conduct
inspections and to recommend a
reasonable fee schedulefor adop-
tion by the City Council. It speci-
fies that the developer, builder
and their agents are responsible
for compliance with this ordi-
nance.
The ordinance provides for en-
forcement and relief from its
standards by incorporating proce-
dures set forth in the Uniform
Building Code (UBC). The UBC,
in turn, provides civil injunctive
and/or abatement remedies for
noncompliance, and this ordi.
nance authorizes imposition of
costs and legal fees upon non-
complying developers or builders
in such cases. The UBC permits
developers or builders to apply
for modifications or standards, or
for approval of alternate materi-

being first duly sworn on oath deposes and says: That--.._,,.
was at all times herein mentioned a citizen of the United States of
America, more than 21 years of age, and the Principal Clerlc of THE
IDAHO STATE JOURNAL, a daily newspaper, printed and published at
Pocatello, Bannock County, Idaho, and having a general circulation
therein.
That the document or notice, a true copy of which is attached, was
published in the said IDAHO STATE JOURNAL, on the following dates,

That said paper has been continuously and uninterruptedly pub-
lished in said County for a period of seventy-eight weeks prior to the
publication of said notice or advertisement and is a newspaper within
the meaning of the laws of Idaho.
