County of Bannock ORDINANCE NO. 223 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PRO- VIDING FOR CERTAIN LAND AND PROPERTY WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK PRESENTLY OWNED BY SCOTT A. BIRD AND JANE L. BIRD, HUSBAND AND WIFE, TO BE REZONED AND CHANGED FROM GENER- AL RESIDENTIAL (R-2) TO IN- DUSTRIAL (U IN THE ENTIRE- TY; DECLARING THAT THE CITY COUNCIL FINDS SUCH REZONING CONSISTENT WITH THE LAND USE PAT TERN PRESCRIBED IN THE CITY'S COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE SHALL BE- COME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SE=CTION 1: Rezoning. The fol- lowing described lands or proper- ty within the boundaries of the City of Chubbuck, Idaho, present- ly owned by Scott A. Bird and Jane L. Bird, husband and wife, are hereby re -zoned from general residential (R-21 to industrial (I): Beginning at a point of the East 1/16 line of Section 10, Township 6 South, Range 34 East, Boise Me- ridian, which point is the South- west corner of the Southeast Quarter Northeast Quarter of said Section 10, thence North 00 11' East along the said East 1/16 line a distance of 164 feet; thence South 890 49' East 545.39 feet, more or less, to the Westerly boundary of the right of way of the Union Pacific Railroad; thence South 70 46' East along said right of way boundary 165.59 feet; thence North 890 49' West 568.29 feet, more or less to the point of beginning, Bannock County, ldaho. SECTION 2: Comprehensive Plan, The Mayor and Council find, and therefore declare, that the foregoing changes in zoning are consistent with the land use pattern prescribed by the City Comprehensive Plan. SECTION 3: Effective Date. Full, public hearings having been con- ducted in this matter, the rule requiring ordinances to be read on three separate occasions is hereby dispensed with and this Ordinance shall become effective upon its passage, approval and publication provided by law.
