ORDINANCE NO. 217
AN ORDINANCE OF THE CITY
OF CHUBSUCK, IDAHO,
AMENDING ORDINCANCE NO.
127 OF THE CITY OF CHUB -
BUCK, IDAHO, ENACTED ON
THE 9TH DAY OF OCTOBER,
1973, BY ADDING THERETO
SECTION 3A, TO BE INSERTED
FOLLOWING THE EXISTING
SECTION 3, PROVIDING EX-
EMPTIONS FROM COMPLI-
ANCE WITH THE FOREGOING
REQUIREMENTS OF SAID OR
DINANCE; AND PROVIDING
WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE,
BE IT ORDAINED BY THE
MAYOR AND COUNCIL OF THE

CtTY OF CHUBBUCJC, IDAHO:
SECTION 1: Amendment. Ordi-
nance No. 127 of the City of
Chubbuck, Idaho, enacted on the
9th day of October, 1973, requir•
ing construction bonds within the
city, is hereby amended by
adding thereto Section 3A,%to be
inserted following the existing
Section 3 of said odinance as
fol lows:
"SECTION 3A. Exemption. The
foregoing bond requirement shall
not apply to the owners of im.
proved properties who personally
install curbs, gutters or sidewalks
along city streets or easements
joining or crossing their proper-
ties. Provided, that in order to
qualify for this exemption, said
owners shall prepay any city
inspection fees and execute writ•
ten agreements holding the city
harmless and indemnifying the
city from any claims or losses
arising from such work. The
agreement shall further obligate
said owners to cause the work to
be performed In accordance with
city standards, and shall author-
ize the city to remove, and re-
quire said owners forthwith to
replace at their expense, any
nonconforming curbs, gutters or
sidewalks."
SECT3ON 2: Effective Date. This
Ordinance shall become effective
upon its passage, approval and
publication as provided by law.

published in the said IDAHO STATE JOURNAL, on the following dates,

That said paper has been continuously and uninterruptedly published
in said County for a period of seventy-eight weeks prior to the publication
of said notice or advertisement and is a newspaper within the meaning
