County of Bannock ORDINANCE NO. 212 CITY OF CHUBBUCK, IDAHO AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AN- NEXING CERTAIN LANDS KNOWN AS THE HERITAGE WEST SUBDIVISIONS TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDIC- TIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECI- FYING THE ZONING CLASSIFI- CATIONS WHICH SHALL BE APPLIED TO SAID LANDS; DI- RECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH FILING REQUIREMENTS CONTAINED IN IDAHO CODE 63-2215; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OFCHUBBUCI_, IDAHO: SECTION 1: Annexation. The fol- lowing described lands, located within Bannock Counfy and con- tiguous to the existing boundaries of the City of Chubbuck, Idaho, are hereby annexed and included within the boundaries and juris- dictional limits of the City of Chubbuck, Idaho: A parcel of land being a portion of the E 1/2 of the SW 1/4 of Section 4, T,65., R. 34E., B.M., Bannock County, Idaho and more particu- larly described as follows: Begin- ning at a point marking the Southwest corner of the said SW '/4of Section 4: thence South 890 59' 04" East 1,329.95 feet along the Southerly boundary of the said SW +/4 of Section 4, which is also the centerline of Chubbuck Road, to an iron pin, also said point being the REAL POINT OF BEGINNING; thence continuing South 890 51' 04" East 803.16 feet along the said Southerly bounda- ry of the SW 1/4 of Section 4 to an iron pin; thence North 00 13' 40" West (formerly described as North 00 13' 38" West) 2,654.55 feet along the extended Westerly boundary and the Westerly boundary of Alfuras Park, a sub- division, as filed for record in the office of the Bannock County Re- corder, Pocatello, Idaho, in Book 9 of Plats at page 45, to an iron pin marking the Northwest cor- ner of the said Alturas Park; thence south 890 55' 56" West 811.61 feet along the Northerly boundary of the said SW 114 of Section 4 to an iron pin; thence South Od 241 38" East 2,651.55 feet to the point of beginning, com- prising 49.17 Acres, more or less. SECTION 2: Zoning. The above- described lands, newly annexed to the City of Chubbuck, Idaho, shall be subject to the zoning classification of Limited Residen- tial (R-1), except Lots 1 and 2 of Block 1, Lots 1, 2, 3, 4, 5, 6, 7 and 8 of Block 2, and Lots i and 2 of Block 4, of the proposed Heritage West No. 1 Subdivision, which shall be subject to the zoning classifications of General Resi- dential (R-2). The City Council finds and declares that such clas- sifications are consistent with the City Comprehensive Plan. SECTION 3: Filing. That the document or notice, a true copy of which is attached, was published in the said IDAHO STATE JOURNAL, on the following dates, to -wit: April 6 , 1930 19 19 -, 19 , 19 . 19 19_ _.._ , 19 That said paper has been continuously and uninterruptedly published in said County for a period of seventy-eight weeks prior to the publication of said notice or advertisement and is a newspaper within the meaning of the laws of Idaho.
