ORDINANCE NO. 260
CITY OF CHUBBUCK, IDAHO
AN ORDINANCE OF THE CITY OF
CHUBBUCK, IDAHO, AMENDING OR-
DINANCE NO, 60 OF THE CITY OF
CHUBBUCK, IDAHO, TO PROVIDE
THAT ALL GARBAGE WASTES COL-
LECTED BY THE CITY SHALL BE
PLACED IN APPROVED DISPOSAL
PLASTIC OR PAPER CONTAINERS OR
IN APPROVED MECHANICALLY
DUMPED CONTAINERS; REPEALING
ALL PRIOR ORDINANCES IN CON-
FLICT WITH T1415 ORDINANCE; PRO-
VIDING FOR SEVERABILITY OF THE
PROVISIONS OF THIS ORDINANCE;
AND PROVIDING WHEN THIS ORDI-
NANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR
AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
'SECTION 1. Definition of approved san(-
tary Containers. Ordinance No. 60 of the
City of Chubbuck, Idaho, enacted on the
10th day of March, 1964, is hereby amend-
ed by repealing in their eitireties Sections
3 and 4 thereof and by the addition of new
Sections 3 and 4 to read as follows:
3: DEFINITION: "Sanitary containers"
as the term is used in this Ordinance,
means approved sanitary containers or
receptacles which may be any of the
following:
(a) Disposable (nonreturnable) paper re-
fuse containers as approved, which shall
be 50 -pound wet -strength extensible Kraft
paper of not less than 20 -gallon capacity
nor more than 32 -gallon capacity;
(b) Disposable (nonreturnable) plastic
bags of not less than 20 -gallon capacity
nor more than 32 -gallon capacity, which
shall be manufactured for -n polyethylene
or ethylene copolymer resin, with a
gauge of not less than one and five -tenths
Mil or the one and five tenths mil bag as
furnished and/or made available through
the City;
(c) Sanitary containers, receptacles or
bundles provided for in Subsections (b)
and (d) of Section 17 of this Ordinance;
(d) Approved mechanically dumped con-
tainers of one yard or more capacity;
approval of size and type shall be ob-
tained from the Director of P,lblic Works.
The paper containers or plastic bags
referred to in Subsections (a) and (b)
herein may be used as finers in cans, but
such containers or bags used as liners
shall be removed from the cans, tied
securely with the wire tie as furnished,
or, in the case of paper Containers, the
top securely rolled, and placed in the
proper location for pickup on the sched.

4: SEPARATION OF REFUSE: All kitch-
en garbage shall be drained of excess
water and shall be wrapped in paper in
any animal defecation shall be separately
wrapped in paper before being placed in
the nonreturnable sanitary container. Tin
cans and glass containers may be placed
in the sanitary container with kitchen
garbage.
SECTION 2. Garbage, Trash and Other
Refuse From Private Property. Said Or-
dinance No. 60 is further amended by
repealing in its entirety Section 17 thereof
and by the addition of a new Section 17 to
read as follows:
17: GARBAGE, TRASH AND OTHER
REFUSE FROM PRIVATE PROPER-
TY: All garbage, refuse and rubbish,
except ashes, in or about any private
residence, dwelling, house or other build-
ing shall be placed in approved sanitary
containers and shall be placed at or near
the street line so as to be easily seen.
Approved nonreturnable sanitary contain-
ers may be placed at or near the public
right-of-way in areas approved by the

was at all times herein mentioned a citizen of the United States of Ameri-
ca, more than 21 years of age, and the Principal Clerk of THE IDAHO
STATE JOURNAL, a daily newspaper, printed and published at Pocatello,
Bannock County, Idaho, and having a general circulation therein.
That the document or notice, a true copy of which is attached, was
published in the said IDAHO STATE JOURNAL, on the following dates,
to -wit:

That said paper has been continuously and uninterruptedly published
in said County for a period of seventy-eight weeks prior to the publication
of said notice or advertisement and is a newspaper within the meaning
of the laws of Idaho. r
