HomeMy WebLinkAbout06 11 1985 Ord. 270PROOF OF PUBLICAi ION STATE OF IDAHO ss County of Bannock CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 270 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR A CHANGE IN THE LAND USE DIS- TRICT WITH RESPECT TO CERTAIN LANDS LOCATED IN SECTION 11, TOWNSHIP 6 SOUTH, RANGE 34 E.B.M., WITHIN THE BOUNDARIES OF —THE CITY OF CHUBBUCK, IDAHO, FROM AGRICULTURAL (A) TO LIMIT- ED RESIDENTIAL (R-1) AND GENER- AL RESIDENTIAL (R-2); DECLARING THAT THE CITY COUNCIL FIND SUCH RE -ZONING CONSISTENT WITH THE LAND USE PATTERN PRESCRIBED IN THE CITY'S COMPREHENSIVE PLAN; REPEALING PRIOR CONFLICTING ORDINANCES; AND PROVIDING -WHEN THIS ORDINANCE SHALL BE- COME EFFECTIVE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: Change of Land Use District to Limited Residential (R-1), The Land Use District established by the Chubbuck Land Use Ordinance, Ordinance No. 241, with respect to the lands described below, located within the boundaries of the City of Chubbuck, is hereby changed from Agricultural (A) to Limited Residential (R-1).: See Exhibit A which is attached hereto and incoropated herein by reference as though set forth in full hereinafter. SECTION 2: Change Of Land Use District to General Residential (R 2). The Land Use District established by the Chubbuck Land Use Ordinance, Ordinance No. 241, with respect to the lands described below, located within the boundaries of the City Df Chubbuck, is hereby changed from Agricultural (A) to General Residential (R-2): See Exhibit B which is attached hereto end incorporated herein by reference as hough set forth in full hereinafter. SECTION 3: Comprehensive Plan. The 'Aayor and Council find, and therefore declare, that the foregoing changes in the Land Use District, are consistent with the land use pattern prescribed by the City's Comprehensive Plan. SECTION 4: Repeal of Conflicting Ordi- nances. All prior ordinances or provisions thereof which conflict with this ordi- nances are hereby repealed to the extent of such conflict. SECTION 5: Severability. if any section or provision of this ordinance is held invalid by any court of competent juris- diction, such holding shall not affect the validity of the remaining sections or provisions. SECTION 6: Effective Date. Full public hearings having been conducted in this matter in accordance with all applicabel requirements under state and local law, the rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
