ORDINANCE NO. 276
AN ORDINANCE ADOPTING THE CITY
CODE OF CHUBBUCK, IDAHO; RE-
PEALING THE CONFLICTING PROVI-
SIONS OF ANY PRIOR ORDINANCE TO
THE EXTENT OF SUCH CONFLICT;
PROVIDING FOR THE SEVERABILITY
OF THIS ORDINANCE; AND PROVID-
ING WHEN TIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR
AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO, AN IDAHO hAU-
NICiPAL CORPORATION:
SECTION 1: Acceptance of Codification
as Law of the City. From and atter the
date of passage of this ordinance, tho City
Code of the City of Chubbuck, Idaho,
containing the compilation of ordinances
of the general nature together with the,
changes made to said ordinances under
the direction of the governing body of the
City shall be accepted in all courts
without question as the official code and
law of the City as enacted by the Mayor
and City Council.
SECTION 2: Method of Supplementatlon;
Designation of Depositary. There is here
by adopted as a method of perpetual
codification the looseleaf type of binding
together with continuous supplementation
whereby each newly adopted ordinance of
a general and permanent nature amend-
ing, altering, adding or deleting provi-
sions of the official city code is identified
by the proper catchline and inserted in
the proper place in each of the official
copies, three (3) copies of which shall be
maintained in the office of the City Clerk
certified as to correctness and available
for inspection at any and all times that
said office is regularly opened.
SECTION 3: Continued Effect of Pre
Existing Ordinances. All ordinances of a
general nature included in this official
city code shall be considered ps a contin.
uation of said ordinance provision and the
fact that some provisions have been
deliberated elimanated by the governing
body shall not serve to cause any inter-
ruption in the continuous effectiveness of
ordinances included in said official city
code. Ali ordinances of a special nature
such as tax levy ordinances, bond ordi-
nances, franchises, vacating ordinances,
and annexation ordinances shall continue
in full force and effect unless specifcally
repealed or amended by a provision of
the city code. Such ordinances are not
intended to be included in the official city
code.
SECTION 4: Unlawful Modification. It
shall be unlawful for any person, firm or
corporation to change or amend by addi
tions or deletions any part or portion of
such code or to insert or delete pages or
portions thereof or to alter or tamper
with such code in any manner whatsoever
which shall cause the law of the city to be
misrepresented thereby. Any person,
firm or corporation violating this section
shall be punished as provided in Section
1.u.o10 of the City Code of Chubbuck,
Idaho.
SECTION 5: Repeal. All ordinances or
parts of ordinances in conflict herewith
are to the extent of su�h conflict hereby
repealed.
SECTION 6: Severability. If any section,
paragraph, clause or provision of this
ordinance shall be held invalid by any
court of competent jurisdiction, for any
reason, such holding shall not affect the
validity or enforceability of any remain-
ing provision thereof.
SECTION 7: Effective Date. The rule
requiring an ordinance to be read on
three separate days is hereby dispensed

was at all times herein mentioned a citizen of the United States of Ameri-
ca, more than 21 years of age, and the Principal Clerk of THE IDAHO
STATE JOURNAL, a daily newspaper, printed and published at Pocatello,
Bannock County, Idaho, and having a general circulation therein.
That the document or notice, a true copy of which is attached, was
published in the said IDAHO STATE JOURNAL, on the following dates,
to -wit:

That said paper has been continuously and uninterruptedly published
in said County for a period of seventy-eight weeks prior to the publication
of said notice or advertisement and is a newspaper within the meaning
of the laws ofrld'aho.
