County of Bannock CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 320 - AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING A CONDITIONAL USE PERMIT Is ISSUED TO AN APPLICANT; COR- RECTING TECHNICAL DRAFT- ING ERRORS; REPEALING PRIOR CONFLICTING ORDI- NANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVI- SIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18.28 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDI- NANCE SHALL BECOME EFFEC- TIVE. BE IT ORDAINED BY THE MAY- OR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Section 18.28.040 (A) of the Chubbuck Code is amended to read. 18.28.040 Conditional use permits. A. Duration, assignability and review. A conditional use permit is issued to the Applicant authorizing applicant to use the property for the use specified in the permit and subject to any conditions imposed upon the use. Unless otherwise specified by the land use development commis - Sion when granting, renewing or modifying a conditional use permit, such permit shall be nonassignable and nontransferable and shall expire in three years if the applicant fails to implement the use for which such Permit is sought. A conditional use Permit shall expire upon the viola- tion of any conditions imposed by the Land Use Development Commis- sion upon the approval of a condi- tional use permit. The commission may, as a condition imposed upon a conditional use permit granted her- eunder, require that the applicant report to the commission on a subse- quent date or dates as to the imple- mentation of the use for which the permit is sough and as to the applicant's compliance or noncom- pliance with conditions imposed by the commission.
