HomeMy WebLinkAbout04 26 1989 Ord. 317is PROOF OF PUBLICATION STATE OF IDAHO County of Bannock ORDINANCE NO. 317 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING CHAPTER 9.12 CHUBBUCK CODE TO PROVIDE WHEN AN UN - SCREENED STORAGE AREA CONSTITUTES A NUISANCE, TO PROVIDE FOR OTHER NUI- SANCES; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERA- BILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 9.12 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAY- OR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Section 9.12.010(5) of the Chubbuck Code shall be amended to read as follows: 5. Any junk items or reclaimed items kept adjacent or in close proximity to private grounds of an- other, pedestrian or vehicular thor- oughfares, or premises open to the public, unless such items are en- closed within a solid structure or other sufficient visual screen; "junk items" includes, without limitation, abandoned or inoperative motor ve- hicles, abandoned or reclaimed mo- bile homes, trailers or production dwellings, inoperative appliances or fixtures, dismantled or discarded furniture or equipment, scrap metal or lumber, ropes, rubber, glass, rags, paper or bagging, and other salvage or refuse articles. Section 2. A new section 9.12.010(8) shall be added to the Chubbuck Code to read as follows: 8. Any other condition of property or act upon property which is injurious to the health, safety, or welfare of individuals, or is offensive to the senses of individuals, or is an ob- struction of the free use of property, so as to interfere with the comforta- ble enjoyment of life or property.
