County of Bannock ORDINANCE NO. 306 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR THE &STABLISHMENT OF NO PARK- ING a.IRE LANE ZONES NEXT TO BUSINI. SS OR COMMERCIAL ESTAB- LISHM&NTS; TO PROVIDE FOR PEN ALTIES FOR PARKING IN A DESIG- NATED° NO PARKING FIRE LANE ZONES; REPEALING PRIOR CON- FLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDF NANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK,IDAHO: Section 1. Purposes. (a) The purpose of this ordinance is to provide a means whereby no parking zones adjacent to buildings or commer- cial establishments may be designated for purposes of keeping a lane open for access by fire department and other emergenWcy� equipment. (b) The establishment of such fire zones and the enforcement of no parking within those fire lanes is a reasonable exercise of the City's police power to prohibit stopping, standing or. parking as provided by Idaho Code Section 49-582. Section 2. Amendment of Section 10.04-050, Section 10.04.050 is amended by adding thereto a subsection Q as follows: 0. In an area designated as a 'fire lane' or 'no parking -fire lane' area. Section 3. Enactment of Section 10.04.090. There shall be added to the Chubbuck Municipal Code a Section 10.04.090: 10.04.090. Creation of No Parking - Fire Lane Areas Upon Private Property. A property owner may designate and mark an area for a fire lane adjacent to a commercial or business establishment, which fire lane shall be created for the purposes of keeping an area free for access by fire department and other emergency vehicles. Such fire lane shall be conspicuously painted and shall be clearly marked by a sign visible from the entire fire lane, which sign shall be at least thirty-six (36') inches above the ground and shall indicate 'No Parking - Fire Lane' or some similar wording. Law enforcement officials are empowered to enter upon private property open to public use to enforce the provisions of this section and 10.04.050(0). ADMINISTRATIVE PROVISIONS Section T. Repeal of Conflicting Ordi- nances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent juris- diction, such holding shall not effect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requir- ing an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publica- tion as provided by law.
