SUMMARY OF
ORDINANCE NO. 365
An ordinance of the City of Chub -
buck, Idaho adding definitions to
the Chubbuck Municipal Code of a
screening fence and a solid fence;
providing that a solid fence shall be
used for non-residential uses abut-
ting residential districts and provid-
ing that landscaping or screening
sufficient to reduce the minimum
yard requirements by 50% shall be
determined by the building inspec-
tor or the building official, subject
to review by the Land Use and De-
velopment Commission and the City
Council; amending 18.12.030(E) to
provide a solid fence be used be-
tween drive in establishments and
residential property or residentially
zoned areas and further providing
that the fence shall be a minimum
of six foot in height; amending
Chapter 18.12.030(H) to provide for
screening fences around kennels;
amending Chapter 18.12.030(J) to
provide screening fences around
areas for the outdoor storage of
commercial and industrial prod-
ucts; amending Chapter
18.12.030(K) of the Chubbuck Mu-
nicipal Code to provide for a solid
fence around production building
cluster arrangements; amending
Chapter 18.12.030(N) to provide for
a screening fence around vehicle
storage sites; amending Chapter
18.12.040(D) to provide for a solid
fence around certain trash areas
and amending Chapter 18.12.040(E)
to provide for fences to be gener-
ally six feet in height, but providing
that the building official, building
inspector or their designee may au-
thorize a fence of up to eight feet in
height, based upon a consideration
of certain factors; providing for the
repeal of prior conflicting ordi-
nances; providing for the severabil-
ity of the provisions of this ordi-
nance and; providing for waiver of
the rule requiring the ordinance to
be read on three separate occasions
and providing that this ordinance
shall become effective upon pas-
sage, approval and publication.

of the contents of this ordinance.
