DESIGN REVIEW DECISION
DATE: October 5, 1995
APPLICANT: Lee Madden
PROJECT: Fence Material For Impound Storage Yard at 145 East
Linden, Chubbuck, ID
Pursuant to the direction of the Land Use and Development Commission in
issuing the conditional use permit as affirmed by the Chubbuck city Council at the
October 5, 1995 meeting, Lee and Cindy Madden presented a proposal for an eight foot
high metal fence around the impound yard. The fence Posts would be four feet apart
with cross rails. The metal would be off white in color and would be durable except for
damage from people running into it. Madden's proposed to have a steel bar gate with
tracking wheels that swung open. The green area on Linden was discussed as was the
existing steel posts and cable there now. After consideration, the Design Review
Committee reached the following decision:
A- The metal material for the fence is approved and an eight foot high
fence with fence posts four feet apart with cross rails is approved. The metal will
be facing the outside of the fence.
B. The green area on Linden would need to be 10 feet deep. The steel
posts and cable will be moved back by the neighbor's fence to keep vehicles from
running into it.
C. The fence will be put up within six weeks and installed four feet off
center from the canal pursuant to the decision of the Land Use and Development
Commission as affirmed by the Chubbuck City Council.
Pursuant to Idaho Code S 67-8001 et seq., the Design Review Committee makes
the following findings with respect to the decision in this action:
A- This Action does not result in a permanent or temporary physical
occupation of private property.
B. This Action does not require the property owner to dedicate a portion
of the property or to grant an easement.
C. This Action does not deprive the owner of the property of all viable
uses of the property.
D. This Action does not have a significant impact on the landowner's
economic interest.

E- This Action does not deny a fundamental attribute of ownership.
F. This Action does not serve the same purpose that would be served by
directly prohibiting the use or action; nor does the condition imposed substantially
advance such purpose.
