HomeMy WebLinkAbout08 04 1998CORRECTED COPY DESIGN REVIEW COMMITTEE MEETING MINUTES August 4, 1998 DESIGN REVIEW SUBJECT: Big Bear Chevron Addition - 4259 Yellowstone Ave. DATE: August 4, 1998 APPLICANT: Dave Nutting PROJECT: Pump relocation and new Canopy - 4259 Yellowstone Ave. Present: Mayor John O. Cotant, Attorney "Thomas J. Holmes, Steven Smart, Cary Campbell, Eric King, Ron Conlin, Jerry Rowland and Larry Kohmopp. Dave Nutting, Big Bear Chevron and Attorney Stephen Herzog were present. Mr. Nutting was told there are several items he needs to address in order to continue work on the project: SEE ATTACHED COPY OF CARY'S ORDER OF WHAT HAS HAPPEN. 1. To present a set of documents to the Building Department addressing the structural analysis of the canopy. 2. A set of documents addressing lot lay out and the general concerns as requested by the Design Review Committee. 3. A set of documents addressing the lay out and design of the underground fuel lines and extension and relocation of the fuel pumps. 4. Big Bear Chevron will be required to purchase a new permit, it will be based on the overall cost of the project. The initial minimal permit fee was not adequate for what they are actually doing. Mr. Nutting was directed to present these requests to the Design Review Committee at a meeting on August It, 1998, at 11:00 a.m. July 21, 1998 RE: Meeting Big Bear Construction Project. Attended by; Dave Nutting, Mary Christensen, James Day, Gerd Dixon, Eric King, Ray Griffin, Cary Campbell. Larry Kohntopp and Steve Smart Attended part of the meeting. Due to lack of design information, Cary reissued the stop work order to James Day on the Big Bear project that was apparently lifted by the design review committee. From this meeting it appeared that the design review committee on July 10`", had given Big Bear the OK to continue the erection of the fuel island canopy in the relocated area, for which the original stop work order had been issued. At this time a building permit has not been issued for the relocation of the canopy nor has one been issued for the relocation of the fuel pumps, islands or the underground fuel lines. Cary told James that the permit had not been issued for the relocation of a canopy but to replace the existing canopy. It was also issued based on the design documents being sealed by a design professional. He also said that he believed the permit had been issued based on misinformation. At this time the sealed set of documents have not been received by the building department. (During a break in this meeting James left and upon his return reported that the sealed information on the canopy was being Fed. Exed. today.) Eric said he had mentioned to James on an earlier occasion, when James apparently had been doing a job at the K & B store that he needed to contact Cary at city hall to discuss the requirements for the changing of fuel lines. This contact was not made. Based on the requirements of the earlier Design Review meeting a scaled set of documents were to be presented to the Design Review Committee detailing the information requested by them. The lot lay out plans were to include, green areas, onsite water and fuel spill containment as well as the location of the gas lines. This information has not been presented for the committee's review at this time. Mr. Nutting was also reminded he was asked to have some sort of documentation from the Idaho Transportation Department and the Chevron company stating they felt comfortable with their areas of authority. Dave and James were told there were several items they needed to address in order to continue to work. The third was a sealed set of documents addressing the lay out and design of the underground fuel lines and extension and relocation of the fuel pumps. The fourth item was to have a date by which the three foregoing requirements were to be in to the city. (That date has now been determined by their design professional, Steve Wallace, Architect, to be July 29,1998.) They were told when that date (July 29th) date was determined they would be allowed to proceed. They were also told they could not permanently cover any of the work they had done until it was inspected and approved by city staff and Big Bear's design professional. If all of the foregoing information has not been received by the city by July 29, their work will be stopped and they may not resume construction until the we have received it and it has all been approved and permitted. If the information has been received by July 29, or before it will investigated by those who are responsible for its approval. When approved, the necessary building and fire permits will be issued and the construction documentation will take place. 72398 Jim Day hand delivered the sealed design calculations to the building department on July 23 e 1130 hours. (cec) 72498 Dave came into the office to discuss his project. We spoke about the need to eliminate as many access onto the highway as possible. Discussion included the possibility of Mr. Nutting sharing his northern access with the Oxbow for their access to the west of his building. Required parking and it's So green area were discussed. I told him it is my believe that the 5t was based on the required parking for the building and its access to and from the public way. We also talked about green areas in general and how they related to the runoff retention, and how the green area and the water retention areas could be one in the same. 72798 Talked to Steve Wallace about a meeting which will be at 1600 in his office with those concerned about this project so that we may try to get something acceptable for the design review committee. Also called Roy Frisk about the electrical on the job, he said he had checked some of the preliminary work but has not made a final inspection. 72798 Jim Day came in and said Dave Nutting had received a letter from the designer that he would not approve the project without seeing what was covered up. He wanted me to approve it anyhow. I told him he would have to satisfy the designer and if that meant that he would have to cut concrete to expose the work he would have to do so. Box 1412 Pocatello, Idaho 83204-1412 Hand Delivered It is my understanding that the City has been provided with a copy of a letter from Chevron dated July 29, 1998 regarding Chevron's general approval of the present layout of Big Bear Chevron. It is also my understanding that the City, after reviewing the letter, has taken the position that the City, in spite of the letter, is not willing to approve the location of the pump island. It would be of great benefit to my client if the City could spell out what, if anything, Big Bear can do at this point ---short of moving the island ---that would persuade the City into approving the pump island location. Mr. Nutting suggested that he would be willing to install signs on the island stating something to the effect that: "trailers over 28' are prohibited at this pump island". If the City is interested in following through with this idea, we can discuss the size, location, and style of the sign. I was under the impression, after the meeting with the design review committee on July 28, that after receiving the letter from Chevron, the City would be inclined to approve the island location. My intention at this point is not to force the City to make the decision to either reject or accept the island location. My client just needs to know if there is anything more he can do to convince the City that it should permit the island to remain in its present location. Finally, I have enclosed a photograph that was taken at Big Bear yesterday by Mary Christensen. The trailer in the photograph is 33' long, according to Mr. Christensen. Please note that the trailer, even with its lengthy load, does not obstruct the sidewalk OR street.
