DESIGN REVIEW SUBJECT: Landscaping Site Plan at 4818 Yellowstone Ave.

PROJECT: Landscaping
Present: Mayor John 0. Cotant, Steve Smart, Cary Campbell, Jerry Rowland, Larry Kobntopp,
Ron C. Conlin, Jim Phelps and Gerd Dixon.
Steve & Barbara Steele presented a landscaping site plan for their portion of mini -mall at 4818
Yellowstone Ave.
After discussion, Design Review Committee approved the landscaping site plan presented,
subject to the site plan being completed prior to, Labor Day, September 7, 1998.

DESIGN REVIEW SUBJECT: Big Bear Addition Construction
DATE: July 28, 1998
APPLICANT: Dave Nutting
PROJECT: Big Bear Construction at 4259 Yellowstone Ave.
Present: Mayor John 0. Cotant, Steven Smart, Cary Campbell, Jerry Rowland, Ron C. Conlin,
Jim Phelps, Larry Kohntopp and Gerd Dixon.
Present representing Big Bear Chevron: Steve Wallace, Architect, Steve Herzog, Attorney and
Dave Nutting.
Due to a lack of design information Cary Campbell reissued the stop work order to James Day
on the Big Bear Chevron Project. Design Review Committee on July 7, 1998 had given
Big Bear the OK to continue the erection of the ftiel island canopy in the relocated area,
for which the original stop work order had been issued. At this time a building permit had
not been issued for the relocation of the canopy nor has one been issued for the relocation
of the fuel pumps, islands or the underground fuel lines.
Based on requirements of the earlier Design Review Meeting a scaled set of documents were to
be presented to the Design Review Committee detailing the information requested by the
them. The lot lay out plans were to include, green areas, onsite water and fuel spill
containment as well as the location of the gas lines. This information has not been
presented for the committee's review prior to this meeting.
Steve Wallace presented an architect's site plan of the Big Bear Construction Project:
1. Plan shows two accesses on Yellowstone Ave. - One to the south and one to the north
which will be shared with the Oxbow.
2. Plan shows on site collection of storm drainage.
3. 10' Landscaping strip with automatic sprinkling system.
4. 8 car parking area.
Design Review Committee expressed concern about larger vehicles backing up traffic
ontoYellowstone Ave. Dave Nutting explained what he thought the traffic patterns would
be on the site plan.
PWD Smart explained the Access Management Guidelines of the City, stating this plan does not
meet the access management guidelines, therefore should be denied.
Dave Nutting stated, he felt like he is caught in the middle, because his contractor did not present
the City with the required plans. Mr. Nutting said the project is 90% finished and he does

not know what to do.
Mr. Nutting said Chevron Co approved the project.
PWD Smart stated, if the plans were brought to the City for permits prior to construction of the
project, Mr. Nutting would have been required to move the south access as far to the
north as possible.
Discussion about possibility of adjusting the site plan. Mr. Nutting stated, the construction is too
far along, also because of the 13 year lease on the property, this is the only feasible way
financially, the property will work.
Mayor Cotant suggested Chevron should be involved in approving the site plan
After discussion, Design Review Committee directed Mr. Nutting to get a letter of approval from
Chevron, attached to Wallace -Hudson Architect's site plan and present to PWD Steve
Smart and Attorney Tom Holmes.
Design Review Committee was in favor of allowing Mr. Nutting to proceed with, landscaping,
with automatic sprinkling, the canopy can also be inspected. Big Bear Chevron, Dave,
Nutting is responsible for any and all costs if the site plan is not approved by Chevron
and City of Chubbuck.

RE: Meeting Big Bear Construction Project.
Attended by; Dave Nutting, Mary Christensen, James Day, Gerd Dixon,
Eric King, Ray Griffin, Cary Campbell. Larry Kohntopp and Steve
Smart Attended part of the meeting.
Due to lack of design information, Cary reissued the stop work
order to James Day on the Big Bear project that was apparently
lifted by the design review committee. From this meeting it
appeared that the design review committee on July loth , had given
Big Bear the OK to continue the erection of the fuel island canopy
in the relocated area, for which the original stop work order had
been issued. At this time a building permit has not been issued
for the relocation of the canopy nor has one been issued for the
relocation of the fuel pumps, islands or the underground fuel
lines.
Cary told James that the permit had not been issued for the
relocation of a canopy but to replace the existing canopy. It was
also issued based on the design documents being sealed by a design
professional. He also said that he believed the permit had been
issued based on misinformation. At this time the sealed set of
documents have not been received by the building department.
(During a break in this meeting James left and upon his return
reported that the sealed information on the canopy was being Fed.
Exed. today.) Eric said he had mentioned to James on an earlier
occasion, when James apparently had been doing a job at the K & B
store that he needed to contact Cary at city hall to discuss the
requirements for the changing of fuel lines. This contact was not
made.
Based on the requirements of the earlier Design Review meeting a
scaled set of documents were to be presented to the Design Review
Committee detailing the information requested by them. The lot lay
out plans were to include, green areas, onsite water and fuel spill

information has not been presented for the committee's review at
this time. Mr. Nutting was also reminded he was asked to have some
sort of documentation from the Idaho Transportation Department and
the Chevron company stating they felt comfortable with their areas
of authority.
Dave and James were told there were several items they needed to
address in order to continue to work. The f irst was to have a
sealed set of documents to the building department addressing the
structural analysis of the canopy. The second was for a set of
ls� documents addressing lot lay out and the general concerns as
requested by the design review committee. The third was a sealed
set of documents addressing the lay out and design of the
underground fuel lines and extension and relocation of the fuel
pumps. The fourth item was to have a date by which the three
foregoing requirements were to be in to the city. (That date has
now been determined by their design professional, Steve Wallace,
Architect, to be July 29,1998.) They were told when that date
(July 2 9th ) date was determined they would be allowed to proceed.
They were also told they could not permanently cover any of the
work they had done until it was inspected and approved by city
staff and Big Bear's design professional. If all of the foregoing
information has not been received by the city by July 29, their
work will be stopped and they may not resume construction until the
we have received it and it has all been approved and permitted. If
the information has been received by July 29, or before it will
investigated by those who are responsible for its approval. When
approved, the necessary building and fire permits will be issued
and the construction documentation will take place.
72398 Jim Day hand delivered the sealed design calculations to the
building department on July 23 @ 1130 hours. (cec)
72498 Dave came into the office to discuss his project. We spoke
about the need to eliminate as many access onto the highway as
possible. Discussion included the possibility of Mr. Nutting
sharing his northern access with the oxbow for their access to the
west of his building. Required parking and it's 50-. green area were
discussed. I told him it is my believe that the 5t was based on
the required parking for the building and its access to and from
the public way. We also talked about green areas in general and
how they related to the runoff retention, and how the green area
and the water retention areas could be one in the same.
72798 Talked to Steve Wallace about a meeting which will be at 1600
in his office with those concerned about this project so that we
may try to get something acceptable for the design review
committee. Also called Roy Frisk about the electrical on the job,
he said he had checked some of the preliminary work but has not
made a final inspection.
72798 Jim Day came in and said Dave Nutting had received a letter
from the designer that he would not approve the project without
seeing what was covered up. He wanted me to approve it anyhow. I
told him he would have to satisfy the designer and if that meant
that he would have to cut concrete to expose the work he would have
to do so.
The Building Department is served by nationally certified
inspectors. In addition to the 1996 edition of the National
Electrical Code and the CABO/ANSI A117.1-1992 Accessability Code

DESIGN REVIEW SUBJECT: 2-13 Trailer Sales
DATE: July 28, 1998
APPLICANT: H.C. Cheirrett
PROJECT: Landscaping and parking requirements at 4612
Yellowstone Ave.
Present: Mayor John 0. Cotant, Steven Smart, Cary Campbell, Jerry Rowland, Ron C. Conlin,
Jim Phelps, Larry Kohntopp and Gerd Dixon.
H.C. Cheirrett was present, stating he received a letter from Attorney Holmes, advising him he is
required to have completed landscaping and parking requirements prior to, June 1, 1998.
Mr. Cheirrett stated he was moving in the direction of completing the requirements of the
sprinkler system when the owner of the property put the property up for sale. Mr.
Cheirrett stated he is reluctant to complete the requirements if he does not purchase the
property.
Mr. Cheirrett asked for an extension on the requirements until, October 1, 1998. Mr. Cheirret
stated he will know for sure whether, or not he will purchase the property prior to
October 1, 1998
Jim Phelps stated the weeds on the property has not be cleared as required.
Mr. Cheirrett was told he should be using the meter on his property, rather than the house on the
next lot.
After discussion, Design Review Committee gave Mr. Cheirrett 60 days to complete the
landscaping, off street parking, paving to off street parking and access requirements, or
close the business. Mr. Cheirrett was directed to, when he finds out whether or not he is
going to purchase the property, he contact Gerd Dixon and Larry Kohntopp.
