HomeMy WebLinkAbout02 02 1999DESIGN REVIEW COMMITTEE MEETING MINUTES February 2, 1999 DESIGN REVIEW SUBJECT: East Chubbuck Road and Burley Drive Project DATE: February 2, 1999 APPLICANT: Gary Ratliff, 4970 Apache PROJECT: Commercial Development and Storage Unit Sheds. Present: Mayor John 0. Cotant, Attorney Thomas J. Holmes, Steven Smart, Cary Campbell, Jerry Rowland, Ron C. Conlin, Jim Phelps, Larry Kohntopp and Gerd Dixon. EAST CHUBBUCK ROAD COMMERCIAL AND STORAGE UNIT PROJECT - Gary Ratliff, 4970 Apache and Attorney Randy Kline were present to explain Gary Ratliff s Site Plan. Randy Kline expressed concern the City discriminated against Gary Ratliff by not allowing him to construct his storage sheds back in 1996. Attorney Kline stated, Nick Crookston who owns the property to the west of Mr. Ratliff, was never notified he is required to install his half of the street requirement. Mr. Ratliff does not feel he should Be required to front the monies to construct the complete street. Attorney Holmes said, Mr. Crookston was notified, and entered into a developmental agreement stating, he understands he is required to build his half of the street. Gary Ratliff was told, and is being told he can have a temporga access onto Yellowstone Ave. until such time, the Burley Drive Road is constructed. Mr. Ratliff is required to enter into an agreement with the City of Chubbuck, which will allow the temporary access, until Burley Drive is constructed. Mr. Ratliff will also have an access onto Burley Drive as he develops. Attorney Holmes stated, City is proposing a Local Improvement District on Burley Drive, this will get Burley Drive constructed, everyone involved will pay their share. Mr. Ratliff asked why Charlie Frasure was not told he is required to be involved in constructing the street. Attorney Holmes explained Charlie Frasure does not have frontage on the street. Mr. Ratliff stated he wants a temporary access onto Chubbuck Road and a building permit to build three storage units on the second Lot. Steve pointed out the preliminary plat that was approved for the subdivision has expired. Mr. Ratliff is required to go through the platting procedure again. Mr. Ratliff said he will get on the March, 99 Land Use and Development Meeting. 'N� 100 STAFF MEETING MINUTES - (cont.) February 2 d., 1999 City Staff will proceed with Local Improvement District on Burley Drive to get the street constructed. After discussion, Staff approved a building permit for three storage units on Lot 2, with the following conditions: 1. Gary Ratliff is required to go through platting procedure again, because prior plat approval has expired. 2. Temporary Access onto E. Chubbuck Road until Burley Drive is constructed, subject to entering into a Temporary Access Agreement with City of Chubbuck.
