DESIGN REVIEW SUBJECT: Copy Center
DATE: March 9, 1999
APPLICANT: Wayne Moon
PROJECT: Copy center at 4809 Yellowstone for a drive
through window.
Present: Mayor John 0. Cotant, Attorney Thomas J. Holmes, Steve Smart, Ray Giffin,
Jerry Rowland, Eric King, Myrna Crapo, Jim Phelps, Larry Kohntopp, Peter Anderson
Mori Byington, and Gerd Dixon
Wayne Moon presented a small Sketch showing the building.
Jerry Rowland would preferred that they didn't use the drive up window. His is concerned with
an accident happening at the comer. Jerry wondered if they had enough required parking spaces
with the drive up window spaces being unusable. Gerd Dixon went and measured the building
and Larry Kohntopp figured out the number of spaces that would be needed.
After discussion, Design Review Committed decided to wait and watch the comer to see if a
Problem developed and then take a look at that time.

PROJECT: IDAHO CENTRAL REMODELING OF BUILDING AT
4425 BURLEY DRIVE FOR FOREST SERVICE.
Present: Mayor John 0. Cotant, Attorney Thomas J. Holmes, Steven Smart, Ray Griffin, Jerry
Rowland, Eric King, Myrna Crapo, Jim Phelps, Larry Kohntopp, Pete Anderson Gerd
Dixon, and Mori Byington.
Chris Hyer and Brennan Construction Company presented a drawing of the proposed project and
explained what they were doing.
GSA are bring in Fish and Wildlife and a Refuge center. They are merging those two offices and
will share one office. With this addition it will leave one portion of the building vacant. They
hope to be full in 10 years. They will add one more exterior doorway.
Tom Holmes brought up the requirement of curb, gutter, and sidewalk around the building.
Because of the water problems, they need a swale. There would be a raised curb with cuts then a
swale and then a sidewalk.
They will put drainage in to pick up water that isn't flowing. Mr. Hyer is not opposed to doing
the street. They would like to have a nice road down Burley.
Jack Brennan questioned the status of the other property owners and putting in the curb and
sidewalk and then having to redo it.
Mr. Hyer of Idaho Central asked if they could give a letter of agreement that they will participate
in the L.I.D. He would like a change to look at what the city wants and then come back and meet
with us next week.
The Design Review Committee then discussed:
Putting in a sidewalk and swale now and then the curb later.
They are proposing to put up a small sign listing the businesses that are there.
They are looking at low key signs.
Eric King advised Mr. Hyer that the fire department will need a key into the new part. Eric asked
that they put the key in the same box that is there. The Fire Department needs to be able to get
through the magnetic locks. They need the punch code placed in the box with the keys and kept
updated.
The Design Review Committee gave them Permission to start their construction. They are
scheduled to meet March 16 at 10:30 PM with the Design Review Committee.

DEVELOPMENT AGREEMENT
This Development Agreement is entered into by and between
Idaho Central Credit Union ("Idaho Central")
and
the City of Chubbuck, Idaho, a municipal corporation ("Chubbuck")
FACTS:
A. Idaho Central is remodeling a portion of the office building at 4425 Burley Drive
("subject premisesfi).
B. The remodel triggers the development ordinances of the City of Chubbuck which
would include but not be limited to the installation of curb, gutter, drainage and sidewalk along
Builey Drive, both to the East and South of Idaho Central's building.
C. The City is currently reviewing the design of Burley Drive with respect to width,
drainage and other such matter and does not yet have a design standard for the curb, gutter,
drainage and sidewalk along Burley Drive at this time.
D. Idaho Central and the City enter into this Agreement to provide that the above
improvements by Idaho Central will not be required until such time as the design standards are
decided upon by City.
NOW THEREFORE in consideration acknowledged by each of the parties of this
agreement given by one to the other, the parties agree as follows:
I . Chubbuck will not require curb, gutter, drainage and sidewalk improvements to be
made to Burley Drive at this time,
2. Upon request by the City with reasonable notice to Idaho Central, Idaho Central
agrees install curb, gutter, drainage and sidewalk along Burley Drive in accordance with the
design standards approved by the City. Such design standard shall be uniform for Bur!cv Drive

Idaho Central building North to East Chubbuck Road. Idaho Central acknowle'd-es
such improvements would be beneficial to the subject premises.
