DESIGN REVIEW SUBJECT: 4937 Yellowstone Ave.
DATE: September 21 st, 1999.
APPLICANT: Steve Vigliaturo
PROJECT: Second hand store at 4937 Yellowstone Ave.
Present: Mayor John 0. Cotant, Attorney Tom Holmes, Steve Smart, Jim Sempek, Sean Harris,
Larry Kohntopp, Jerry Rowland, Eric King and Ron C. Conlin.
It is duly noted, Attorney Holmes law partner Mr. Robinson does do work for Steve Vigliaturo.
Steve Vigliaturo stated, Juan Cruz and Buck Hensley are planning to start"Sharkeez", a second
hand store of sorts at 4937 Yellowstone Ave. The owner is Steve Vigliaturo.
Mr. Vigliaturo stated, everything will be sold within the structure on the property.
The following requirements were discussed at length:
1. 10' Landscaping with automatic sprinkling. Mr. Vigliaturo said the trees on the
property will be cleaned up.
2. On site storm drainage management - Discussion about using the right slope to take
care of on site storm drainage.
3. Required to meet all Building and Fire Code requirements - Jim Sempek stated he will
need; a) Existing floor plans b) Proposed floor plans as soon as possible.
Mr. Vigliaturo said he will get plans to Building Department.
4. Parking layout plans - Needs to be paved and meet all ADA accessability requirements.
Five parking spaces are required.
5. Drive to parking is required to be paved.
6. There is a wood burning stove in the structure. If the wood burning stove is not UL
Listed the stove will have to be removed.
7. There is metal storage shed behind the structure that is required to be removed.
8. If a sign is installed, the sign is required to go through Design Review Committee for
approval, prior to being installed.
The Committee was in agreement, all the above requirements must be satisfied prior to
occupancy.

Juan Cruz and Buck Hensley are planning on starting "Sharkey's" , a second-hand store
of sorts at the above address. The owner is Steve Vigliaturo. I've scheduled them for a
Tuesday, September 21", 10:30 AM Design Review. See attached for your information.

STAFF MEETING MINUTES
September 14"., 1999
Present: Mayor John 0. Cotant, Attorney Thomas J. Holmes, Steven Smart, Jerry Rowland Jim
Sempek, Eric King, Ron Conlin, Sean Harris and Larry Kohntopp.
Steve reported Carl Richards, American Tower Co. expressed interest in installing a 250'-300'
cellular tower in the City. Discussion about having multiple companies on one tower.
Steve Smart and Larry Kohntopp are working with Mr. Richards.
Steve suggested the City get a plan in place to serve water -sewer to properties east of Pleasant
View, and possibly east of Interstate. Steve suggested the City contract with a firm that
can give costs. Mayor Cotant suggested the City get two or three proposals for the costs.
Jerry Rowland stated the Police Department has an extra video camera for installation in the
Public Works front entry. Jerry said there will be the cost of wire, installing, etc., Public
Works can have the video camera. Discussion about installing a panic button in the
Public Works Department, same as the one in Utility Billing Office.
Steve and Ron stated they have not received anything from Roy Lacey on his invoicing for park
dedication in Espie Subdivision. Attorney Holmes stated he will follow up.
Discussion about proposed Local Improvement District No. 2. Steve stated Engineering received
Gary Ratliff s Final Plat, but has not had time to review. Steve suggested the Local
Improvement District No. 2 be tabled. Attorney Holmes stated the City can table the item
for a period of time, rather than tabling every agenda. It was suggested the Local
Improvement District No. 2 be tabled until first meeting in January, 2000.
Discussion about Joshua Ellis application for a change of Land Use District for 706 Washburn to
(R-2). It was suggested the proposal be approved for (R-2), but, Mr. Ellis be required to
build to (R-1) Standards. -
Larry Kohntopp stated, Glen Shukie, owner of Nitro -Green on E. Linden Ave. wants to operate a
horse trailer sales, etc. from his property on E. Linden Ave. Mr. Shukie was told he is
required to go before the Design Review Committee if he is to sell horse trailers from his
property on E. Linden Ave. Larry Kohntopp said he will watch the property.
Larry Kohntopp stated, John Jackson, Jackson Food Store, 5059 Yellowstone Ave. has agreed to
all requirements put on by the Design Review Committee, August 24"., 1999 with
exception of, 10' landscaping requirement on north side of property, (Stuart Ave.) Mr.
Jackson said he would like to put in a 5' landscaping area because of customers parking
on the north. After discussion, Staff was in agreement, Mr. Johnson can install a 5'
landscaping strip on area to north of his store. It was suggested, he use trees in the
landscaping to the north. Larry Kohntopp will advise.
