Wendy's Restaurant 4519 Yellowstone Ave. Site Plan Approval. Present: Mayor John O. Cotant, Attorney Thomas J. Holmes, Steve Smart, Richard Webb, Ray Griffin, Eric King, Ron Conlin, Jean Higgins and Larry Kohntopp. Trent Siddoway, Wendy's was present to present his site plan for a Wendy's at 4519 Yellowstone Ave. Mr. Siddoway was told the development can not have access to Yellowstone Ave, but can have two accesses to Parrish Lane. Mr. Siddoway stated he talked to the Wendy's people, Wendy's people said the development will not work if there is not an access to Yellowstone Ave. Mr. Siddoway agreed with Wendy's and asked the Design Review Committee what steps he would have to take to get an access from Yellowstone Ave. Mr. Siddoway was advised the next step if Design Review Committee denied the access is for Mr. Siddoway to take the proposal to the City Council. Mr. Siddoway explained why he did not think the requirement of accessing to and from Parrish Lane only, would not work. Design Review Committee agreed to give Mr. Siddoway one access that would be a shared access with property to the south of 4519 Yellowstone. There is an issue of moving a power pole to make that access work, but it could work. The one access to Yellowstone Ave is required to be to the far south of Mr. Siddoway's property, it is not quite the required 150' from Parrish Lane, but is close. Design Review Committee decided there will only be one Parrish Lane access if Wendy's gets shared access approval on Yellowstone Ave. After discussion, Mr. Siddoway was told the only way this can work is if the State approves the one access. Mr. Siddoway said he will take the proposal to the State for approval. October 1, 2003 City of Chubbuck-Design Review Committee 5160 Yellowstone Chubbuck, Id 83202 Dear Committee; I am writing you this letter in response to the meeting that I attended yesterday with your committee. First of all, let me say that I appreciate the time that was spent by the committee considering my proposal to build a Wendy's restaurant in Chubbuck. I have had a good feeling about Chubbuck for a long time and look forward to being part of your community as we move forward on this project. The main reason for this letter is to respond to the proposal that you gave to me at the meeting, of having two entrances on Parrish Lane, and no entrances on Yellowstone. I met at the site yesterday with a Wendy's representative, and my engineer. After reassessing the situation we could only come back to the same conclusions that we had before. We are still asking for two entrances on Yellowstone, and one on Parrish lane. Here is our reasoning: It is totally unacceptable to us to stack cars in a turn lane of a city street to form our drive thru line. I can not imagine that your city would think this a viable solution. 2. I am purchasing two lots that together currently have three curb cuts on Yellowstone, and three curb cuts on Parrish lane. We are only asking for half of those to remain. This is a reasonable request. Currently there are two separate companies doing business out of these curb cuts, so there is already traffic impact there now. The impact of our one business replacing the two of them will be minor. There would be very little if any alterations to traffic flow on Yellowstone. This block of Yellowstone is a gateway to your city. Currently one of the first things that you see entering Chubbuck is a piece of property full of used RR ties. It sits next to a small building that has no landscaping, no organized parking, and sits too close to the street and corner. We have a good track record of building and maintaining attractive buildings. We landscape them, and keep up the maintenance on our buildings and landscaping. Increased property taxes. Need I say more on this subject? 5. Parrish Lane is a dead end street. Cars will all have to enter and exit from Yellowstone. If this were a through street, it would make Parrish Lane more attractive as an alternative. I believe that funneling all cars in and out of Parrish Lane will be very frustrating to customers. 6. Increased jobs in Chubbuck We will continually employ forty to fifty people. The bottom line to me is simple. We will be an asset to the city of Chubbuck. This location is our best option. This is a win-win for both of us. Please do not put an end to this project by limiting access to this property. There has been business enacted on this property for a long time without traffic problems. This is a commercial street, and it is the goal of all business on this street to attract customers. We will be no different. A car slowing down to turn directly into our lot, will not impede traffic any more than if they were slowing down to turn onto Parrish Lane. Cars exiting directly from our lot will not impede traffic any more than cars exiting from Parish Lane. I keep hearing about new regulations and rules. I can't accept that. If you want new business to come to Chubbuck, you have to give them the opportunity to compete with other business in the area. We feel that a restaurant with good access and good traffic flow has a distinct advantage over a restaurant with poor access and poor traffic flow. It is that simple. PLEASE ALOW US THE SAME OPPPORTUNIES THAT OUR COMPETITORS HAVE! I would be happy to come back to your meeting next week and answer any more questions. Please give these considerations some thought. The Design Review Team meets every Tuesday morning between the hours of 10:30 and 12:00 Noon. This team will work in unison, with you, to establish the criteria for your project as it relates to the adopted ordinances of the City of Chubbuck. Keep in mind, this is an informal review and is only conducted on submitted applications. This is a review team not a design team. Provide (6) six sets of drawings at least eight days in advance of your scheduled meeting. Formal reviews of your plans or project by City staff is conducted after formal application. Once you make your appointment and it is verified, it is very important to keep that appointment so others can be scheduled accordingly.
