PURPOSE OF REVIEW: Childcare relocation
Present: Mayor Steve England, Councilman Kermit Morrison, Attorney Thomas J. Holmes,
Steve Smart, Larry Kohntopp, Paul Andrus, Ron Conlin, Randy Severe, Andy Despain,
Ray Griffin, Eric King, Patty Unruh, Jean Higgins and Merlin Miller.
Christine and Larry Baab were present to present their plans on a childcare relocation.
The Baab's decided they will use two locations for their daycare facility, one on Belva and one
at 5009 Yellowstone Ave. Christine and Larry Baab were advised they are required to
have two business licenses.
Christine Baab stated the infants and children will be in separate locations.
Christine and Larry Baab were advised City Code states a licensed supervisor is required to be
with children at all times, children are not to be left without a licensed supervisor for any
reason. This means a licensed supervisor is required to be in the same room at all times.
The site plans were approved subject to the following:
1. Discussion about off street parking, the required paving deadline is required to
be completed June 30"'' 2008
2. Landscaping with automatic sprinkling is required.
3. Required to have on site storm water drainage.
4. Required to have two business licenses, one for each location. When applying
for business licenses the State Health Department is required to inspect food
service application.
5. Required to comply with Chubbuck Daycare Facility Code.
6. Required to work with Fire Department in regards to the required knox box.
7. Required to have a visible street address.
8. Required to install a street type approach.

DESIGN REVIEW MEETING APPLICATION
The purpose of this application is to establish a meeting and review time with the City of
Chubbuck Design Review Team consisting of the Mayor, Building Official, City
Planner, City Engineer, Fire Marshal, Police Chief and other City staff as required.
The Design Review Team meets every Tuesday morning between the hours of
10:30 and 11:30 AM.
This team will work in unison, with you, to establish the criteria for your project as it
relates to the adopted ordinances of the City of Chubbuck. Keep in mind, this is an
informal review and is only conducted on Submitted applications. This is a review team
not a design team.Provide (10)ten sets of drawings, (8 1/2 X 11), at least eight days in
advance of your scheduled meeting. Formal review of your plans or project by City
Staff is conducted after formal application. Once you schedule your Design Review,
it is very important to keep that appointment so others can be scheduled accordingly.

Design Review Purpose: To guide the general appearance and arrangement of commercial,
industrial and intense residential uses in order to create an attractive and dynamic "downtown
business center", assure the compatibility of satellite commercial establishments and industrial
areas with their surrounding neighborhoods, and assure the compatibility of dense residential
land uses with surrounding neighborhoods.

Kris Babb's application denied in May of 2006
Tiffany Babb's application issued in May of 2006
Initial Inspection May 30, 2006
Day Care opened in June of 2006
June 16, 2006 Inspection done-
Tiffany Babb warned that Nathan Babb as well as her husband would have to be licensed
in order to be allowed around the children. At that time Kris Babb was observed at the
day care in the kitchen. Tiffany Babb was warned about her license denial and advised
she could not work in the center where the children were.
July 15, 2006- Another inspection of the facility was done and unlicensed providers were
found. At that time Tiffany Babb was advised again that the facility was in violation.
Oral Warning issued
August 14, 2006- Received anonymous complaint of unlicensed providers working at the
facility.
August 15, 2006-Inspected facility
Violations:
-15 children left unattended
-Unlicensed providers Amanda Hall and NaLani Collins were found watching children.
-Violation involving Daycare Records and sign in and out sheets were also observed
Oral Warning issued
August 21, 2006, advised by Patty Unruh that all employees licensed
September 19, 2006, letter sent to daycare advising problems
December 22, 2006, inspection of the facility done
Violation:
-Jennifer Millward an unlicensed provider watching children
-Other minor violations were located
Oral warning issued
January 4, 2007, Inspection of the facility
No violations noted

April 17, 2007, received complaint called in reference provider/child ratio being in
violation. Advised that Kris Babb was watching children within the facility. Also
advised that two children were found outside the facility and in the front of the building
by themselves.
April 17, 2007, Inspection of the facility
Violation:
-1 provider watching 17 children in the back of the facility. 19 other children were
located inside the facility with 3 other providers. Workers were to advise Tiffany Babb
that we had been at the daycare and to have her call us.
April 18, 2007, Unruh and myself responded back to the facility
Violations:
- Vesta Wigington found unlicensed and working at the daycare. At that time,
Nathan Babb was advised to have Tiffany contact us upon her return to the
business.
That afternoon Unruh and myself met with Tiffany and Nathan Babb at the office. They
again were warned about the problems of provider/child ratio as well as the other
problems that we were finding. Tiffany denied knowing anything about children
wandering outside the facility or that Kris Babb was watching children. Tiffany did say
that they were in the process of building a fence going from the building to the back
playground in order for the children to be in a secured area. Babb was again advised that
I would be citing her if she was found in violation again. At that time, her and Nathan
Babb both advised they understood.
On May 17, 2007, received a call from Tiffany Babb, Babb said that she had fired Diedre
White. That White was causing problems and had been harassing the business since she
had been fired.
June 5, 2007, facility inspected and no violations found.
November 6, 2007, received complaint that sinks were leaking in the common area of the
facility. A second complaint was in reference to?he children only eating peanut butter
and jelly and noodles. The complainant also said that she was picking up children from
the daycare and that she was not an authorized party listed as being able to pick up
children from the facility.,
November 7, 2007, facility inspected
Violations:
-Leak found under sink(Babb advised leak had been there for 1 to 2 weeks). Babb
advised the leak would be fixed immediately.
January 18, 2008, I received a complaint of the daycare being dirty and unsanitary.
January 18, 2008, Unruh and myself inspected the facility
Violations:
-20 children had been left with 1 provider, Randii Walker. Walker is in the process of
being licensed, but the licensing is not complete and she is not to be left alone with any of
the children.
-1 infant was left in a back room of the facility upon another provider coming from the
back of the building.
-Unruh and myself were able to enter the facility and walk into the common area of the
daycare. Unruh and myself stood in the common area for some time before being noticed
by Walker who was writing in a tablet at the back of the room.
-fire alarms at the front of the business was "chirping".
-Upon checking the bathroom used by the children. The toilet was dirty and appeared to
have been used. Toilet paper was scattered all over the floor and appeared as if children
had been playing in the toilet.
-The facility appeared very dirty and smelled badly.
Walker and the other worker, Kolayna Wolters, advised that Wolters was cleaning up a
back room because Geri Poston had left without doing so. It was later learned that
Poston's license had been revoked on 12/5/07. The letter was sent to Poston as well as
Tiffany Babb at that time. On 1/31/08, Poston brought in the proper paperwork for her
licensing and the license is under review for renewal at this time.
Due to past problems and similar incidents, Tiffany Babb was cited for failure to comply
to the provider/child ratio, a violation of ordinance 6.04.110A.
